Most forms of gambling are illegal in Dominica (officially Commonwealth of Dominica, a.k.a “the Nature Island”, a former British colony, independent since 1978). This might be surprising, as the Commonwealth of Dominica (not to be confused with the Dominican Republic) is situated in the Caribbean Sea, which is famous, and infamous, for its many gambling establishments, tax havens, and as a home to hundreds of international online wagering platforms (the licensed online gambling sites which accept Dominican players can be found below, most of them are registered and licensed in various Caribbean countries).
The act regulating minor offences, including gambling related offences, is the Small Charges Act*, which actually predates the country’s independence, as it has been in effect since 1891. Since its inception, the law has been amended several times. Games of chance in particular, have been regulated by the act since 1964.
In accordance with the act, it is illegal to “receive any other person in any house or place for the purpose of gambling”. Punishment ranges up to 3 months of imprisonment and a 3000 Dominican Dollar fine (which is around $ 53). Those found gambling must cease and leave at the first warning, or they too may be prosecuted. Those found gambling in streets, roads or such public places have no warning before they are deemed “vagabonds” and punished.
However, the law does not apply to the state owned national lottery, pari-mutuel betting and charitable events approved by the Ministry of Finance (and to the two “Dominica Entertainment Centres”, which are slot halls, the local casino substitutes).
Online gambling is not specifically regulated by the Small Charges Act, but it is considered technically illegal for locals (not enforced, locals are not fined or prosecuted for internet gambling, but organizers, unlicensed operators are). At any rate, this is actually a good thing for the island, the people desperately need something to raise themselves out of poverty. And casinos do provide some good jobs, but it’s hardly a solution, just a band-aid, but better than nothing. Most of the bad things associated with casinos, higher crime, rampant gambling addiction, spreading “immoral behaviour” is just simply not true, actual studies have been done on this, and showed how gambling establishments are not comparatively worse than other entrainment venues, especially those who serve alcohol, in fact, according to some studies, they were actually better in terms of crime, than the parking lots of larger retail outlets or malls, which for some reason tend to attract crime the most, according to most studies.****/

- a 5 year business plan
- audited financial reports for the holding company of the applicant
- evidence from holding, parent of applicant, or other affiliated company that the required US$ 500,000 capital will be provided and set apart before license is issued, or an irrevocable letter of credit drawn on a reputable international commercial bank
- receipt from the accountant general for an application fee of US$ 15,000 and any additional $10,000 extension fees, if applicable
The licensee must maintain a presence on the island, and the government expects licensed companies to employ as many locals as possible. Additionally, applicants have to pay a a non-refundable application fee of US$ 15,000. If there is more than one form of gaming on the application, a further non-refundable application fee of US$ 10,000 is required for each additional category. On top of these fees a capital of $500 K is required, and the applicant is required to purchase Treasury bill bonds in the amount of US$100,000. These treasury bills will be rolled over until six months after termination of agreement, at which time it is refunded to the applicant.
