Summary: Gambling is legal in Turkmenistan since 1999 (also known as Turkmenia, a Central Asian Islamic country, with a population of 6 million, formerly part of the USSR, one of the few Strongly Muslim countries, which has legalized gambling).

Online gambling is officially illegal since 2016. However, this is not enforced and players, who visit foreign gambling websites are not prosecuted.

1991 – Turkmenistan, upon independence from the USSR, did not inherit the Russian gambling laws. This means that even though lottery was legal during the Soviet era, it was outlawed in 1991.

1999 – Gambling was officially legalized.

2016 – Online gambling was banned along with gambling advertisements with the passing of the bill titled: On advertising (details can be found below, in the online gambling section).

Gambling is legal in Turkmenistan since 1999, according to the Law on Licensing of Some Types of Activity1 ( ЗАКОН ТУРКМЕНИСТАНА О лицензировании отдельных видов деятельности – новая редакция, and its amendments), which is the main piece of the gambling legislation.

Despite being a Muslim country (93% of the population is an adherent of Islam), games of chance are legal. Although, they are certainly looked down upon by most of the population. This, and the low number of tourists, and relative poverty of the population, are among the main reason why there are only 2 casinos in the country.

The private gambling sector is very underdeveloped, it consist of 3 casinos (all 3 of them small by international standards) and a few betting shops.

Online gambling is officially illegal since 2016, according to the Law on Advertising2, which also prohibits gambling advertisements.

Turkmenistan ranks among the most repressive and closed societies in the world. The internet is heavily regulated and available only to a small fraction of the population (33%3). It was only in 2008, when citizens of Turkmenistan were first allowed to have personal internet connections. Additionally, private internet connections are prohibitively expensive, only the upper class can afford them (faster internet connections cost an unbelievable 5000 Turkmenistan manats – approx. € 1300, $ 1500, monthly).

There is also a robust censoring system in place4, which targets mainly political content, but online gambling sites are also widely blocked. The only ISP in the country Turkmen Telekom is completely controlled by the government and authorities basically have full reign over what content Turkmen residents can access over the web.

However, because internet use is still not widespread the authorities do not really focus on blocking online gambling sites (most are not blocked, we just tested it with a VPN) and people who visit foreign gambling websites are not targeted by the authorities, although it is technically illegal.

/Comment: This seems to be widely disregarded. Even the bookmaker 1xBet, which is active in Turkmenistan, accepts bettors form the country, despite the ban on online gambling. Details can be found in the Turkmenistan sports betting section below./

How is it legal for online gambling websites to accept players from Turkmenistan? Isn’t it illegal?

It’s only illegal for Turkmen citizens to play online. These foreign online gambling websites, which accept players from Turkmenistan are registered and licensed in foreign countries, and the Turkmen laws only apply within the borders of the country (within the so called jurisdiction, they do not apply to these foreign gambling websites).

According to the local gambling laws of the countries in which these offshore gambling companies operate it’s perfectly legal to accept players from Turkmenistan.

But it’s not legal for Turkmen citizens to place bets on these platforms.

International law can be complicated, and enforcement is even more tricky. I hope this clears this up.

Yes, the laws discussed on this webpage only apply to Turkmen citizens, and they do not apply to tourists. Tourists (expats, non-citizens, migrants) can play online freely, while enjoying their stay in the country.

 

Betting on blood sports in Turkmenistan

All forms of blood sports are officially illegal in Turkmenistan. Betting on blood sports is also illegal.

 

Turkmenistan is one of the most obscure countries in the world, very few people know anything about the country outside of the region, the restricted state controlled media and lack of internet access make the situation even worse. As a result the country gets very few tourists, fewer than 10 K tourists visit the country according to estimates6.

/Comment: Although, the exact number of tourists is not known for certain, because the government stopped publishing official figures. Which pretty much guarantees that they want to hide it, because it’s so low./

In fact, the number of tourists is so low that they closed many of the major tourists attractions, because it made no sense to maintain them if there are no torusits5.

This lack of tourists is actually the main reason why there are only 2 casinos in the country (you can see the biggest one on the picture at the top of the page).

UPDATE COVID-19: These are pre-coronavirus estimates, the number of visitors has most likely fallen because of the global pandemic. However, the government hasn’t published any official figures. Therefore, the effects of the pandemic are not known.

Turkmenistan gambling licenses

We tried to find, which government body is responsible for the gambling licensing but it seems like it is not specified, the best information we can provide is the following (from the Law on Licensing, unofficial translation):

“Article 7. Authorities of state bodies, issuing licences.

1.,The state bodies, issuing licences carry out the next authorities:

  • licensing at the territory of Turkmenistan according to the present Law and other normative and legal acts which came into force before the present Law came into force;
  • control of the observance of licence requirements and conditions by the juridical and physical persons who received licences;
  • holding up of the power of licences and their annulment;
  • re-registration of licences;
  • reforming and holding registry of licences.

2. State bodies, realising the authorities stipulated by the present article are determined by the Cabinet of Ministers of Turkmenistan.”

“Article 11. The order of issue of a licence.
To receive the licence, the applicant of the licence presents the next documents to the state body issuing the licence: 

 

  • application on issuing of the licence indicating: the name and organisational and legal form of the juridical person, the place of its location, the name of the bank and the numbers of payment account in the bank, statistical and tax codes;
  • last name, name and middle name of the individual businessman, the information from the document identifying his personality;
  • kind of activity, which the juridical person or individual businessman intend to carry out he indication of the time during which the indicated kind of activity will be carried out;
  • for juridical persons – the copies of the certificate on state documents and the copy of the certificate on state registration of the applicant of a licence as a juridical person, certified by the notary;
  • for individual businessmen – the copy of the certificate on state registration of the citizen as an individual businessman, certified by the notary.
  • Depending on the specific character of the activity, submitting of other documents, certifying the correspondence of the applicant for a licence to the fixed licence requirements and conditions can be stipulated in the regulation on licensing of the concrete kind of activity
  • The demand of submitting of other documents not stipulated by the present Law and regulation on licensing of the concrete kinds of activity from the applicant of for licence is not accepted.”

Turkmenistan gambling taxation

The gambling tax is determined by the Tax Code of Turkmenistan7. Applicable tax is calculated based on the number of gaming machines, seats, area. You can see these fixed fees below:

I'm an independent gambling blogger since 2012. In this sector dominated by huge media companies, casino operators and online marketing networks, who can easily spend $ millions on their online gambling blogs, it's not easy for an independent nobody like me to survive. It took me about 6 years, working my ass off, to even have a chance to be noticed by visitors like you. I'm lucky enough that for a few years now, I make enough money to be able to do this full time (before that, I had part-time jobs, ghost writing gigs, online marketing this and that).
Now I can finally do this full time, thanks to visitors like you! And it means a lot! If you are interested, please bookmark this site (no social media profiles, I no longer have any, but please feel free to share anything on any social media networks, if you still use them). I don't have any money to advertise, and if you have a personal blog, any social media profile, please mention my gambling blog and link back to it.
