And according to the Department of Internal Affairs:

“Only the gambling that is conducted in New Zealand is subject to the provisions of the Act [2003 Gambling Act]. If any element of the gambling is organised or conducted in, or from New Zealand, it will be caught by the Gambling Act.”3

Which means playing in foreign online casinos is officially not illegal according to the Department of Internal Affairs. This might be surprising for a layperson, but this is pretty much what happens in 90% of the countries (you can see this here, on this interactive map of internet gambling). There are legal reasons for this. Simply put: the laws of New Zealand only apply within the borders of New Zealand. This is called a ‘jurisdiction’ in legalese. Land-based casinos in New Zealand

Legal status of casinos in New Zealand: legal since 1990, operators require a licence

 

Casino gambling is legal in New Zealand, and it is currently regulated by the 2003 Gambling Act. Casinos have been legal since 1990, according to the Casino Control Act 1990 (which was replaced by the 2003 Gambling Act1). However, the first casino: Christchurch Casino (see below, in the list), only opened in 19942.

The current NZ casino legislation contains such lines as: Casino Gambling Act Part 2 Gambling – Subpart 11 – 2.,: “opportunities for casino gambling must not increase” and “the total number of table games and slot machines may not grow, nor the player space available at table games”. This means that getting a casino licence in New Zealand is definitely not easy (there are ways around it). Consequently, the number of casinos, and the amount of games they offer remained almost entirely unchanged (except at the Auckland Casino, which has a special status3). And expansion in the NZ casino sector is done more by acquisitions (e.g.: Wharf Casino was acquired by Skycity Entertainment Group in 2013) than by opening of new casinos.

Currently, there are 6 casinos in New Zealand.

Apart from this limit, the casinos in New Zealand must comply with strict game regulations. Casino gambling is considered class 4 gambling (in New Zealand games of chance, betting, wagering are divided into classes, casinos are class 4, you can find the detailed explanation of this classification system here), and as such, everything that applies to Class 4 gambling, applies to casinos as well.

One exception to these strict limitations are sports betting opportunities in casinos. These are regulated by TAB NZ and the New Zealand Racing Board instead, according to the 2003 Racing Act4.

And interestingly, just like in Europe, but very much unlike neighbouring Australia, most casinos in NZ have official dress codes.

The Sky Tower Casino is the biggest and the most iconic (and expensive) casino of New Zealand. And interestingly, it is also the second oldest casino, open since 1996.

This is the only casino in Auckland, the biggest city of NZ (but not the capital, that’s Wellington, which doesn’t have a casino).

The huge tower, which makes the gambling complex iconic, and lend it its name, is the 328 metres (1,076 ft) tall Sky Tower, a landmark of New Zealand, and a tourist attraction.

Christchurch Casino is one of the two casinos in NZ, which are not owned by the Skycity Entertainment Group (it is owned by Skyline Enterprises).

This is the oldest casino in New Zealand. It’s in continuous operation since 1994.

Despite the small size, even some of the bigger poker tournaments take place here, e.g.: New Zealand Poker Championships.

4., Dunedin Casino

This is the third smallest NZ casino, but it is the best looking (at the very least the opulent interior is unbeatable, you can take a peek by watching the video below).

The “Grand” was only recently added to the name, as part of a marketing campaign. In fact, the new official name since 2021 is ‘Grand Casino in Dunedin’ and their slogan is “New Zealand’s Leading Boutique Casino”.

The venue is in operation since 1999.

The establishment is located in ‘the Exchange’, a historic landmark building of Dunedin (Heritage 1 status), built in 1883.

The company also regularly sponsors NZ charities like Otago Cricket, Nuggets Basketball, Dunedin Wildlife Hospital and Foster Hope Otago.

Crypto, bitcoin casinos in New Zealand

Legal status: not specifically regulated, not accepted as a currency, therefore casinos don’t accept it

 

Cryptocurrencies are not accepted as currency in New Zealand, but contract and tax laws apply to cryptocurrency (which means you have to pay taxes on your bitcoin earnings). Because cryptocurrencies are not recognized as currency, and because of this, land-based gambling establishments in NZ do not accept them.

Bitcoin gambling is not specifically regulated. There is no legislation regarding the use of cryptocurrencies in the context of gambling.

There are no bitcoin casinos in New Zealand.

 

Other forms of online gambling in New Zealand

The 2003 Gambling Act prohibits New Zealand companies from conducting remote interactive gambling and the advertising of such games.

The only exceptions from this rule are lottery type sales promotions and the state run and owned gambling monopolies of the Lotteries Commission and the Racing Board.

The Racing Board that regulates sports betting in New Zealand operates an online sports betting site called TAB. The main profile of TAB is greyhound and horse race betting. TAB also offers live, “trackside” betting.

Aside from races, wagering on various New Zealand and international sports events is also available, and makes up an ever increasing slice of the sports betting offering of the platform. Sports to bet on include soccer, american football, basketball and tennis, as well as sports more specific to the area such a surfing, and a few more.

The Lotteries Commission of New Zealand operates the country’s national lottery, Lotto New Zealand.

Profits from the lottery games go to sporting and cultural organizations. The Lotteries Commission operates MyLotto, the only website authorised to sell lottery tickets online in NZ. Games on offer include keno, powerball, and other numeric games.

In accordance with the 2003 Gambling Act, only these forms of online gambling may be conducted in the country, by NZ companies. However, it is perfectly legal for locals to play on offshore online gambling sites of any kind. This means that New Zealanders – Kiwis – are free to play on the big international gambling platforms (a list of thee can be seen below).

 

History of gambling and casinos in New Zealand

Gambling has a long history in New Zealand. The most popular forms of gambling in NZ are: pokies, lottery, casino gambling, sports betting, horse racing betting.

Out of these 5, horse racing betting was the first form of gambling to be legalized. The first race meeting was held in the Bay of Islands in 1835.* The automatic totalisator, the “tote board” was actually invented by New Zealand-born engineer George Julius.

But in 1910 bookmakers were banned from horse-racing meetings at the behest of Protestant churches. Back then, betting on horses was the most popular form of gambling in New Zealand. Eventually, sports betting was taken over by the state in the form of the Totalisator Agency Board (TAB), which is still in operation today.

By the end of the 1980s, gambling regulation became more lenient as various forms of gambling were legalised by a series of laws: lottery in 1987, gaming machines also in 1987 and, finally, casinos in 1990. As a consequence, the importance and popularity of horse racing betting declined significantly. The staterun sports betting monopoly, TAB responded to this shift in player habits, and in the 1990s, introduced betting on other sports events.

Today pokies make up the largest percentage gambling spending, about $NZ 2 billion per year, with lottery as close second. Betting on horse racing and other sports accounts for only 18% of the pie nowadays (and horse racing betting alone is in the single digits).
