Guide to Gambling Turkey

Most forms of online gambling are illegal in Turkey (officially the Republic of Turkey, unlike its neighbours, it is a secular state, but its legislative system still bears the traits of Islamic influence in some areas), and only a few forms of strictly state controlled gambling are legal and tolerated. Obviously, that goes without saying, that the only legal forms of online gambling are the online platforms of state controlled gambling companies (lottery, sports betting and horse racing betting by the Turkish Jockey Club, none of them have their own online betting platforms at the time of writing). The main pieces of gambling legislation are the Article 228 of the Turkish Criminal Code* and  Law Regarding Roulette, Pinball and Gaming Machines**, and they specifically mention and ban so called games of chance (Şans Oyunları) and betting, wagering (Müşterek Bahis).

Land based gambling was outlawed in 1998 following the murder of the ‘casino king’ Ömer Lütfü Topal in 1996.

The casino industry was targeted by the ban due to accusations of money laundering (rightfully so, as it turned out later, lot of disgusting things happened in that sector). The gambling establishments went underground after this, not all of them disappeared, they became “private clubs”, all hush-hush. However, in 2016 concentrated attacks, coordinated raids targeted these private clubs, and since then, only small scale illegal gambling is present in Turkey.

Nowadays, it’s became accepted and common knowledge that the Northern-, Türkey controlled, part of Cyprus is the casino sanctuary of the country, where all the gambling operators were relegated to. People from Turkey, tourists who want to gamble, all go there, and it has impressive casinos all reliant on tourists, many of them from Turkey, and from other Arab countries, where gambling is largely illegal.

Online gambling in Turkey: For a brief period actually, in the early 2000s, online gambling operators thrived in the country. But they were banned in 2007 (it was never actually legal, just not regulated, and they operated in a legal gray area). In 2013, Turkey introduced stricter laws against the unlicensed online gambling operators (increasing penalties for gambling related offences as well as exposing the sector to thorough scrutiny).

The new legislation does not only impose harsher monetary fines and prison sentences on operators, but also penalizes those who play on these platforms as well – an act previously not criminalised by any regulation pertaining to online gambling. But in practice, it’s really the companies who are punished, and not the players, who are usually unaware of the legal implications of what they are doing online. Legal disclaimer: However, Turkey is one of the countries where even the players can be prosecuted for playing online, therefore we do not recommend it. Despite this, there are a few online casinos, which accept players from the country, you can find these below.

The fines imposed on players, who play on illegal platforms are between 100k-500k Turkish lira (US $55k to $278k)***, which is quite a lot, especially in a country with a median annual income of less than $6k. According to the new legislation, Turkey’s Telecommunications Authority is responsible for blocking illegal websites and the Banking Regulation and Supervision Agency is trusted with the prevention of the use of banking services and transactions, including bank and credit cards, for illegal online gaming (if the online casinos below are blocked, please let me know in the comments section)

Currently, the only legal forms of gambling in the country are:

 

Unlicensed online casinos are blocked in the country (although most of them are not, only the biggest).

As you can see, they are trying to “privatize” these companies from time-to-time, but it’s not real privatisation, they only get the license for 10 years, then it goes back to the state,  no ownership exchange whatsoever. So instead of privatization, as it is advertised (for political reasons probably), a better name for it would be ‘public concessions for temporary licenses’.

 

Despite the fact that all forms of online gambling not tied to the state is illegal, a few foreign operators accept players from Turkey (you can see them below). Players, if caught, could face a hefty fine. However, to this date, no players have been fined (none that we know of, if you know of anything, please drop a line in the comments section below). Some players use VPN for extra safety and anonymity. The government is after the organizers, not the players. Nevertheless, play online at your own peril, we do not recommend it. These online companies are registered in offshore tax havens, and are behind many shell companies, which makes them well outside of Turkey’s jurisdiction and immune to their attempts at litigation.

UPDATE 2021: The ISPs (internet service providers) in Turkey started to block access to sports betting websites, bitcoin gambling websites in addition to online casinos.******

 

Turkey gambling license

Turkey doesn’t have a unified gambling licensing body. Instead, who is responsible for the licensing, overseeing, controlling depends on the type of activity. This is typical btw. of countries where gambling is a state monopoly, and private operators are not allowed in. Change in such countries, at least significant change, only occurs ‘once in a blue moon’, always initiated by the so called, entrenched (often dynastically entrenched, so called “new nobility”, nothing noble about them btw…) “in-crowd” whom bureaucracy and the workings of the bureaucratic and corrupt machine is second nature (often in these countries you can see that gambling companies are owned, or at least partiality owned, at the very least their CEO is a lawyer or political appointee with a lifetime of experience with the disgusting and corrupt political system). Therefore, there wasn’t a need to streamline the processes and create a unified gambling licensing, approval, controlling body.

It’s not possible for private companies to acquire a license. Only the following entities are allowed to organize any sort of gambling activity:

 

Eventually, the plan is, that all forms of  games of chance will be managed by the Turkey Wealth Fund, but it’s a slow process. By the time you are reading this, probably one of the main forms of gambling is administered by them, but at the time of writing this, it’s not the case.

Turkey gambling tax

On top of all the other, regular taxes (eg.: corporate tax, VAT – gambling is not VAT exempt in Turkey), the following is the applicable gambling tax based on the type of gambling activity:

 

There is no specific online gambling tax, same tax rates are applicable to online gambling activities as well.

 

For the players: Gambling winnings are taxable in Turkey, both winnings from domestic, licensed, legal companies, and also the winnings from unlicensed foreign online operators (which is illegal, but if you happen to win some money you need to pay taxes on it, don’t worry, players are not prosecuted if you show the government you are willing to pay taxes on it, so make sure you do, players who don’t pay taxes on their gambling winnings from unlicensed operators are often hit with big fines and back taxes, but players who pay taxes are left alone), and also winnings from licensed companies abroad (e.g.: money you won by purchasing a lottery ticket abroad, in person, from the public lottery company of the country where you spent your vacation) are subject to taxation.

Social gambling is considered gambling in Turkey (and probably social casinos too, there is a detailed explanation about the situation of social casinos in the comments section, at the bottom of the page), in fact, it’s one of the few countries where this is directly mentioned and regulated in the applicable parts of the gambling legislation. Needs to be approved by the Ministry of Finance. Loot boxes and other gambling like activities with virtual goods and services are not yet regulated, but considering the propensity of the Turkey government to control all forms of gambling, it’s only a matter of time that they will be. Especially, considering that video game companies are overwhelmingly American, and Turkey is not exactly friendly towards American companies (for good reason, American intervention, holding countries economically hostage, letting the 1% buy up entire war torn countries right from underneath the citizens after wars they have started, and controlling, manipulating the current world currency, the petrodollar to further their own agenda, their “novus ordo seclorum” haven’t really endeared them to people in the Middle East, Turkey and Muslim majority countries). Taxing loot boxes and regulating them as gambling is another great opportunity for the Türkish government to tax American companies, probably they will somehow act on it, sooner or later.

Brick and mortar casino gambling was outlawed in Turkey as early as 1997. Before that, the casino industry thrived with an estimated yearly turnover of $1bn, and approximately 20,000 people  were employed by the sector. Much of the casino gambling went underground after that, the state put serious efforts into enforcing the laws in this area. This culminated in concentrated raids in 2016, which put an end to large scale illegal casino gambling in the country. Nowadays, the casinos of Turkey, and operators of such establishments, all moved their interest, involvements and investments to Northern Cyprus, which is well known as the casino playground of Turkey, and it is visited by many Turkish tourists looking for casinos.

Online casino gambling was first outlawed in 2007, and regulations were further tightened in 2013. Operating online casinos in Turkey, even from abroad, is a criminal offence and is punishable by four to six years of imprisonment, and huge fines. Players, if caught and prosecuted, could theoretically expect fines ranging from US $55k to $278k, but this not really enforced (to the best of my knowledge, if you know of any instance of enforcement, when players were fined for playing in unlicensed online casinos, please let me know in the comments section, I couldn’t find any).

Many of the major global online casinos no longer offer their services to Turkish players, so far no individual players (to my knowledge) have been prosecuted for illegal online gambling, but many organizers and even employees of gambling establishments have been prosecuted.* Despite this, some offshore online casinos still accept players from Turkey (they have offshore gambling licenses, they are located outside of Turkey, and in their jurisdiction, and with their gambling license, what they are doing is legal, because it’s online and they process the players and transaction outside of Turkey, legally speaking no gambling takes place in Turkey). You can see these websites below, but we do not recommend playing from Turkey at this point, just to be safe.

Bingo in Turkey

 

Online Bingo in Turkey: illegal, players are not currently prosecuted but could be

 

In many countries where lottery is a state monopoly, bingo is considered a lottery type game and is part of that lottery monopoly. This is not the case in Turkey. Instead both land based bingo and online bingo are entirely outlawed by the Turkish authorities. (a huge oversight and bad decision IMO, they are missing out on a lot of tax revenue, and bingo is probably the least addictive, least harmful form of gambling).

It shows just how serious the Turkish government is about the ban, that in 2008, 6 British tourists were actually arrested and fined for organising a game of charity Bingo in the popular tourist city Altinkum*. Not for profit,  bingo for charitable purposes, where the proceeds go to various charities is usually an exemption to the bingo monopoly of the state, in countries where bingo is part of the state monopoly. But In Turkey there is no bingo monopoly, and also there is no exemption granted for charity bingo, or raffles.

In some countries poker is considered a game of skill, not gambling, and therefore the gambling legislation is not applicable to poker (in truth, it’s between a game of skill and gambling, it’s neither). This is not the case in Turkey, poker is considered gambling. Consequently, land-based poker was prohibited alongside all other casino games in 1998, when casinos were outlawed by the authorities as potential venues for money laundering operations.

In 2013, a stricter, more restrictive online gambling legislation was introduced, which, among others, effected online poker as well. Legally, Turkish residents cannot play poker neither online, nor offline. None of the major online poker platforms allow players from Turkey to register since 2013. I could only find a few smaller sites that still do, see below

Sports Betting in Turkey

 

Online sports Betting in Turkey: legal, state monopoly, the the state-run betting companies don’t have online platforms, even though it’s legal

 

Sports betting is a state monopoly in Turkey, and the only legal betting opportunities are the ones offered on the state-run horse tracks of the country and sports betting organized by the Turkish Sports Toto (the IDDAA sports betting game). Both of these sports betting companies are owned and controlled by the state. And none of them, despite online sports betting being legal, have any online sportsbooks or betting platforms.

Betting on unlicensed foreign platforms is a huge issue in Turkey, but blocking them, litigation, and fines don’t work (just like every other country), the next logical step should be, offering legal domestic alternatives, so citizens choose them instead. It should be obvious, but old political appointees, from the pre-internet era at the head of these companies,  don’t seem to be steering the country in this direction.

One of the big disadvantages of state run companies is that the higher management positions are always (more often than not) filled by people who are not really talented, but have “political capital” instead of being good at their job. Quite a shame, they are missing out on astronomical amounts of tax revenue because of this, hopefully that privatisation they are trying to do for years, goes through, that could be one solution to this (but if it was me, I would leave it state controlled, and I would start working on removing the talentless political appointees instead, an institution-wide purge, not just remove them, but dispense with them entirely, easier said than done of course).

Horse racing is still somewhat popular in Turkey and betting on races is extremely popular, even though the total takeout rate is a stunning 50% (highest in the world). The Jockey Club of Turkey, the organisation conducting all the races is taking a 22% cut from all wagers and the government takes another about 28%, in the form of taxes. Despite all of this, Turks wagered the Turkish Lira equivalent of $1.49 billion on horse races in 2012* and it’s a growing sector.

The other legal sports betting venue, IDAA is also very popular and you can even make bets online on their website. The fact that the government seeks to privatise the company behind Sports Toto for $10 billion, along with the Horse Racing Authority shows just how profitable these operations are. So far, this privatization (10 year licence to organize sports betting by a private company, after that, it goes back to the state) was not successful. Not surprising, because even though they are cash cows, they ask a ridiculous amount upfront, very few companies can put together that amount, payment in installments over the years could be a solution (a license fee annually) to this. But even with that, it’s questionable whether this is a good investment (I would just invest that money somewhere else, I’m pretty sure you can get better ROI on other investments in the gambling industry, with such a hostile environment, hostile to foreign investment, hostile to gambling, I doubt a company could turn a profit, unless it’s a company that has “close ties” to the government’s graces – just my opinion of course).

Foreign betting sites are illegal, and even the punters could be penalised. However, some offshore betting platforms still accept registrations from the Republic of Turkey despite this (it’s actually legal for them to do so, they are outside of the jurisdiction of Turkey, and the processing of players, the data centers are located outside of the country). If they no longer accept registrations from Turkey, or if they are blocked in the country, please let me know in the comments section, so I can update this list.

UPDATE 2021: Unlicensed online bookmakers which accept players from Turkey are blocked by the internet service providers. I updated the list according to this, but please let me know if the remaining sportsbooks on the list are blocked, so I can update it again.

The Turkish National Lottery is very successful. Probably part of the reason is the lack of competition due to the country’s strict ban on all forms of private online and offline gambling. In 2012, the company managing the lottery, Milli Piyango, had a revenue of an estimated 1,8 billion liras (approx. $0,6 billion).

It was part of the reason Net Sans-Hitay consortium offered $2.755 billion for the company on the privatisation tender. Although they backed out, the second bidder ERG-Ahlatcı has purchased the company for $2.75 billion.

The firm does not have an online platform so far, even after the successful acqusition of ERG-Ahlatcı. Which is quite a surprise, probably the state is not cooperative in this regard, but there is no official info about this (if you know anything, please drop a comment).

It’s illegal to purchase lottery tickets online from unlicensed lottery platforms (players are not prosecuted, in fact the online lottery websites are not even blocked, unlike unlicensed online casinos and online bookmakers). However, purchasing lottery tickets in person, while in another country, is perfectly legal. Just don’t forget, that winnings from the lottery are taxable.

While just wondering, I see also many online gaming such as poker and card betting within which coins are used instead of cash, and the coins are only one way convertible, meaning that I can use cash to buy more coins, while the coins bought or earned through winning will always be coins for further playing, that cannnot be convertied into cash again. In this way, am I also gambling? Or, do I violate any law or regulation against the Turkish authority?     1. I agree with you, it’s best to be safe, good choice.

      Back to your question: Yes, those are called “social casinos” in the gambling sector (from the legal term “social gambling”, which has nothing to do with social networks, it is small stakes gambling among friends that is usually legal and not punished, but not in Turkey, social gambling is also illegal in Turkey). I have seen them too online. You can buy coins with money, but coins are not exchangeable back into money, they are all over Facebook. It’s a legal loophole, and because they are a good source of advertisement revenue, they are tolerated on most websites, social networks. It all depends on how bets, coins, tokens are defined in the gambling legislation. However, in most countries where gambling is illegal, that is not specifically, or sufficiently defined. And to the best of my knowledge, it is not specifically defined by the Turkish legislation as well.

      This is a though question. In short: it’s probably technically illegal, operators, companies engaging in the activity in Turkey would get into trouble (all social casinos are foreign websites, not registered in Turkey), but players would not be prosecuted or fined.

      Details: In my opinion, according to the Criminal Code of Turkey:

      “(4) In the implementation of the Criminal Code, gambling shall be defined as a game
      undertaken with the aim of earning money, where the profit and loss depends upon
      chance.”

      And in my opinion, keep in mind, this is in no way the official stance of the Turkish government, only my interpretation of the law, this does not include social casinos, because there is no way to make a profit, tokens are not exchangeable back into money (but they make a profit from your purchases of the coins, see, not easy, which one, probably depends on the judge).

      HOWEVER! It also says:

      “(1) Any person who provides an environment or the means for gambling shall be sentenced
      to a penalty of imprisonment for a term of up to one year and a judicial fine.
      (2) The penalty to be imposed shall be increased by one fold where an environment or
      means is provided for children in order to gamble.”

      And the intent of social casinos are very clear, it’s obviously gambling, these companies attract a lot of investments because it’s obviously a legal loophole, allowing gambling (this is a similar situation to fantasy sports betting in the US btw.). Therefore, I would say operators In Turkey would probably be fined, prosecuted, and it’s technically illegal. Not to mention! They allow children, minors under 18, to register! Which is a big violation according to the Criminal Code.

      Notice how it is actually worded “Any person who provides an environment or the means for gambling” (not mentioned, but obviously includes companies too) so not the players.
