Gambling in Belgium

Summary: Gambling is legal in Belgium (officially the Kingdom of Belgium, a rich Western European country, heart of the EU, with a population of 11.46 million) since 1851.

According to the 1999 Gambling Act1 (this is the main piece of the gambling legislation), all forms of gambling not specifically legalized were banned because of rampant illegal gambling.

Since then, all the main forms of gambling were legalized one by one (breakdown by category can be seen below). The gambling sector is strictly controlled and has remained relatively crime and scandal free since 1999

Online gambling is also legal in Belgium since 2011 (according to a 2010 amendment to the Gambling Act), and just like in the case of land-based gambling, all the main types were legalized over the years.

History of gambling in Belgium: Archaeologists have discovered documents referring to card games and lotteries existing on the territory of modern day Belgium as far back as 1300, and a regional lottery as early as the 15th century.

However, as interesting this might be, this has no bearing on the modern gambling landscape of Belgium (Belgium only exist in its present state since its 1830 independence from the Netherlands), and gambling only started officially in 1851 with the legalization of lottery, according to the Federal Act of 31 December 1851 regarding lotteries (a.k.a. Lotteries Act)1.

Between 1851 and 1999 gambling has accrued a very bad reputation, and many scandals were tied to various gambling operations (often operated by organized crime groups) in Belgium (which was considered a poor, backwater, coal mining country back then).

This has culminated in a gambling ban first in 1872, then in 1902, and finally in 1999, which is the third gambling ban in the history of Belgium.

UPDATE: Video game loot boxes were declared illegal in 2018 (without a gambling license). They are “in violation of the gambling legislation”, according to the Belgium Gaming Commission.

Loot boxes earned in game are fine, but those that can be bought for real money must be removed from video games in Belgium. Many video game companies (not all) have since blocked access to loot boxes for players from Belgium.

UPDATE The Belgian Parliament approved new amendments to the Gambling Act in 2019, introducing:

-a €500 per week deposit limit per player, per casino (bitcoin deposits do not count toward the limit)
-casino bonuses are not available anymore to Belgian players (casinos can no longer offer any bonuses to players from the country)
-you can only use a debit card, and you can’t use your credit card while playing online (not really an issue in Europe, what we call “credit card “is actually a debit card, most people in Europe have debit cards)
-players from Belgium can no longer place bets on unlicensed virtual sports betting websites (more of this at the sports betting section below, it is considered gambling)
-“Gamble in moderation”, “Gok met mate” must appear on every Belgian gambling website

Betting on blood sports in Belgium

All forms of blood sports are considered animal cruelty, and are illegal in Belgium. Betting on blood sports is also illegal, and it was illegal even before the 1999 gambling ban.

 

Can tourists play online while visiting Belgium?

Yes, the online gambling laws of the country only apply to citizens and lawful permanent residents, if you are a tourist (or a non-citizen expat, or illegal), you can play online freely while enjoying your stay.

 

Gambling licensing in Belgium

The gambling licensing authority of Belgium is the Belgian Gaming Commission. Website is available in English as well. You have to contact them if you wish to set up any sort of gambling business in the country.

The following gambling licenses are issued:

  • Licence D: employees of gambling establishments
  • Licence E: sale, rent, production, etc. of gambling equipment
  • Licence F1: organisers of bets (Class 4)
    • Licence F2: providing betting services (e.g. bookmakers, sports books, totalizators)
    • Licence F+: providing sports betting services on the internet
  • Licence G1: providing games of chance through television (e.g.: TV bingo)
    • Licence G2: providing games of chance through other media (not including the internet)

 

As you can see, online gambling activity is tied to brick & mortar licenses, and an internet gambling license can not be acquired separately.

This has caused a lot of controversy in the EU. Because according to Article 56 of TFEU3: if a country does not provide any means for foreign online casinos to acquire local licenses, then they can not punish or block these gambling websites, or players who visit them.

According to some interpretations of this law, the local license means a local online gambling license. And according to some experts, the current licensing system contravenes the EU online gambling directives.

However, court rulings seem to favour the Belgian government over the offshore online gambling operators4.

 

The number of land-based licences is capped:

  • the maximum number of casino licenses is 9,
  • there is a limit of 180 “arcades” (slot halls, arcades can have gaming machines in Belgium)
  • and only 34 bookmaker companies can be licensed (the number of bookmakers, betting shops is not capped).

 

As a result, it is rather difficult for international gambling companies to enter the Belgian market.

Lottery retailer licensing is done separately by the Nationale Loterij, the Belgian lottery monopoly.
