1971: Gambling has been illegal ever since Qatar’s independence from the UK.
All forms of gambling are illegal in Qatar, according to the Penal Code of Qatar1.
According to article 274 the following is the definition of gambling:
“Gambling is any game in which the probability of gain and loss depends on the luck and not on controlled factors and each party agrees to give the amount of money, in case of loss, to the winning party.”
Despite this poker is also considered a game of chance, even though non-banking poker is partially a game of skill. Which means that despite the official definition, everything that even remotely resembles gambling is outlawed.
The reason for the comprehensive ban on games chance are the teachings of Quran (Sharia Law is the foundation of the Qatari legislation), which state that gambling (maisir) is forbidden (haram) for all Muslims2. This is the case in most Muslim-majority countries.
According to Islamic (Shari’a) law:
- It is unlawful for Muslims to gain wealth by gambling. According to Islamic teachings one ought to earn a living by honest, serious, hard work, and relying on luck to gain money is contrary to this principle.
- Muslims must not participate in gambling for recreational purposes: The reason for this prohibition lies in the addictive nature of gambling, which causes the gambler to neglect his responsibilities to society and the Creator.
Therefore, there aren’t any legally operating land-based gambling establishments in the country. Qatar doesn’t even have a national lottery.
/Comment: Most Muslim-majority countries actually have a lottery, only a few countries in the world don’t have a lottery, e.g. Afghanistan, Iraq, Pakistan, Syria, Pakistan./
The penalty for engaging in illegal gambling, according to article 275 of the penal code is:
“Imprisonment for a term not exceeding three months and/or a fine not exceeding 3000 QR – Qatari Riyals (around € 800). If gambling occurs in a public place, and performed openly or in any place or house made for this purpose the imprisonment can be extended to six months and/or a fine not exceeding 6000 Qatari Riyals (EUR 1600).”
Additionally, according to article 276 the penalty for organizing illegal gambling is:
“Whoever opens or runs a place for gambling, and any person who organizes any gambling games in a public place, openly or in any place or house made for this purpose Imprisonment for a term not exceeding a year in prison and/or a fine not exceeding 5000 Qatari Riyals (EUR 1350).”
/Comment: Quite lenient, one of the most lenient fines and sentences in the Arab world regarding illegal gambling./
The closest thing to games of chance in the country are promotional raffles, which are legal, and a lottery organised by Qatar Duty Free, a subsidiary of Qatar Airlines. The game is similar to the Dubai Duty Free lottery, which is also the only legal “gambling” in Dubai (it’s more of a promotional raffle tbh., it’s just called a lottery for marketing reasons).
Additionally, according to online rumours (no high quality source for this, take it with a grain of salt) illegal betting on camel races is the most popular form of illegal sporting betting in the country, and invitation only poker games among the upper classes are also not unheard of (the rich and powerful seem to be exempt from the rules, just like in every other country).
Online gambling is illegal as well, officially. Online gambling is not specifically mentioned in the Penal Code of Qatar. However, because all forms of gambling are considered illegal it applies to digital games of chance as well.
Technically placing bets on an online gambling platform is illegal, as mentioned above, punishable by 3 months in prison and/or a fine not exceeding 3000 QR.
However, this is not strictly enforced, players are not prosecuted, but the the Ministry of Transport and Communications does attempt to block most gambling websites3 (despite this there are some international gambling websites, which accept players from Qatar, you can see a list of them below, and the blocking can easily be circumvented by using VPNs, IPmasks, although those are officially forbidden to use).
However, this is not enforced and players are not prosecuted.
This is not unique to Qatar, the situation is the same in most Muslim-majority countries. For example, leading online bookmaker Betfair admitted that they had over 700 active user from Pakistan (where online gambling is similarly illegal)4, and even though this has become public information no action was taken against these players.
Another good example is from Afghanistan, where there are professional poker players, who compete in international tournaments and many of them openly admitted to playing poker online from the country (e.g.: Sherkhan Farnood, who was the Chairman of Kabul Bank until 20105, he was never prosecuted for illegal gambling).
UPDATE 2022: Online gambling sites are still blocked (only the biggest ones seem to be blocked8), but players, who visit these foreign gambling websites are still not prosecuted.
