Legal status of online casinos in Germany: legal since 2021, operators require a licence

UPDATE 2021: Online casinos have been recently legalized in Germany, on a federal level with ISTG 2021 (GlüStV 2021)1.

This is a result of a long-standing feud between the EU vs. Germany vs. the state of Schleswig-Holstein.

You can read about the context and the details and the context of the current legal status, but if you are just an ordinary player all you need to know is that online casinos are legal, and you can paly online freely (a list of online casinos, which accept players from Germany can be found below).

In order to understand the somewhat confusing German system, we have to take a closer look at the German system of governance first:

The Federal Republic of Germany is made up of 16 federal states (Bundesländer). Each of them are autonomous to a large extent (although, the federal government is chipping away at this autonomy for a long time, especially when it comes to Bavaria). These Bundesländer are subject to decisions on various topics to the federal parliament (Bundesrat).

In theory, the states could legislate for themselves when it comes to online casino gambling prior to 2021 (and Schleswig-Holstein did just, and legalized online casinos, even before GlüStV 2021). However, online casinos are contentious topic, which are prone to abuse, and abusing it is exactly what Schleswig-Holstein did.

The Glücksspielstaatsvertrag, or interstate gambling treaty signed by 15 out of 16 states came into effect in 2008. The treaty banned most forms of online gambling, including online casinos in most of Germany. The only state that decided not to join the treaty was Schleswig-Holstein, which refused to sign it.

The real problem with autonomy regarding online gambling is that Schleswig-Holstein licensed internet gambling portals (23 such online casino licences were issued between 2008 and 2013) can accept players from all of Germany, not just from the rouge state.

Obviously this creates issues for the states, and the federal government, who didin’t want any private online casinos.

/Comment: Mostly because they didn’t want competition for their online lottery monopoly (and some states also wanted to monopolize online casino gambling, despite the objections of the EU). That’s the real reason, not the official version, which was that they only wanted to protect players from gambling addiction./

Even though Schleswig-Holstein was in the right, from a legal point of view, they were essentially bullied into signing the 2012 Interstate Treaty on Gambling2 in 2013. This ensured that they would not issue any further licenses. However, silently, behind the scenes, they extended all 23 online casino licenses they have issued up until that point (and these online casino could still accept players from all states). So as you can see, in true German fashion, nothing was solved, everything just got more complicated, and it left a bad taste in everyone’s mouth.

If this wasn’t enough, the EU got involved too, and as you can imagine it didn’t end well. It just made things more complicated, and made everything a lot worse.

Germany, EU laws and online casinos: Germany is an EU country, which means Article 56 TFEU3 and Article 8 of Directive 98/34/EC (EU gambling directives) apply. This states that other EU online gambling companies should be provided access to the German market, and they should be provided a way to obtain local gambling licenses (free trade of services and free competition within the Eurozone).

This was not the case prior to 2021 and the EU Top Court ruled in 2016, that Germany can not penalize or restrict unlicensed foreign operators, because they made it impossible for them to acquire licenses4.

This has led to the very unusual situation between 2016 and 2021, that even though online casinos were illegal in Germany, the government could not restrict the citizens from playing in foreign, unlicensed online casinos, which paid no taxes at all. Players were not prosecuted for playing in these offshore online casinos.

And this was the situation up until recently, a ‘clusterfuck’ is I believe the perfect word for this. However, with the 2021 legalization of online casinos the country is finally EU complaint, and every state can decide what to do with online casinos.

Most states are still in the process of ironing out the kinks of online casino licensing and taxation, because this is so recent. However, what is certain is that players can play freely online, and companies require a Germany online casino licence if they wish to accept players from Germany.

By scrolling below, you can find a list of online casinos, which accept German players.

Can tourists play online while visiting Germany?

Yes, tourist (or non-citizen expats, or illegal migrants) can play online freely while enjoying their stay in the country.

Online casino licensing and regulatory body of Germany:

Online gambling licensing in Germany is not done on a federal level. All states have their own licensing process and authority. You can see a breakdown by states in the table below.

Germany online gambling licensing
German state: Gambling authority, where to apply for a gambling licence:
Berlin Department for Economy, Energy and Businesses (Senatsverwaltung für Wirtschaft, Energie und Betriebe)
Bayern (Bavaria) Gambling is a state monopoly in Bavaria (LOTTO Bayern, Bayern Staatliche Lotterieverwaltung), no gambling licenses are issued to private operators.
Niedersachsen (Lower Saxony) Under construction currently, no licenses are issued at the time of writing.
Baden-Württemberg Service Portal Baden-Württemberg
Rheinland-Pfalz (Rhineland-Palatinate) Ministry for Economic Affairs, Traffic, Regional Planning and Viniculture (Ministerium für Wirtschaft, Verkehr, Landwirtschaft und Weinbau)
Sachsen (Saxony) Ministry of Interior and Sports (Ministerium für Inneres und Sport)
Thüringen (Thuringia) Thuringian Ministry of the Interior and Local Affairs (Thüringer Ministerium für Inneres und Kommunales)
Hessen Hessian Ministry of the Interior and Sports (Hessisches Ministerium des Innern und für Sport)
Nordrhein-Westfalen (North Rhine-Westphalia) Ministry of Home Affairs and Local NRW (Ministerium des Innern des Landes NRW)
Sachsen-Anhalt (Saxony-Anhalt) Ministry of the Interior and Sports of the State of Saxony-Anhalt (Ministerium für Inneres und Sport des Landes Sachsen-Anhalt)
Brandenburg Brandenburg Ministry of the Interior and Local Affairs (Ministerium des Innern und für Kommunales des Landes Brandenburg)
Mecklenburg-Vorpommern Seems to be under construction at the time of writing, in the meantime
Hamburg Hamburg Gambling Licensing Information
Schleswig-Holstein Ministry of the Interior, Rural Areas, Integration and Gender Equality (Das Ministerium für Inneres, ländliche Räume, Integration und Gleichstellung)
Saarland Ministry of the Interior, Building and Sport (Ministerium für Inneres, Bauen und Sport)
Bremen Senator for Internal Affairs (Senator für Inneres)

Most of the ministries have German-only websites.

For now the states issue the online gambling license too, but it is planned that the The Joint Gambling Authority of the Federal States (Gemeinsame Glücksspielbehörde der Länder) will be established, and it will handle the online licensing for many of the states. It’s just a plan for now.

Keep in mind that the overwhelming majority of states does not yet issue online casino license (at the time of writing) because this is so recent. By clicking on the links you can check it for yourself.

Land-based casinos in Germany

Legal status of brick & mortar casinos in Germany: legal since 1720, operators require a licence

Brick & mortar casinos are legal in Germany, and have been for quite a while. The first German casino had opened in 1720 in Bad Ems (no longer in operation). This is typical for Germany, many of the spa towns (Bad means bath, spa) have casinos, and of course all of the larger cities.

Although there is a way for private companies to obtain casino licences, a good portion, about 40%, of brick and mortar casinos in Germany are operated by the state owned companies (e.g.: in Bavaria all of the casinos are owned by the state-owned Bavarian lottery company, Lotto Bayern) And many are state owned, but they are operated by subcontractors.

/Comment: Originally the German government wanted to monopolize the entire gambling sector, but this violated EU laws, and after years of litigation it was dismantled, but the Bundesländer managed to keep their local monopolies intact./

Germany actually has one of the most state owned casinos in Europe (and the entire German gambling sector is in similar shoes).

Currently there are about 100 licensed casinos in Germany.

Slot halls are also legal in Germany (although some states did ban them). However, the following federal limitations must be observed in each state:

All 16 states allow and have casinos, and though there are some differences, all casinos are non-smoking (except for the designated area), and most of them are only open between noon and 3 am. Additionally, German casinos are usually posh places with dress codes and entrance fees.

Most of the 100 casinos in Germany are part of a complex, and are integrated into hotels, restaurants, bars, entertainment venues, and so called Kurhauses (Kurhaus is a German word for spa with medicinal bath).

Casinos are called Spielbank in German, and most of them have Spielbank written over the gate or the building, instead of casino.

You can find all the currently operating brick and mortar casinos in the list below.

Can locals visit the casinos in Germany?

Yes, both locals and tourists can play in the casinos.

*Bavarian Texas Hold’em explanation, tutorial, how to play: Bavarian Texas Hold’em is a variation of  Texas Hold’em. It is a very rare form of poker, it can be found in Bavarian casinos. In contrast to Texas Hold’em, the individual players do not compete against each other, but each player plays against the bank. And there are some additional bonus bets too.

You can read a detailed tutorial explanation here, but sadly it’s only available in German.

Casino Baden-Baden

Casino Baden-Baden, address: Kaiserallee 1, 76530 Baden-Baden

Kurhaus un Spilebank Baden-Baden is one of Germany’s oldest casinos. It is in operation for 200+ years.

The exterior of the complex is an homage to the Belle Époque architecture, and its interiors are ornately decorated, modeled after royal French palaces.

In its heyday, Baden-Baden was the hotspot of the European 1% and people of note: wealthy writers, composers and actors including Fyodor Mikhailovich Dostoyevsky and Marlene Dietrich.

Actually, Marlene Dietrich called the casino “the world’s best casino”. This is currently the best rated casino in all of Germany, based on hundreds of online reviews.

Despite all the praise, the casino section itself is rather small by international standards (by German standards it is medium sized), and some of the gaming machines are very old. Also, this is clearly for the upper 10%, strict dress code, astronomical prices, high minim bets, be prepared, watch the video below to get an idea.

Games: around 140 slots, and around 9 tables (1 American Roulette wheel, 1 French roulette wheel and 7 blackjack)

To the right of the picture you can find info about the casino, including: address: opening hours: dress code, entrance fee and a video.
Casino Wiesbaden

Spielbank Wiesbaden, address: Kurhausplatz 1, 65189 Wiesbaden

The casino in Wiesbaden is the oldest  still operational casino in Germany. It opened in 1810, and it was the country second ever casino (the first one was Casino Bad Ems from 1720, but that is no longer in operation).

The Kurhaus is built in a neoclassical style, and the complex is a hotel and spa as well, with a restaurant and multiple bars.

/Comment: Kurhaus is a German word for spa with medicinal bath, the word directly translated means “a house of healing”, a reference to the scientifically-proven healing properties of natural thermal waters./

The facade of the main building (seen on the picture to the left) has a Latin inscription: “Aquis Mattiacis” , which means ‘the waters of the Mattiaci’. This refers to the Germanic tribe that once lived in that area and had legends of healing, magical waters. These fabled magical waters were likely the hot springs of Wiesbaden, which are still harnessed today for healing and wellness purposes.

The casino itself is an unremarkable medium sized casino (by German standards, small by international standards) with a beautifully decorated opulent interior space. It is a very posh place that is well known among the upper classes of the German society. Consequently, this is a very expensive place.

According to the casino:
“Every day, visitors to the gaming machines win over one million euros. On average 600 people play in the casino ever day.”

Games: around 190 gaming machines (slot machines, bingo machines and video poker machines), and around 11 tables (6 American Roulette wheels, 1 French roulette wheel, 4 blackjack) + 6 electronic roulette machines (with approximately 50 terminals in total)

Bitcoin casinos in Germany

Legal status: not specifically regulated

Bitcoin is not illegal in Germany. In fact, the German Finance Ministry announced back in 2013 that bitcoin is now essentially a “unit of account” and can be used for the purpose of tax and trading in the country. However, it does not count as a legal tender as of now.

Despite this, Germany does not have any specific cryptocurrency gambling laws or regulations.

None of the land-based casinos accept any alternative digital currency and there are also no bitcoin casino websites licensed in Germany. However, some of the Schleswig-Holstein licensed online casinos do accept crypto, through various payment processors.

The online casino below accept bitcoin and players from Germany.

Other forms of online gambling in Germany

The interstate treaty of 2008 banned all forms of online gambling in 15 out of 16 German states apart from wagering on horse races, internet sports betting and online lottery. However, the 2021 new interstate treaty legalized online casinos and online poker as well.

The following casino websites accept players from Germany:

Thank you for visiting:
This is a selfie of the author and owner of Simon's Casino Gambling Blog, me, Simon András Péter, a.k.a. by the internet pseudonym SimonTheSorcerer, owner of Simon's Online Marketing Kft. This is the homepage of my online casino gambling blog, you can see what's on the website, the links to all the different sections of the website.
That's me, Simon, thank you for visiting.
Don't worry, this is not an ad! ;) Just wanted to make sure to tell you that I'm glad you visited this gambling blog. I'm Simon, the only author and the man behind this blog (if you are interested, my unusual life story can be found on the homepage, under the "About me" dropdown section).
I'm an independent gambling blogger since 2012. In this sector dominated by huge media companies, casino operators and online marketing networks, who can easily spend $ millions on their online gambling blogs, it's not easy for an independent nobody like me to survive. It took me about 6 years, working my ass off, to even have a chance to be noticed by visitors like you. I'm lucky enough that for a few years now, I make enough money to be able to do this full time (before that, I had part-time jobs, ghost writing gigs, online marketing this and that).
Now I can finally do this full time, thanks to visitors like you! And it means a lot! If you are interested, please bookmark this site (no social media profiles, I no longer have any, but please feel free to share anything on any social media networks, if you still use them). I don't have any money to advertise, and if you have a personal blog, any social media profile, please mention my gambling blog and link back to it. This the only way for a small website like this to grow. Thank you!

Logo of Kiva.org. You can read about my non-profit activity right next to the picture.
Charity: As a way to help others, to give back, I sometimes donate to Kiva. If you click on the ads on the website, I make some money. And in a good month, if I make more than my expenses, I donate to people and projects on Kiva.
Kiva helps young entrepreneurs in developing countries, which is an issue close to my heart for obvious reasons. If you have the means, please sign up with the revolutionary non-profit company Kiva.org and help people lift themselves out of poverty, through hard-work, and an initial investment (non-profit loan). These non-profit loans encourage entrepreneurship and hard work instead of creating a dependent class that is afraid to get a job, or start a business (because if they did, they would no longer get support and free money, disincentivezing hard work and entrepreneurship). This is the right way to fight poverty in developing countries (or anywhere else really), and if this is something you are interested in, and if you would like to know more, or to help out, please check out Kiva.org here. Thank you!
