Summary: Gambling is legal in Isle of Man since the 1961 (also known as Mann, a British Crown Dependency, with a population of just 83 K, not a member of the EU, but integrated into the EEA).

United Kingdom gambling laws do not apply to the Isle of Man, the territory has its own gambling legislation.

Online gambling is also legal in the Isle of Man since 2008. In fact the territory is one of the less important online gambling licensing hubs, and it is also an offshore tax haven.

Gambling is legal in the Isle of Man since the 1961, according to the Gaming (Amendment) Act 19841, which is currently the main piece of the gambling legislation.

As of now, only one brick-and-mortar casino operates on the island, which was awarded to the Best Western Palace Hotel and Casino (you can read more about the single Isle of Man casino here). The maximum number of casino licenses is capped at two, one additional casino could open.

 

Online gambling is also legal, since 2001, according to OGRA – Online Gambling Regulation Act 20012. However, it was not until 2009 when the first online gambling licence was issued to Celton Manx Limited.

Since then, many more licenses and sub-licences were issued and the British territory has became a lesser known offshore online gambling hub.

  • Anti-Money Laundering Policy: Full AML due diligence. Indemnification procedures, record keeping, internal procedures, education and training, as well as adherence to the Isle of Man Gambling Control Commissioner’s Guidance Notes for the Prevention of Money Laundering.
  • Country Restrictions: It is the responsibility of the operator to decide, however the Gambling Control Commissioners may request independent advice be taken.

At one point leading online gambling brands (e.g.: Paddy Power, and the world famous gambling software provider and developer Microgaming Software Systems Ltd.) were also licensed here. However, they all left for other jurisdictions for unknown reasons.

Is the Isle of Man gambling licence a reputable, high quality license?

It’s a good licence. I couldn’t find evidence of any scandal.

Really big reputable companies used to be licensed here for years (the kind that can not afford damage to its reputation and brand, do not engage in anything shady for a quick buck, in it for the long run), and some are still licensed here, though there are much less bigger companies licensed here nowadays.

It is on the UK whitelist. It is a real license with real supervision and accountability, unlike most of the Caribbean and Central American offshore tax havens.

However, they do have a sub-licensing system, which in my experience always ends up being abused, and just opens up opportunities for shady activity. Although, in all fairness, I’m not aware of any such abuse or shady activity (if you know of any please leave a comment).

Isle of Man gambling tax

Gambling is VAT exempt on the Isle of Man.

The progressive gambling tax rate depends on the gross gaming yield of a company in a given tax year:

  • For gross gaming yield or retained profit exceeding GB£40 million per annum: 0.1%.
  • For gross gaming yield or retained profit of more than GB£20 million per annum, but not exceeding £40 million per annum: 0.5%.
  • For gross gaming yield or retained profit not exceeding GB£20 million per annum: 1.5%.

 

The prescribed proportion of gross gaming yield for pool betting is 15%.
