New Zealand Gambling Guide
Gambling is legal in New Zealand since 1835, according to the Gambling Act 20031, and its amendments (amended twice since it came into effect). However, it is strictly restricted.
/Comment: Technically gambling is illegal, unless specifically legalized by a legally binding act of the government of New Zealand, in this case, the Gambling Act 2003, which is the main piece of the NZ gambling legislation. However, most forms of gambling have been made specifically legal by that very act (detailed breakdown can be found below). Therefore, it’s easier to say that gambling is legal. It just confuses people, unnecessarily./
First of all, the types of gambling specifically allowed by Gambling Act are:
- lottery (monopoly o f Lotto NZ)
- bingo (a.k.a. housie, a slang term for bingo used in Australia and New Zealand)
- casino games (which includes poker)
- gaming machines (slots, video poker machines, a.k.a. pokies)
- lottery
- instant games
- scratch cards
- keno
- sports betting (monopoly of TAB)
As you can see the main forms of gambling are legal and regulated by the Gambling Act (except sports betting , which is regulated by the 2003 Racing Act2).
Additionally, gambling is also restricted by the amount of turnover, and the value of the prize, separated into classes (all values are in New Zealand Dollars, NZD):
Class 1 ( pretty much the equivalent of social gambling, or small gambling “smalles Glückspiel” in Austria)
Class 1 gambling cannot have a prize or turnover greater than NZD$ 500. All proceeds from the gambling (including interest), if conducted by an individual, must be paid to the winners. Only Class 1 gambling can be conducted by individuals. Licence is not required.
Class 2 (charity, fundraising)
Class 2 gambling must have prizes with a total value between NZD$ 500 and NZD$ 5,000. The potential turnover from the gambling must exceed NZD$ 500 but cannot exceed NZD$ 25,000. This class of gambling does not require a licence but it must be conducted by societies (usually non-profit organizations, for fundraising purposes) as defined in the Gambling Act.
Class 3
Class 3 gambling must have prizes with a total value exceeding NZD$ 5,000. Requires a gambling licence. Only companies can engage in Class 3 gambling.
Class 4
Class 4 is gambling that utilises gaming machines. Class 4 gambling can only be conducted with a licence, by companies.
Summary: The New Zealand gambling law focuses on ensuring that the community benefits from the proceeds of gambling, and that the harm that gambling can cause is minimised.* To ensure that this happens, games of chance outside of casinos are only allowed if the money is raised for an “authorised purpose”(mostly charity, class 2) or if it’s small stakes social gambling.
History of gambling in New Zealand:
1835 – Gambling started officially with horse racing betting, the first race meeting was held in the Bay of Islands in
1881 -1932 – due to pressure from the sizeable Protestant population (who were actually religious back then, and actually lived according to the Bible, not like today) gambling was outlawed with the Gaming and Lotteries Act till the 1970s, for 51 years
1932 – lottery is legalized, state run only
1961 – the Golden Kiwi lottery was introduced
1971 – horse and greyhound racing betting is officially legalized with the The Racing Act 1971
1977 – private companies can start gambling businesses too, for the first time, gaming machines, charity gambling, instant games and prize competitions are legalized
1987 – Lotto was introduced (in the early 2000s the game was regularly played by 67% of the population), pokies (gaming machines) first appear in NZ
1990 – Casinos are legalized with the Casino Control Act
2003 – six casinos had been introduced, one in Christchurch, Auckland, Dunedin and Hamilton, and two in Queenstown

Online gambling is illegal in New Zealand (except online lottery and online sports betting). To be precise, “remote interactive gambling” is forbidden, which includes gambling conducted through the internet, telephones, radio, etc. However, online sports betting and lottery are exemptions, and the Racing Board and the Lotteries Commission are allowed to authorize online gambling platforms, activities and issue online gambling licenses.

In this sector dominated by huge media companies, casino operators and online marketing networks, who can easily spend $ millions on their online gambling blogs, it's not easy for an independent nobody like me to survive. It took me about 6 years, working my ass off, to even have a chance to be noticed by visitors like you. I'm lucky enough that for a few years now, I make enough money to be able to do this full time (before that, I had part-time jobs, ghost writing gigs, online marketing this and that). Now I can finally do this full time, thanks to visitors like you! And it means a lot!  Kiva helps young entrepreneurs in developing countries, which is an issue close to my heart for obvious reasons. If you have the means, please sign up with the revolutionary non-profit company Kiva.org and help people lift themselves out of poverty, through hard-work, and an initial investment (non-profit loan). These non-profit loans encourage entrepreneurship and hard work instead of creating a dependent class that is afraid to get a job, or start a business (because if they did, they would no longer get support and free money, disincentivizing hard work and entrepreneurship).
