Serbia Gambling Guide
| Summary: Gambling is legal in Serbia since 2006 (officially the Republic of Serbia, a poor Eastern European country, only independent since 2006, not a member of the EU, has a population of 6.8 million).

Serbia is only independent since 2006. However, gambling on the territory predates the modern state of Serbia.
1964 – The first written record of gambling is from 1964, when Serbia was still part of Yugoslavia (along with Montenegro, Bosnia and Herzegovina, Croatia, Macedonia, Montenegro, Kosovo and Slovenia).
Some forms of gambling were made legal in Yugoslavia (e.g.: regional lotteries, horse racing betting) after World War II., to stimulate the post-war, ruined economy, and to help develop the tourism sector.
Under the Yugoslav ‘Law on Games of Chance’ enacted in 1964, the authorities created a distinction between ‘special games of chance’ and ‘classical games of chance’ – a distinction which still used in Serbia’s gambling legislation today.
Special games of chance were played inside casinos, but these were exclusively for foreign tourists, locals were in fact not allowed to enter such venues for a very long time.
/Comment: The first casino opened in Serbia’s capital, Belgrade, in the 1960s, and indeed locals were not allowed to enter (today Egypt is in a similar situation)./
2004 – The new gambling legislation comes into force, which modernized the legal framework of gambling in Serbia. This was the main piece of the gambling legislation up until 2020. Serbia was not independent at this point, it was in a union with Montenegro (independent only from 2006).
2008 – Kosovo declares independence. Serbian gambling laws do not apply to Kosovo from 2008. Kosovo is a muslim majority country, and as such it outright banned gambling.
2011 – After Serbia’s Independence from Montenegro and Kosovo’s secession the gambling legislation was overhauled once more. This overhaul legalized online gambling officially. However, online gambling was only really regulated in 2013.
2020 – The new gambling legislation comes into effect, with the passing of the Act on Games of Chance 2020, details can be seen below.
Gambling is legal in the Republic of Serbia since its formation in 2006. The current main piece of the gambling legislation is the 2020 Act on Games of Chance1, which allows the following forms of gambling:
- classical games of chance (e.g. lottery and lottery-like games, e.g.: raffles, bingo, scratchcards)
- special, or other games of chance (e.g. casino gambling, slot machines and sports betting)
- internet gambling games (online gambling)
- prize competitions
Online gambling is also legal in Serbia, since 2011 (but it is only really regulated since 2013). Actually, online gambling was legal prior to 2011 in a very limited form, and it was only legal for the state-owned Serbian national lottery.
The 2011 Law on Games of Chance2 dismantled the online gambling monopoly of the State Lottery (except for lottery, bingo and lottery-like games) and allowed foreign, private operators to apply for an online gambling licences in Serbia (details can be seen below, in the Serbian gambling licensing section).
The new legislation also included a clause that made it possible for the government to block unlicensed foreign platforms through Internet Service Providers.
/Comment: A blacklist of 70 sites was created in 20123 by the Ministry of Internal Affairs and the Serbian Gaming Board, which since then has grown to include over 13 000 websites, and it is still growing./
Authorities also asked financial institutions to ban transactions related to unlicensed gambling sites. However, banks refused to comply for legal reasons, and this hasn’t been attempted ever since.
Because of these strict measures we definitely do not recommend visiting unlicensed offshore gambling websites. Stick to Serbian licensed internet wagering platforms (you can see a list of licensed gambling websites, which accept players from Serbia below). However, players, who visit unlicensed sites by mistake are not prosecuted, but it’s definitely illegal.
Even though online gambling was legalized in 2011, it was not fully regulated until 2013. The licensing system needed refinement, and licenses were not issued to private companies prior to 2013. You can read an extremely detailed presentation about this here if you are interested.
UPDATE 2021: The gambling legislation was amended again in 2020 (Official Gazette of the Republic of Serbia, No. 18/20204), this aimed at harmonizing the Serbian gambling legislation with EU directives (Article 56 TFEU5 and Article 8 of Directive 98/34/EC) in preparation of the eventual EU membership, probably sometime in 2025 (according to current estimates).
The most important changes are:
- general improvements to definitions of various gambling expressions, industry specific words
- further liberalization of the Serbian gambling market by making it easier for private companies to get an online gambling licence in Serbia by more clearly defining and quantifying requirements, especially licensing requirements for foreign companies registered in EU member countries
- social responsibility aspects are now taken into consideration, advertisements can only appear in places where they can’t be seen by minors, and must be accompanied by an 18+ sticker, or similar clear indication of the legal gambling age
- gambling addiction, problem gambling prevention is now more of a focus, a warning, info, and steps to take in case of gambling addiction must be included in advertisements, in clear view (similarly to cigarettes)
- overhauled the regulation of sweepstakes for goods and services, by non-gambling legal entities, or for non-gambling purposes, which was a legal gray area so far
- banned the use of the words “casino”, “sazino”, “kasino” or “kazino“ to be used in advertisements, promotions or on social media (everywhere, except in accounting, legal or in professional, business context)
- sports betting social responsibility improvements, e.g: prevents match-fixing by prohibiting companies who own or co-own a sports clubs, teams, or are active in sports events organization to be involved in any kind of sports betting activity
This is the biggest amendment to the the Games of Chance Act since 2011.
The Red Cross of Serbia receives 40% of government revenue collected from gambling.
/Comment: This is praiseworthy. I wish more countries would pledge a percentage of their gambling revenue, especially such a high percentage of the gambling tax revenue, to a good cause. I hope this will be copied by other countries./

Can tourists play online from Serbia?
Yes, the laws discussed on this webpage only apply to Serbian citizens, and does not apply to tourists. Tourists (expats, non-citizens, illegal migrants) can play online freely. However, unlicensed foreign gambling websites will be blocked by the internet service providers, and won’t be accessible, while you are using the Serbian internet infrastructure.

And because it is a poor country that means it’s cheap (for Western Europeans and North Americans). You can get the ‘European experience’ here for less than 1/3 of the price of what you would pay in Western Europe, great value for money.
Give it a try, it’s a really cheap place, and if they join the EU in a few years (very likely) it will get significantly more expensive, now it’s your last chance to visit before it gets expensive.

Serbia gambling license
Gambling licenses are issued by the Serbian Gaming Board. You have to contact them if you wish to set up any sort of gambling business in Serbia. Their website is available in English as well, but very little is actually translated into English sadly.
Only companies registered in Serbia or in the EEA (European Economic Area) can apply for a licence.
The maximum number of land-based casino licenses is 10. Online casinos licenses are not capped.
A casino company must have at least €1 million capital, and must have a minimum deposit or bank guarantee of an additional € 300,000 (in a Serbian bank, per licence).
Additionally, a gambling establishment must have the following amounts of security deposits or bank guarantees, to make sure they have enough money to pay for the winnings of the payers:
- in case of betting, EUR 5,000 per betting shop, capped at EUR 1,500,000;
- in case of slot machines, EUR 500 per slot machine, capped at EUR 1,000,000;
- in case of online gambling, EUR 300,000 per website;
- in case of casinos €50, 000 per casino (+ the slot machine security deposit).
The minimum share capital requirement for betting operators and slot machine operators is EUR 250,000.
Casino licenses cost EUR 500,000 per year, and are valid for a period of 10 years. Online gambling licenses only cost €2500 per month.
There are restrictions on the locations of slot halls, casinos and bookmakers. These may not be within 200 meters, by the shortest safe pedestrian path, from educational institutions, or within 100 meters from one another. This regulation does not apply to sites, which existed prior to 2020, but only to new sites.

Serbia gambling tax
The gambling tax rates were recently increased in Serbia, the current values are the following:
