Legal status of online casinos in Germany: legal since 2021, operators require a licence
UPDATE 2021: Online casinos have been recently legalized in Germany, on a federal level with ISTG 2021 (GlüStV 2021)1.
This is a result of a long-standing feud between the EU vs. Germany vs. the state of Schleswig-Holstein.
You can read about the context and the details and the context of the current legal status, but if you are just an ordinary player all you need to know is that online casinos are legal, and you can paly online freely (a list of online casinos, which accept players from Germany can be found below).
In order to understand the somewhat confusing German system, we have to take a closer look at the German system of governance first:
The Federal Republic of Germany is made up of 16 federal states (Bundesländer). Each of them are autonomous to a large extent (although, the federal government is chipping away at this autonomy for a long time, especially when it comes to Bavaria). These Bundesländer are subject to decisions on various topics to the federal parliament (Bundesrat).
In theory, the states could legislate for themselves when it comes to online casino gambling prior to 2021 (and Schleswig-Holstein did just, and legalized online casinos, even before GlüStV 2021). However, online casinos are contentious topic, which are prone to abuse, and abusing it is exactly what Schleswig-Holstein did.
The Glücksspielstaatsvertrag, or interstate gambling treaty signed by 15 out of 16 states came into effect in 2008. The treaty banned most forms of online gambling, including online casinos in most of Germany. The only state that decided not to join the treaty was Schleswig-Holstein, which refused to sign it.
The real problem with autonomy regarding online gambling is that Schleswig-Holstein licensed internet gambling portals (23 such online casino licences were issued between 2008 and 2013) can accept players from all of Germany, not just from the rouge state.
Obviously this creates issues for the states, and the federal government, who didin’t want any private online casinos.
/Comment: Mostly because they didn’t want competition for their online lottery monopoly (and some states also wanted to monopolize online casino gambling, despite the objections of the EU). That’s the real reason, not the official version, which was that they only wanted to protect players from gambling addiction./
Even though Schleswig-Holstein was in the right, from a legal point of view, they were essentially bullied into signing the 2012 Interstate Treaty on Gambling2 in 2013. This ensured that they would not issue any further licenses. However, silently, behind the scenes, they extended all 23 online casino licenses they have issued up until that point (and these online casino could still accept players from all states). So as you can see, in true German fashion, nothing was solved, everything just got more complicated, and it left a bad taste in everyone’s mouth.
If this wasn’t enough, the EU got involved too, and as you can imagine it didn’t end well. It just made things more complicated, and made everything a lot worse.
Germany, EU laws and online casinos: Germany is an EU country, which means Article 56 TFEU3 and Article 8 of Directive 98/34/EC (EU gambling directives) apply. This states that other EU online gambling companies should be provided access to the German market, and they should be provided a way to obtain local gambling licenses (free trade of services and free competition within the Eurozone).
This was not the case prior to 2021 and the EU Top Court ruled in 2016, that Germany can not penalize or restrict unlicensed foreign operators, because they made it impossible for them to acquire licenses4.
This has led to the very unusual situation between 2016 and 2021, that even though online casinos were illegal in Germany, the government could not restrict the citizens from playing in foreign, unlicensed online casinos, which paid no taxes at all. Players were not prosecuted for playing in these offshore online casinos.
And this was the situation up until recently, a ‘clusterfuck’ is I believe the perfect word for this. However, with the 2021 legalization of online casinos the country is finally EU complaint, and every state can decide what to do with online casinos.
Most states are still in the process of ironing out the kinks of online casino licensing and taxation, because this is so recent. However, what is certain is that players can play freely online, and companies require a Germany online casino licence if they wish to accept players from Germany.

Brick & mortar casinos are legal in Germany, and have been for quite a while. The first German casino had opened in 1720 in Bad Ems (no longer in operation). This is typical for Germany, many of the spa towns (Bad means bath, spa) have casinos, and of course all of the larger cities.
Although there is a way for private companies to obtain casino licences, a good portion, about 40%, of brick and mortar casinos in Germany are operated by the state owned companies (e.g.: in Bavaria all of the casinos are owned by the state-owned Bavarian lottery company, Lotto Bayern) And many are state owned, but they are operated by subcontractors.

Casino Baden-Baden

Kurhaus un Spilebank Baden-Baden is one of Germany’s oldest casinos. It is in operation for 200+ years.
The exterior of the complex is an homage to the Belle Époque architecture, and its interiors are ornately decorated, modeled after royal French palaces.
In its heyday, Baden-Baden was the hotspot of the European 1% and people of note: wealthy writers, composers and actors including Fyodor Mikhailovich Dostoyevsky and Marlene Dietrich.
Actually, Marlene Dietrich called the casino “the world’s best casino”. This is currently the best rated casino in all of Germany, based on hundreds of online reviews.
Despite all the praise, the casino section itself is rather small by international standards (by German standards it is medium sized), and some of the gaming machines are very old. Casino Wiesbaden

The casino in Wiesbaden is the oldest still operational casino in Germany. It opened in 1810, and it was the country second ever casino (the first one was Casino Bad Ems from 1720, but that is no longer in operation).
The Kurhaus is built in a neoclassical style, and the complex is a hotel and spa as well, with a restaurant and multiple bars.
/Comment: Kurhaus is a German word for spa with medicinal bath, the word directly translated means “a house of healing”, a reference to the scientifically-proven healing properties of natural thermal waters./
The facade of the main building (seen on the picture to the left) has a Latin inscription: “Aquis Mattiacis” , which means ‘the waters of the Mattiaci’. This refers to the Germanic tribe that once lived in that area and had legends of healing, magical waters. These fabled magical waters were likely the hot springs of Wiesbaden, which are still harnessed today for healing and wellness purposes.
The casino itself is an unremarkable medium sized casino (by German standards, small by international standards) with a beautifully decorated opulent interior space. It is a very posh place that is well known among the upper classes of the German society. Consequently, this is a very expensive place.

I recently travelled Germany from Frankfurt to Hamburg by train. From what I experienced connected to the Internet by phone there was NO options in regards to accessing any casino websites.
I tried hard, but any access whatsoever to a online casino site was totally inaccessible, I tried a not so known casino website for access, its IP address circumvents any legislation even here while gaming I was eventually cutoff and my guess is by German Police / secret police maybe.
You write that 1) it is legal since some date in 2021, and 2) about EU legislation that should provide free access to such operators. The thing is EU regulations are very weak compared to national laws. Especially when it comes to prohibitions and so forth.You should check this for an update…
