Gambling is legal in Slovenia (officially the Republic of Slovenia), the defining piece of gambling legislation is the 2012 Law on Gambling (Zakon o igrah na srečo)*. Gambling was first legalized and regulated in Slovenia (then a part of Yugoslavia) in the ’60s, but initially merely as a means to collect funds for charitable purposes. Only in the second half of the decade was the first casino established.
Casinos were legalized to help with the rebuilding of the country after World War II.. Interestingly, back then, casinos were only available to the tourists, you could only enter with a foreign passport, locals were forbidden to enter (this attitude btw., is still very prevalent in Slovenia’s gambling industry, nowadays it’s the Italian tourists which are main driving force of the gambling sector, and casinos still primarily cater to tourists and not the locals). The Yugoslavian Gaming Act was introduced in 1965, and the first casino, Casino Portorož (still in operation today, by the name of Grand Casino Portorož, oldest casino in Slovenia) was opened a year before the enactment of the Act, as a pilot project. In subsequent years, several others followed, all of them for tourists only, even wagers could only be made in foreign currencies. Locals were restricted from gambling in casinos, as the activity was deemed “irreconcilable with the socialist values” (Yugoslavia was a communist country).
The government was more tolerant towards lottery by this time, as the profits of the game went to public funds, charitable causes, or were redistributed in society. Initially, casinos within the territory of Slovenia could only be established at major tourist destinations that had one thousand tourist beds and at least two hundred thousand overnight stays by foreign tourists per year**. Later the requirements were lowered, to allow cities near the Italian border, like Nova Gorica, to lure in the masses of Italian tourists (, who still dominate Slovenia’s gambling industry to this day, it was very successful). The ban on locals entering gambling venues was abolished with the disunion of Yugoslavia in 1991.
The casino sector continued to develop in the subsequent decades. By 1991, Slovenia gained independence. However, until the Slovenian Gaming Act was enacted in 1995 (,which was clearly based on the Yugoslavian gambling act, just slightly modified), there was no clear legal framework for controlling and licensing the gambling scene and casinos in Slovenia.
Casinos are legal and regulated in Slovenia since 1995, and they account for a large portion of the state’s revenues from tourism. However, online casino gambling is still a grey area in the country, which makes Slovenia one of the few European countries that still hasn’t fully regulated online gambling (online lottery, online bingo, and online sports betting is to some extent legal and regulated, all are state controlled monopolies).
Since 2014 there are rumors of a New Gaming Act, which would make online gambling expressly legal and allow private operators to obtain a licence in the country***.
UPDATE: In 2018, Slovenia’s parliament passed a new gambling act prepared by the Ministry of Finance,. This will eventually open up the market to private and foreign operators. The new act was originally expected to go into effect in 2019, but was postponed indefinitely. It’s clear that it’s only a matter of time till Slovenia completely regulates online gambling, and develops a licensing system, similar to the other EU countries.
The New Gaming Act will also impose fines and possible ISP bans on sites that offer their services on the Slovenian market devoid of a licence.
Currently, the only legal forms of online gambling in Slovenia are: the online lottery, which is a monopoly of the Slovenian National Lottery (majority owned by non-profit organizations), online bingo, and online sports betting, which are a monopoly of Sportna Loterija (a subsidiary of the national lottery) . Private companies can not get any kind of online gambling licences.
Despite this, very few foreign online gambling platforms are blocked, and Slovenian players placing bets on such sites are also not prosecuted. You can see some of the online gambling websites, which accept players from Slovenia below. The reason why Slovenia doesn’t block or prosecute companies which accept players from Slovenia illegally, without a licence, is the EU. Slovenia is a member of the EU, and the European Union made it very clear that: “article 56 TFEU prohibits restrictions on the freedom to provide services to recipients in other EU countries”. As long as it is not possible for a gambling company, registered in any other EU member state, to acquire an online gambling licence in Slovenia, they can not penalize or prosecute these companies, or their players. Because there is no legal way for them to acquire a local licence, and that violates free competition, and the free flow of services within the EU, and article 56 TFEU. (Not to mention, the various gambling, online gambling monopolies in Slovenia already violate EU directives on gambling.). Therefore the government of Slovenia is pretty powerless when it comes to online gambling companies registered, licenced in other EU countries, and they can not prosecute them. Slovenia gambling license
In Slovenia, gambling licenses are issued by the Financial Administration of the Republic of Slovenia. The maximum number of licensed casinos is capped at 15, and the maximum number of slot halls is capped at 45. The law makes a difference between casinos and slot halls, casino gambling is called “special gambling”, while slots belong to the category “classic, regular gambling” (this categorization is the same in all of the post-Yugoslavian countries, a legacy of the original Yugoslavian gambling legislation).
UPDATE: The number of available licenses is increased almost yearly, e.g.: in 2013 the maximum number of sot halls was 30, right now, at the time of writing, there are no free casino or slot hall concession slots. And until the government of the Republic of Slovenia increases the limit, it’s not possible to get a gambling licence.

Slovenia gambling tax
Gambling companies have to pay the following taxes (on top of regular taxes like corporate tax, but not VAT, gambling is VAT exempt):
- 5% tax on gross gambling revenue,
- 15% tax paid out on prizes exceeding the value of €300,
- 25-30% concession, license fee (depending on the exact type of game) on the gross gambling revenue.
As you can see, the gambling tax rate is quite high in Slovenia. I can already tell, if they open up their online gambling market, and they will try to force these kinds of tax rates in online gambling as well, then nobody will want to get a licence here, and companies will just keep on accepting Slovenian players without a license, without paying taxes, just like they do right now. They will be forced to reduce taxes, just like Slovakia had to reduce their online gambling tax rate from 27% to 22%, and this is even higher than that.
For players: Gambling winnings from licensed, local companies are tax exempt. Taxes are withheld at the source, by the company (it’s the “15% tax on paid out prizes exceeding the value of €300” part).

Sports betting in Slovenia
Online sports betting in Slovenia: legal, state monopoly
The only licensed and legal bookmaker in Slovenia is the state backed Sportna Loterija, which has plenty of land based betting shops around the country, as well as an online platform. It also launched a virtual sports betting product last year, on software provided by the company Inspired Gaming*.
Online sports betting is technically legal to some extent, and Sportna Loterija even received a made from scratch online sports betting licence (the only licensed sportsbook in Slovenia). However, foreign online bookmakers, can not apply for a licence, which makes online sports betting a state monopoly.
In 2006, the government attempted to block the two most popular foreign sports betting sites: bwin.com, and bet-at-home.com. However, without the requisite legal statutes in place, most ISPs in the country refused to comply with the government’s request**. For now, no such sites are being blocked and players are not prosecuted for placing bets with foreign online bookmaker.

Lottery in Slovenia
Online lottery in Slovenia: legal, state monopoly
Loterija Slovenije is the only legal lottery provider in Slovenia. The Slovenian lottery is 40% owned by the non-profit company Slovenian National Council of Disabled People’s Organizations, and 15% by the state of Slovenia (rest is various investment groups, and 10% of the company is owned by employees) It offers games such as Loto, Super Loto, Euro Jackpot, 3×3 plus 6, etc. All games are offered on an online platform as well. In fact, online lottery (which includes instant games and online scratch cards, which makes it almost like an online casino) are the only legal form of online gambling in Slovenia. At this point, the online platform of the Loterija Slovenije is very much like an online casinos, with the online scratch cards replacing video slots, and tikitaka instead online bingo.
The Slovenia lottery doesn’t officially have bingo. However, tikitaka is very similar to bingo . There is also no keno on the website. Unlike most European national lotteries the Slovenian lottery doesn’t have a sports betting section at all (it’s handled by a separate company Sportna Loterija).
Foreign online lotteries are illegal, but purchasing lottery tickets in person, while abroad is perfectly legal. Keep in mind that only winnings from the Slovenian lottery are tax-exempt. In 2013, the Ministry of Finance of Slovenia issued a formal opinion about the status of Bitcoin and other virtual currencies in response to a request from the Tax Administration of the Republic of Slovenia. The opinion states that Bitcoin is not a monetary means under Slovenian law and not a financial instrument. The approach of the authorities to cryptocurrencies hasn’t changed since.
Online gambling itself is a grey area in Slovenia, and virtual currencies as well. Even the proposed, and very late New Gaming Act will not address gambling in virtual currencies.
