This is a guide to brick and mortar as well as online casinos in Turkey (officially the Republic of Turkey, unlike its neighbours it is a secular state, but its legislative system still bears the traits of Islamic influence in some areas, has a population of 84.3 million, one of the few predominantly Muslim countries with some widespread legal gambling). Online casinos in Turkey

Legal status of digital casinos in Turkey: illegal since 2007

 

Online casinos are illegal in Turkey, since 2007, according to the 2006 Regulation on Online Gaming (effective from 2007)1. Exceptions are granted to the state-owned gambling companies, but none of them operate an online casino.

However, this only applies to Turkish citizens within the territory of the Republic of Turkey.

/Comment: This is called a jurisdiction, a country’s laws only apply within the borders of the country, in short: within its so called jurisdiction./

Foreign licensed online casinos still accept Turkish players (you can see a list of them below). These online gambling websites are registered and licensed in other countries, and therefore the laws of Turkey do not apply to them; they can legally accept players from Turkey. However, it is illegal for Turkish players to play in these online casinos (tourist, migrants, non-residents, expats residing in Turkey can play legally).

Since 1998 casino gambling is illegal in Turkey (details can be found in the casinos in Turkey section  below). However, between 1998 and 2007 online gambling in the Republic of Turkey was unregulated, and there were actual Turkish online casinos, which were operated by companies registered and based in Turkey (many of them had ties to the banned casinos, details below, in the Turkey land-based casinos section, additionally, they were rumored to have ties to organized crime groups as well, similarly to the banned casinos).

Tho avoid a similar situation to the disastrously corrupt brick & mortar casino sector, the state acted fast and cracked down on these illegally operating online casinos. As a result, these casino websites disappeared almost overnight, at least those registered and operating from within the country.

/Comment: A good chuck of them just simply moved to offshore locations./

Ever since this online casino ban there are no Türkish domestic online casinos. Many illegal organizers and even employees of illegally operating online gambling companies have been prosecuted since the official ban2.

However, despite this, between 2007 and 2014 online casinos operating from foreign countries accepted players from Turkey without any problems (none of them were actually available in Turkish, therefore only people who spoke at least basic English could play online).

Since 2014 the government is more strict when it comes to foreign online casinos, and they force internet service providers (ISPs) to block such sites.

/Comment: Only the biggest digital casinos seem to be blocked, and it is really easy to circumvent this ban with a VPN. VPN services are freely available online (don’t get fooled, no need to pay for them, plenty of them are free), registration takes 1 minute./

The government also threatened players and announced that anyone, who plays in unlicensed online casinos will be fined. The fines range from US $55 K to $278 K, which are a ridiculously big fines, considering that the annul median income in Turkey is around $6000)3.

UPDATE 2022: The ISPs in Turkey started to block access to unlicensed poker networks, bingo websites and bitcoin gambling websites as well, in addition to online casinos4.

However, to the best of my knowledge, players are not prosecuted for playing in offshore online casinos. The authorities try to go after the unlicensed rouge companies instead, which makes sense, because the overwhelming majority of players (90%+), who place bets in these online casinos don’t even know they are breaking the law. It would not be fair to punish them.

Land-based casinos in Turkey

Legal status of casinos in Turkey: illegal since 1998

 

Casinos are illegal in Turkey since 1996 (effective from 1998), according to the Turkish Criminal Code1, which states that games of chance (Şans Oyunları), including online gambling, and betting & wagering (Müşterek Bahis) are illegal.

However, this was not always the case, casinos were first legalized in turkey in 1983.

/Comment: Not completely clear, according to various sources it’s either 1973 or 1983. And prior to the legalization some casinos already operated, since the 1960s, and they were tolerated.2

I’m going with 1983 as the date of the legalization in this guide./

At its height, the casino sector generated $1billion annually, which was one third of the country’s tourism revenues at that time.

There were 79 casinos in total (although, it’s not clear which of these were genuine casinos and which were only slot halls with just slots, they were both called ‘casinos’ by the press erroneously). This made Turkey the first and so far only Arab country with and thriving casino industry.

/Context: Arab countries (e.g.: Egypt, Libya, Qatar, United Arab Emirates) barely have a few casinos (compared to their population size and wealth), and the few they have are only available to tourists, locals are not allowed to enter. That’s why Turkey’s casino experiment was so important.

And because it failed, it cemented the current stance towards casino gambling in the Arabian Peninsula, and made talks about liberalization in other Middle Eastern countries unfeasible./

The golden age of casinos lasted from 1983 to 1998.

Brick and mortar casinos in Turkey were made illegal in 1996, but it took 2 years to finally get them closed.

The casino ban was the direct result of the assassination of the ‘casino king’ Ömer Lütfü Topal.

/Comment: He was gunned down with a Kalashnikov rifle, a fate well deserved according to most of his contemporaries. He was involved in organized crime, money laundering, corruption, tax evasion and various other scandals, a truly evil and vile man, according to everyone who really knew him3./

The burgeoning casino sector was a hotbed of criminal activity, and casino companies often had ties to organized crime dynasties, bribed local officials and the venues themselves were often used for money laundering. To add insult to injury, revenue form the sector also financed fringe political groups, corruption and domestic terrorism.

As a result, casinos became synonymous with corruption and organized crime, and they started seeing private gambling companies as enemies (for good reason, sadly). This resulted in  total ban on gambling organized by private companies (not just casinos, every other kind of gambling establishments owned by private companies were banned).

The only exceptions to the ban were the betting offices of the state-owned lottery Milli Piyango, and the hippodromes and betting points of the Jockey Club of Turkey.

The ban was so comprehensive that even the possession of gambling machines and tables are prohibited, according to Law on Roulette, Tilt, Pinball and Similar Game Tools and Machines (Law No. 1072)4. Sadly this includes pinball machines as well, that’s why you don’t see any pinball machines in pubs in Turkey, they are also illegal.

After the ban in 1998, most casinos closed. However, a few just went underground, and they became “private clubs”, with an upscale clientele, strictly invitation only.

Because some of the members were upper class, rich, influential people, with ties to politicians, they were able to get away with these private clubs for a long time. However, in 2016, concentrated attacks, coordinated raids, targeted these clubs, and all of them were shut down.

Since then, only small scale illegal gambling is present in Turkey.

It’s common knowledge that the Northern-, Türkey controlled part of Cyprus is the casino district of the country, where many of the businessmen and companies ended up after the casino ban.

/Comment: Cyprus is actually the casino playground of the Arab world, a favourite of the upper middle class, rich Middle Eastern tourists. Consequently the tiny island country boasts an impressive casinos sector.

UPDATE 2021: They ae currently building Europe’s next biggest casino, the City of Dreams Mediterranean./

The now banned casinos hugely contributed to the development of the tourism and hospitality sector of Turkey (most casinos had hotels, either in the same building, or the company owned hotels and/or resorts as well).

As a result, over time, Turkey became the 6th most visited country in the world, with 52 million tourists5 visiting per year (UPDATE COVID-19: pre coronavirus numbers, the number of tourists visiting the country has drastically decreased as a result of the global pandemic).

Turkey could easily take advantage of the enormous untapped potential in the tourism sector and the rich oil countries (which do not have casinos of their own) if they would relegalize casinos.

/Comment: In my opinion they are making a huge mistake by not giving the casino sector another chance.

Also, the casino sector employed 20 000 people in its heyday, and casino employees are usually paid more than employees in similar positions in other sectors. Good paying jobs is what the people of Turkey need more than anything else./

Bitcoin casinos Turkey

Legal status: not specifically regulated, de facto illegal

 

Bitcoin casinos are not specifically addressedd by the Turkey gambling legislation. However, none of the state sanctioned gambling operators accept cryptocurrencies, which makes bitcoin gambling de facto illegal.

The lottery was privatized in 2015, a temporary license for 10 years was awarded to ERG-Ahlatcı. Prior to this, the other two state controlled gambling operators, the sports betting Spor Toto IDDAA and the horse racing betting provider Jockey Club of Turkey were also privatized.

Based on this, it’s likely that eventually online casinos will be legalized as well. And similarly to all the other forms of online gambling they will be first controlled by the state, then eventually, it will be privatized. No set date yet, it’s unlikely that something like this would happen prior to 2025.
