Gambling and casinos in New Zealand are regulated by the 2003 Gambling Act, amended twice since it came into effect. The New Zealand gambling law focuses on ensuring that the community benefits from the proceeds of gambling, and that the harm that gambling can cause is minimised.* To ensure that this happens, games of chance outside of casinos are only allowed if the money is raised for an “authorised purpose”(mostly charity).

The Gambling Act divides gambling into 4 classes. Class 1 and 2 include games with no commission; the former applies to games with prizes under $500, the latter games not exceeding $5000. Games that fall into these categories do not need a licence. Class 3 includes games with prizes exceeding $5000. In  this category commission may be paid, but conducting this form of gambling requires a licence. Class 4 covers gaming machines outside of casinos.

In New Zealand only the types of gambling specifically mentioned in the 2003 Gambling Act are allowed. This includes lottery, bingo (housie, as it is called in New Zealand) casino and instant games (e.g. scratch cards). Sports betting is exempt from this rule, as it is regulated by the 2003 Racing Act.

Online gambling is prohibited in New Zealand. To be precise, remote interactive gambling is forbidden, which includes gambling conducted through the internet, telephones, radio, etc. The law, however, does not cover the Racing Board and the Lotteries Commission, which are allowed to operate approved online gambling.

The Department of Internal Affairs specifies that it is not illegal for residents of New Zealand to participate in online gambling on websites based in other countries. They do warn, however, that players have no legal protection in such cases. Also, it is illegal to advertise overseas gambling sites in New Zealand.**
