Gambling is legal in Luxembourg since 1977, according to the 1977 Gambling Law1, which is the main piece of the gambling legislation even to this day.
History of gambling in Luxembourg: Technically gambling has been legal in Luxembourg since 1870. However, it was banned between 1870 and 1945, and between 1945 and 1977 only lottery was legal. 1977 only marks the beginning of the modern gambling legislation.
The details cab be seen below:
19th century – The first written mention of gambling is from the 1840s, when entrepreneurs tried to receive a license to operate gambling houses within the country. These proposals were rejected up until 1870.
However, eventually they succeeded, and officially legal gambling started in the 1880s, with the opening of the Casino Bourgeois, the country’s first casino.
And just like in the rest of Europe at that time, it was more of a private club for nobles, the rich, and the famous people of that era (who were also usually very rich themselves). Casino games were only a side attraction, it was more of a private VIP casino club for the 09th century “1%”.
Lottery was also legalised in the 19th century, in 1888 by King William III, the Prince of Orange and Nassau, according to Loi du 15 février 1882 sur les loteries (see the lottery section below for details).
20th century – Casinos and gambling were made illegal in the 20th century till 1977 (except for the lottery), just like in most of Europe at that time. They were seen as unsavory, unchristian dens of organized crime, which were more true than not at that time (back than people took their religion seriously, unlike today).
Technically all forms of gambling are still illegal to this day, and only exceptions are granted.
Two important events happened n the 20th century:
- 1945 – The Loterie Nationale, the Luxembourg National Lottery is established. The lottery is non-profit, state-owned and proceeds go to various healthcare and cultural institutions within the country.
- 1977 – The 1977 Gambling Law legalized “licensing of certain casino gambling establishments in the interests of tourism” (unofficial translation by me), which marks the start of modern gambling in Luxembourg, and this act relegalized casinos.
21th century – The national lottery provider starts selling lottery tickets online, which makes online lottery and internet sports betting the first two officially legal forms of online gambling in Luxembourg. And this makes Loterie Nationale the first and so far only online gambling provider of the Grand Duchy.
Eventually it is determined in 2021 that the 1977 gambling legislation applies to the other forms of online gambling as well. This means that online gambling is actually legal in Luxembourg, and has been since 1977.
Online gambling is also legal, but there are no specific laws, which would regulate internet games of chance2.
UPDATE 2021: It was determined by the Ministry of Justice and the law firm BSP2 that the existing gambling legislation applies to digital betting, wagering as well. This makes online gambling technically legal.
/Comment: This is really interesting and unusual, in similar situations, in other European countries, the verdict was usually the opposite./
Right now the only licensed entity in the country is the online lottery of the national lottery provider Loterie Nationale. In theory private online gambling companies could apply for a licence as well. However, there is no online gambling licensing process in place, which makes it de facto impossible.
Luxembourg and EU gambling laws: Because Luxembourg is an EU country Article 56 TFEU3 and Article 8 of Directive 98/34/EC (EU gambling directives) apply.
These state that other EU online gambling companies should be provided access to the Luxembourgish market, and these companies should be provided a way to obtain local gambling licenses (free trade of services and free competition within the Eurozone).
This is not the case, because even though it was determined in 2021 that online gambling is legal, there is no online gambling licensing system in place.
The EU Top Court ruled in 2016, in a similar situation, in Germany, that the government can not penalize or restrict unlicensed foreign operators, because they made it impossible for them to acquire licenses4.
/Comment: Prior to 2021 Germany had issues with online casino licensing. This has been resolved since, and the German online gambling legislation is now EU compliant./
This means that the government can not restrict the citizens from playing on foreign, unlicensed internet gambling platforms. And players can not be prosecuted for playing on unlicensed offshore online gambling websites, due to the EU articles and directives mentioned above.

Casinos are strictly regulated and the government is reportedly not in favour of more gambling establishments in the country, therefore acquiring a casino licence could be prove to be challenging, even though the number of licenses is not capped.
Only casino are legal, slot halls, gaming machines outside of casinos are illegal (except the ZUBITO video lottery terminals of the Luxembourgish lottery).
Online casino gambling is not specifically mentioned anywhere in Luxemburgian gambling legislation.
The only document that mentions online gambling at all is the National Lottery Law and that only applies to lottery and sports betting.
UPDATE 2021: However, the Ministry of Justice and Bonn Steichen & Partners, the leading law firm of Luxembourg, come to the conclusion that the current Gaming Law applies to online gambling as well, which means that online casinos are legal as well.
However, they remain de facto illegal, because their is no online casino licensing system in place. Meaning, private companies can not get a Luxembourg digital casino licence.
This contravenes EU Article 56 TFEU3 and Article 8 of Directive 98/34/EC, as mentioned above, and according to these EU directives Luxembourg currently can not prosecute and restrict local players from playing in foreign online casinos, until such a time that it issues online casino license to private operators.

As I won a big amount of money on an online casino site, MGA license, in Malta, I’m now afraid of some things.

You should be fine if what you say is true, and this is how it happened.
One thing though, most online casinos have a limit of how much money they are willing to send per week to winning palyers, it can be anything from €3500 to 100 000, or even more.
Some online casinos don’t even have such a restriction. It’s all over the place.
I strongly suggest you read the terms and conditions and especially the bonus terms and conditions if you have used any. Bonuses come with very serious limitations, it’s best to not to use any. That is the only thing they can use “to get you”.
If they cause you any trouble drop a line here I will look at it, I can even pull soem string for you with the MGA, if they try to cause trouble for you (I’m working in the online industry for 15 years, I know quite a lot of people, but I can’t promise anything of course but I hate it when internet casinos try to scam palyers, because I have been scammed too, in the past).
