Martinique Gambling Guide

Martinique is an insular region of France located in the Lesser Antilles in the Eastern Caribbean Sea. The island is part of the Windward Islands and it is directly north of Saint Lucia, northwest of Barbados, and south of Dominica.

Because Martinique is a French territory, the French gambling laws apply, which means the main piece of the gambling legislation is the Chapitre préliminaire: Dispositions communes  – Articles L320-1 à L320-18*.

/Comment: Interestingly, the french gambling legislation is set up in a unique way. All forms of gambling are illegal by default. And only exceptions are granted. Therefore, technically, the official legal status of gambling is that it is illegal. But this just confuses people, and the main forms of gambling have all been granted exceptions, and have been de facto legalized (see below, for a detailed breakdown of the legal status all the main forms of gambling, betting, wagering in Martinique, online and offline). This quirk of the French gambling legislation doesn’t effect ordinary players at all./

Gambling is legal in Martinique, and the island only has 2 casinos. The island nation has a population of only 375K population, but gets about 800K (mostly French) visitors per year**, and the casinos are mainly reliant on the visitors to the island. UPDATE 2021 COVID-19: Sadly, this French island was also not spared from the global coronavirus pandemic, and because of the country’s strong reliance on tourism (around 10% of the GDP***) it was severely effected, but it has not resulted in any casino bankruptcies, and both casinos are still operational.

Online gambling is also legal according to French laws. You can see a list of online gambling websites, which accept players from Martinique, below.

If you are new to the beautiful island of Martinique, watch the following video to see why so many tourists choose it for their vacation year after year:

Can tourists play online while visiting Martinique?

Yes, the laws of the country only apply to citizens and lawful permanent residents, if you are a tourist (or a non-citizen expat, or illegal), you can play online freely while enjoying your vacation.

Gambling licensing in Martinique

Martinique doesn’t have its own gambling regulatory and licensing authority. Instead, games of chance, online licenses and land-based gambling licensing is handled by the French regulatory agencies.

Betting activities have traditionally been divided between the Pari Mutuel Hippodrome (PMH) and the Pari Mutuel Urbaine (PMU). Lottery, as well as some lottery-style games such as bingo, are in the hands of Francaise des Jeux (FDJ).

Online gambling and the licensing of brick & mortar gambling houses are the domain of by the Autorité de régulation des jeux en ligne (ARJEL) UPDATE: L’Autorité nationale des Jeux ANJ, replaces ARJEL as the regulatory authority of most forms of gambling and online gambling from 2020. You have to contact them if you want to set up a gambling establishment, or get an online gambling license.

UPDATE: The licensing process, fees, procedures were overhauled entirely in 2019, during  the implementation of PACTE Act. The whole process is now more business friendly, fees are lower, and it is streamlined, the document, which lists all the changes, is attached below.****

Gambling tax in Martinique

French gambling taxes apply, which are extremely high:

Gambling tax in France and overseas territories (tax base is gross gaming revenue, from 2020 onwards, annual):

  • 37.7% horse racing tax
  • 40.8% online poker tax
  • 55.2% online sports betting tax
  • 44.5% retail sports betting tax
  • lottery tax is 54.5% and the tax on other lottery like games (bingo, keno, raffles) is 42%

Gaming clubs (special type of casino, VIP, entrance fee, dress code):

  • 10% of revenue, up to EUR100,000.
  • 30% of revenue, EUR100,000 – EUR1,500,000.
  • 40% of revenue, EUR1,500,000 – EUR2,600,000.
  • 55% of revenue, EUR2,600,000 – EUR5,500,000.
  • 70% of revenue, above EUR5,500,000

Casinos, it’s 28% first + the following progressive tax on the remainder, based on annual gross gaming revenue:

  • Up to EUR100,000: 6%.
  • EUR100,001 and EUR200,000: 16%.
  • EUR200,001 and EUR500,000: 25%.
  • EUR500,001 and EUR1 million: 37%.
  • EUR1,000,001 and EUR1.5 million: 47%.
  • EUR1,500,001 and EUR4.7 million: 58%.
  • EUR4,700,001 and EUR7.8 million: 63.3%.
  • EUR7,800,001 and EUR11 million: 67.6%.
  • EUR11,000,001 and EUR14 million: 72%.
  • EUR14 million: 83.5%

If this wasn’t enough, a 11.2% tax is paid on the 68% of the gross gambling revenue from slot machines.

In addition, every gambling establishments has to pay a 13.7% withholding tax on any winnings by players equal to or exceeding EUR 1,500 (this is because gambling winnings over €1500 are taxable in France and players never paid taxes on them, so now casinos have to).

As you can see, it’s incredibly high, the highest gambling tax rate in all of the world!

Keep in mind, that this gambling tax is paid on top of regular, corporate tax (can be as high as 31%), and taxes paid on the wages of employees (of course some of it is deductible, but still). In fact, with this crazy system, it’s possible for a casinos to get really close to a 100% effective tax rate.

For players, taxation of gambling winnings in Martinique: Gambling winnings over €1500 are taxable, 12% tax rate. However, licensed domestic companies are required to pay taxes on your winnings, not you. Therefore, as long as you play in a licensed establishment, you don’t have to pay any taxes (it’s automatically deducted from your winnings).

However, if you play abroad, or online, and if you win over €1500, you would have to pay taxes on it.

/In reality, this is rarely enforced, but if you win a really big amount, e.g.: €100 000+, I would certainly suggest paying taxes on it, otherwise you can get into a lot of trouble. Of course, I advise paying taxes on your winnings all the time, not paying taxes is illegal, but realistically, it’s not really enforced when it comes to small amounts./

Casino gambling in Martinique

Casinos in Martinique: legal, requires a French license

Online casino gambling in Martinique: illegal, players are not prosecuted according to EU laws

Gambling is completely legal in Martinique as French laws apply to the territory. There are 2 brick-and-mortar casinos in Martinique at the moment, where players can enjoy the usual casino staples (roulette, poker, slots, blackjack etc.). The 2 casinos are the Casino Bateliere Plaza located in Schoelcher and the Casino Trois-Îlets in Pointe du Bout.

Online gambling is legal and regulated, but only the following forms of internet gambling are allowed to be conducted online: poker, sports betting, horse racing betting, online lottery, and bingo, which are monopolies of the state owned French Lottery (details below, in the lottery section).

Despite this, players are not prosecuted if they play in an online casino. EU gambling laws dictate, that according to Freedom to provide services — Article 56 TFEU*: if a country does not provide any means for foreign online casinos to acquire local licenses, then they can not punish or block these gambling websites or players who visit them.

The online casinos below accept players from Martinique.

Bingo in Martinique

Bingo halls in Martinique: legal, requires license (must be within licensed gambling establishments)

Online bingo in Martinique: legal, state monopoly of FDJ (Française des Jeux)

Bingo is legal in France and its territories. However, it appears to be not popular. There is little to no information about land-based bingo halls in Martinique, and none of the licensed casinos have any sort of bingo activity, according to their official websites (if you know anything please drop a comment).

Online bingo is a monopoly in France and its territories, private companies can not get an online bingo license. The state-owned company, Française des Jeux is the only company allowed to conduct bingo games online.

The following bingo websites accept players from Martinique:

Française des Jeux, it’s a monopoly

Poker in Martinique

Poker clubs in Martinique: legal, requires license (must be within licensed gambling establishments)

Online poker in Martinique: legal, requires proper French license

Poker is quite possibly the most popular casino game ever created. In a few countries poker is no longer considered a game of chance (e.g. Brazil, India), instead it’s either classified as a sport, or a game of skill. However, according to French gambling laws, poker is definitely a game of chance (jeux de hasard). Therefore, it can only be played within licensed casinos.

Online poker is  legal in Martinique. it is one of the 3 permitted forms of digital gambling (along with sports betting and horse racing betting). Operators have to acquire the proper license.

UPDATE 2021: Nothing currently, sorry, none of the online poker platforms I use accept poker players from the country, due to the agressive blocking of the French government, and due to the extremely high online poker taxes, the poker networks I use elected to not get a French license, it’s just not worth it for them.

Sports betting in Martinique

Online sports betting in Martinique: legal, requires proper licence

Lottery in Martinique

Lottery in Martinique: legal, monopoly of FDJ (Française des Jeux, the state owned French lottery monopoly)

Online lottery in Martinique:legal, state monopoly of FDJ

The island nation does not have its own lottery. However, The Frech Lottery is active in the region, and it is the the sole provider of lottery and online lottery products. The lottery in France and French territories is the monopoly of the government-owned company, Française des Jeux (FDJ).

Some online lotteries still accept lottery players from Martinique, despite this (they are licensed in countries where offering lottery products to residents of the French Territories is legal), locals can also buy lottery tickets on these platforms (and they are always better than the state owned monopoly, because unlike them, they actually have to compete for players, with great bonuses, free tickets, competitive prices, cheap tickets and huge jackpots).

The following websites allow people from Martinique to purchase lottery tickets online:

There aren't any online lottery sites, which would accept players from the country. Because online lottery is either illegal or a monopoly of the state-owned national lottery of the country (you can read the details above).

Bitcoin, cryptocurrency gambling in Martinique

Crypto wagering in Martinique: not specifically regulated

Bitcoin is a digital currency often referred to as a “cryptocurrency” invented in 2008. It quickly became popular around the world in the following years. Bitcoin gambling appeared shortly after the introduction of the digital currency and continues to grow in popularity as more and more online casinos started to specialize in it. Despite being popular, Bitcoin is still a relatively new phenomenon so just only a handful of countries issued laws regarding its use. As of now, there aren’t any specific laws in France or Martinique regarding cryptocurrency wagering. Players from Martinique can use their bitcoin, bitcoincash, litecoin, ethereum in licensed online casinos.

Thank you for visiting:
This is a selfie of the author and owner of Simon's Casino Gambling Blog, me, Simon András Péter, a.k.a. by the internet pseudonym SimonTheSorcerer, owner of Simon's Online Marketing Kft. This is the homepage of my online casino gambling blog, you can see what's on the website, the links to all the different sections of the website.

That's me, Simon, thank you for visiting.

Don't worry, this is not an ad! ;) Just wanted to make sure to tell you that I'm glad you visited this gambling blog. I'm Simon, the only author and the man behind this blog (if you are interested, my unusual life story can be found on the homepage, under the "About me" dropdown section).
I'm an independent gambling blogger since 2012. In this sector dominated by huge media companies, casino operators and online marketing networks, who can easily spend $ millions on their online gambling blogs, it's not easy for an independent nobody like me to survive. It took me about 6 years, working my ass off, to even have a chance to be noticed by visitors like you. I'm lucky enough that for a few years now, I make enough money to be able to do this full time (before that, I had part-time jobs, ghost writing gigs, online marketing this and that).
Now I can finally do this full time, thanks to visitors like you! And it means a lot! If you are interested, please bookmark this site (no social media profiles, I no longer have any, but please feel free to share anything on any social media networks, if you still use them). I don't have any money to advertise, and if you have a personal blog, any social media profile, please mention my gambling blog and link back to it. This the only way for a small website like this to grow. Thank you!

Charity: As a way to help others, to give back, I sometimes donate to Kiva. If you click on the ads on the website, I make some money. And in a good month, if I make more than my expenses, I donate to people and projects on Kiva.
Kiva helps young entrepreneurs in developing countries, which is an issue close to my heart for obvious reasons. If you have the means, please sign up with the revolutionary non-profit company Kiva.org and help people lift themselves out of poverty, through hard-work, and an initial investment (non-profit loan). These non-profit loans encourage entrepreneurship and hard work instead of creating a dependent class that is afraid to get a job, or start a business (because if they did, they would no longer get support and free money, disincentivizing hard work and entrepreneurship). This is the right way to fight poverty in developing countries (or anywhere else really), and if this is something you are interested in, and if you would like to know more, or to help out, please check out Kiva.org here. Thank you!
