Legal status of online casino gambling in Cuba: illegal, players are probably not prosecuted

 

Gambling, including online casino gambling is illegal in Cuba, since 1959, according to Ley 86*. Even though the law banning gambling predates the internet by far, it’s worded in such a way as to include all forms of gambling, regardless of the medium.

It’s not known for certain how strictly this is enforced. One thing is certain, illegal operators, organizers, unlicensed companies (brick & mortar and online) are prosecuted. Technically players could be prosecuted, fined, or even jailed as well.

The internet is censored in Cuba, and it is monitored by the government (many foreign websites are blocked, mostly US sites, even emails are monitored, political dissidents are targeted)*. Online gambling websites are blocked (not all of them, actually most of them are not, the online casinos below are accessible, if they are not, please let me know in the comments section). According to various online sources, sometimes financial transactions involving online casinos are blocked by banks, but not all the time, and I couldn1t find anything official, just forum posts and comments on Quora and TripAdvisor.

Due the these issues (and the generally extremely slow internet in Cuba), we do not recommend playing in online casinos (for Cuban locals only, tourists can play in online casinos, they won’t be prosecuted or fined). Keep in mind, that due to the lackluster internet connection most games won’t load in Cuba, they need a good internet connection.

Also, VISA and MasterCard credit and debit cards are not accessible to Cuban residents. Therefore, locals can only play in online casinos that allow alternative payment methods (Skrill, bitcoin, EntroPay). The online casinos below all offer many alternative payment methods.**

On the other hand, poorer countries do not prosecute players usually. It’s expensive, and requires a certain technological infrastructure that is usually not in place in these smaller developing countries, like Cuba. Not to mention, blocking these websites is more effective (which they already do), than punishing each individual player (it’s expensive, clogs up the system) (90% of the developing countries do not prosecute players, and I would be surprised if Cuba did, but it’s best not to risk it).

Land-based casinos in Cuba

 

There are no casinos (or any land-based gambling establishments) in Cuba since 1959.

 

The past: The golden age of gambling in Cuba was the 1940s-1950s. Havana was pretty much the Western Hemisphere’s largest gambling hub, “The Las Vegas of The Caribbean”. The island had 10 bigger casinos (all of them in, or near Havanna), and more than 50 additional smaller gambling establishments (gentlemen’s clubs, harness racing tracks, cockfighting rings, jai alai* courts, la bolita** houses). Casinos were legal at the time, and casino licences were granted to companies who invested sufficient amounts of money in tourism (mostly building casinos with hotels, resort, which often doubled as brothels for the wealthy). While in the city the ‘richer sort’ (tourists mostly, and the wealthy, corrupt “elite”) spent their money in casinos, and at the horse racing tracks, in the countryside the ‘salt of the earth’ locals favoured the traditional games of chance: cockfighting, la bolita and jai alai.

*Ja alai is a form of ball game, that is no longer played professionally anywhere in the world, pretty much unknown at this point, but in pre-Castro Cuba it was really popular. And small stakes betting on ja alai matches was also widespread.

**La Bolita is a form of lottery, played with little balls, hence the name. It’s played in the countryside even to this day ,especially popular among Cuban Americans in the USA.

 

The future: There are rumors since 2014 that casinos will be legalized again, but so far, at the time of writing (2021), nothing happened.*
