Costa Rica Gambling Laws, Rules, Legal Gambling Age, Licensing, Taxation of Winnings
Private gambling is officially illegal, but de facto legal in Costa Rica (officially the Republic of Costa Rica) since 1886 (the first country in the Caribbean to actually formally regulate games of chance). The current main pieces of gambling legislation are the 2008 Reglemento de Casinos de Juegos, or as it is known in English, the Costa Rican Gambling Law*, and the 2012 Ley de Impuesto a Casinos y Empresas de enlace de llamadas a apuestas electrónicas, which is better known as the Costa Rica Casino Law**. However, state-run gambling is actually legal, Junta de Potección de Social, state lottery operator, has a monopoly over all forms of gambling, except casinos (but only has a lottery for now), therefore gambling in costa Rica is actually a monopoly of the state according to Law No. 8718***, which grants JPS monopoly over:
“creation, administration, sale and marketing of all lotteries, both pre-printed and electronic, sports betting, games, video-lotteries and other gambling products, in the national territory, with the exception of casinos”.
Interestingly, gambling is officially prohibited for residents of Costa Rica: It is forbidden for locals to bet, place wagers on games with a random outcome. This rule might seem to outlaw all forms of gambling, and probably it was meant to, but this prohibition is ignored. The casinos in operation have a special license and permission from the Ministry of Public Security to operate their gaming machines, tables, electronic tables. The casino sector contributes enough to the economy to justify its existence, and it provides more benefit than the harm it does, not to mention, it mostly caters to tourists, not the locals.
In accordance with the admittedly few gambling regulations, any company wishing to provide gambling services in the country must apply for a license. In lieu of a gambling license (because it’s officially illegal) this is a commercial license, and a data processing license in case of online gambling. Applicants are required to have a company incorporated in Costa Rica (for details of the licensing process and taxation, requirements, check the licensing section, below).
Costa Rica, due to the favourable taxes, the easy and cheap licensing process, and the pro-business, laissez-faire regulatory environment, has quite a lot of casinos, 30 in total (UPDATE 2021 COVID-19: down from about 35, before the pandemic). Which is quite a lot, considering that the country only has 5 million people and gambling is not even legal… (for context, usually, similarly sized countries, with a limited potential for tourism, with normal taxation, actual gambling regulation and licensing, only have about 10 casinos, Costa Rica has 3x that much, but in the Caribbean, this is pretty much the norm).
A few of these companies also operate online casinos as well, but most actually don’t. And just like most smaller countries with a strong tourism focus, almost all gambling establishments are attached, or at the very least, can be found next to hotels, in areas frequented by tourists (which is, in this case, the capital San José, where 20 of the 30 casinos are located).
Private online gambling is also officially illegal, but de facto legal in the country (meaning, there are online gambling companies which operate from the country, but they can’t accept local players), since 1999.
Junta de Potección de Social, state lottery operator, has a monopoly over all forms of online gambling too, probably since 2009, except online casinos (but only has an online lottery for now).
Costa Rica is a lucrative online gambling hub and offshore tax haven despite the ban on online gambling, and it is probably the most popular Caribbean licensing destination. However, this popularity is not reflective of the quality of the licenses issued (at least for the players). In fact, it’s inversely proportional. An online gambling license from this country is considered to be the second worst among the popular offshore licenses (the worst is the Panama “data processing license”). The way they circumvent the ban on online gambling is that the law has been written in such a way, as to stipulate that gambling is not taking place at the location where the server is located, but rather, at the location of the player.
It is rather easy to obtain a licence for an online gambling site from Costa Rica (which is, in itself, is a red flag). The main reason for this is that licenses issued here are actually not even genuine online gambling licences. Companies can only apply for a data processing licences instead, just like in Panama. There are barely any laws regulating the actual gambling aspect of companies licensed in Costa Rica. While this is definitely positive for gambling operators wishing to acquire a licence (and this, coupled with the favourable taxation, explains the popularity of the license). This also means that Costa Rica-licensed online gambling sites are rather unreliable and are barely supervised. This poses a risk for players on these sites, as rules – e.g. payouts, getting your winnings – can not be enforced, and there is no one to help you if the online casino refuses to pay.
The government must be aware of how problematic most of the licensed online gambling operators actually are (although they don’t admit it officially, for obvious reasons). And they forbade these companies to accept locals on their websites, which is no coincidence. This is one of the few rules these licensees have to abide by. I recommend everyone to avoid Costa Rican licensed online gambling websites. There is absolutely no accountability, and these online gambling websites are not controlled, regulated at all. There have been many scandals over the years, and regular accusations of money laundering, involvement of organized crime****. Obviously not all of these allegations are actually true. But even if only a third of them are true, that is already too much. The online gambling websites below are all licensed in other countries, but accept players from Costa Rica.
The best way to illustrate and summarize the attitude of the government, in charge of regulation, licensing and fighting against money laundering, is that whenever confronted with evidence, strong evidence, and strong allegations of money laundering, cheating, tax evasion, illegal activity, this is the typical reaction of the government:
From the 2016 case of USA versus 5Dimes, Costa Rica licensed online bookmaker: Alvaro Montoya, Costa Rica’s Deputy Prosecutor at the Office of Money Laundering (who is reportedly very lenient and dismissed 73% of cases related to money laundering*****), after being confronted by the US government, with evidence of the illegal activity, money laundering, wire fraud (using gift cards to circumvent the US Wire Act), and tax evasion of locally incensed 5Dimes Sportsbook, Alvaro simply said:
“the business of online gaming is legal, and as such, it does not fit into any offense under national law” (meaning: online gambling is not a crime in Costa Rica), and additionally, after mentioning just how much taxes they collected form that one company, he also said “We are hardly going to tax someone who commits a crime.” And that was that. Case closed, according to Alvaro, and this was added to the 73% of cases he dismissed.******
Just for context, the original owner of 5Dimes Sportsbook was kidnapped, tortured and killed, and the company was owned by his widow. Officially, the company had no connections to organized crime, only allegations. His death was not officially connected to his alleged connection to organized crime.*******
/Comment: I hope this is not representative of the kind of people and companies who get licenses here, but, considering that this is an offshore tax haven, yeah… I let you finish that sentence… It’s a disgusting, ugly world we live in, the polar opposite of the movies, where the good people get rewarded, heroes get the girl, and they all live happily ever after. Here, IRL, the evil people get rewarded, and the good guys get to work for them, as wage slaves, for the rest of their miserable little lives…/
UPDATE 2021: Since 2016, a settlement was reached between 5Dimes and the US government, the US won, $47M was paid, any further charges were dropped.
Costa Rica really is a beautiful place (just like the rest of the Caribbean). However, due to the popularity, influx of foreigners, the kind that takes advantage of the offshore financial services provided here, things have changed. Can tourists play online while visiting Costa Rica?
Yes, the laws discussed here only apply to residents of the country, if you are a tourist (or a non-citizen expat, or illegal), you can play online freely while enjoying your vacation.
Gambling licensing in Costa Rica
Only the following companies are eligible for a Costa Rica gambling license (a data processing license):
- must be a Costa Rican corporation
- registration with the local tax authorities
- a commercial license, which is obtained from the local government authorities
There is no dedicated licensing and regulatory body in Costa Rica, the closest thing is the Ministry of Public Security, which issues licenses for gaming machines, tables for land-based casinos, you can try them. And also the Ministry of Economy, Industry and Commerce, because a commercial license is also needed. I couldn’t figure it out, which one is issuing the data processing license, but I’m almost certain it’s one of the two. Both are only available in Spanish. Therefore, if you wish to get an online gambling license, you have to get a translator and contact them directly. If you find out who, or which branch of the government issues the licenses currently, please let me know.
Licensing fees include a one-off license fee of USD 5,000, an annual USD 5,000 license renewal fee, and USD 500 for legal costs.
Land-based gambling license (permit for slots, gaming machines): If you wish to set up a casino you have to get a license from the Ministry of Public Security for tables and gaming machines (slots+electronic bingo+video poker). Gambling tax in Costa Rica
Online gambling tax: Corporations in Costa Rica aren’t taxed on income earned overseas. Since online gambling operators can only accept players from abroad, they don’t pay any gambling or corporate taxes.
Brick & mortar gambling tax: According to the 2012 Ley de Impuesto a Casinos y Empresas de enlace de llamadas a apuestas electrónicas (translated using an automatic translation software, not an official translation, only available in Spanish online):
- Ten percent (10%) of the net income of natural or legal persons originated in the operation of legally authorized casinos.

Casino gambling is legal in Costa Rica, despite that gambling is actually illegal (yeah, I know…, Costa Rica, where gambling is illegal, but they have 30+ casinos…, bizarre…). Casino operators are required to have a licence from the Ministry of Public Security, to operate their gambling machines and tables in the country. Casinos are not allowed to be open 24 hours a day, only between 6 p.m. and 2 a.m. UPDATE 2021: This no longer seems to be a requirement. Most casinos in Costa Rica are located in or near the capital, San José, and all of them are small (compared to US casinos, they are average compared to European casinos).
While casino gambling in general is legal in Costa Rica, regulation regarding specific games is somewhat confusing. There is a law against betting on games with a random outcome, but this prohibition is rather vague and seems to be ignored. Blackjack is missing in some casinos, though available in others. And where blackjack is not available, Rummy, a blackjack variant, with almost identical rules, seems to be available instead. Some casinos don’t have tables, and only have electronic tables and electronic gaming machines (and gambling takes place essentially online, to circumvent the ban, and utilize the island’s leniency when it comes to online gambling).
/Comment: The latter one is a really good solution btw., I would use this if I had a casino in the country, this way, you don’t have to deal with the chaotic regulations, just get the license from the Ministry of Security as well, pay the taxes, but have everything online, on a server abroad, just in case, with a Panama gambling licence, with servers in Panama. God knows what those politicians will come up with, a few years down the line. I couldn’t find a single mention of bingo in the very limited gambling legislation, and half of the government websites just simply don’t work, and display various error messages in Spanish (it’s pretty bad, most of the government websites are unreachable, this would be unacceptable here in Europe). What is certain is that there are about 20 places where there is bingo, and there is at least 2 places with electronic bingo machines (which are most probably considered gaming machines and need a licence from the Ministry of Public Security, and are taxed).
Companies can set up online bingo companies in Costa Rica. However, these companies may not let locals play. While this rule is rather strictly enforced, locals can play on international bingo sites with no repercussions. It’s not known if the blanket ban on online gambling applies to bingo as well, but even if it does, it’s not enforced.
It is very likely that special legal status of Junta de Potección de Social includes bingo and online bingo as well.
