History of gambling in Ireland: The first gambling legislation dates back to 1854, to the Betting Act of 18541 (when Ireland was still a colony of the UK). Back then horse racing betting was the main form of gambling, and this is reflected in the wording of the act.
The 1926 Betting Act2 was the first gambling act of the newly independent Ireland (in 1922).
This was followed the specific regulation of sports betting with the 1931 Betting Act3.
Casino gambling was not regulated till 1956, that’s when the Gaming and Lotteries Act4 was issued.
And lastly the National Lottery is governed by the 2013 National Lottery Act5.
Despite the long history, the gambling legislation is still very underdeveloped in Ireland (compared to that of the UK), especially when it comes to online gambling (see below).
Gambling is legal in Ireland, the main pieces of the gambling legislating are the 1931 Betting Act3, and the 1956 Gaming and Lotteries Act4, and their amendments.
Although the act states that operating a land-based casino is unlawful, some loopholes allow the operation of private clubs with casino-like facilities (slots, and other gaming machines, even certain table games, it’s a casino except you are required to become a member, which is usually free, details can be found in the casino gambling section).
Gambling remained is still a somewhat grey area (certainly not well regulated, even to this day). The proposed Gaming Control Bill6 intended to make casinos explicitly legal and gambling as a whole better regulated.
UPDATE 2022: The Gaming Control Bill still hasn’t been passed, and it is unlikely that it ever will, at least in this form. There are talks about shutting down all private clubs and slot halls (this pops up every other year…) but Ireland’s casinos are still very much in operation.
Online gambling is also legal in Ireland (specifically mentioned in the 2015 amendment of the Betting Act7), which made it possible for Irish citizens to legally bet online at licensed gambling websites.
Gambling operator need to acquire a license (from the Revenue Commissioners) to organize online gambling activities and accept players from Ireland. However, there is currently no specific licensing regime for online gaming (except online sports betting).
The offering of gaming products online (and the promotion of these products) is generally prohibited under Irish law.
Unlicensed gambling websites are blocked and players playing in unlicensed online casinos are not prosecuted due to various EU laws (explanation below).
Ireland and EU gambling laws: Because Ireland is an EU country Article 56 TFEU8 and Article 8 of Directive 98/34/EC (EU gambling directives) apply.
These state that online gambling companies licensed in other EU countries should be provided access to the Irish market, and these companies should be provided a way to obtain local gambling licenses (free trade of services and free competition within the Eurozone).
This is not the case.
In a similar situation the EU Top Court ruled in 2016 that Germany can not penalize or restrict unlicensed foreign operators, because they made it impossible for them to acquire licenses9.

Because Ireland only issues online sports betting licenses and the licensing of other types of internet games of chance is not yet ironed out, Ireland too can not legally pursue unlicensed online casinos from other EU countries.

This conflict with EU laws led to the very unusual situation that Ireland can not restrict citizens from playing on offshore, unlicensed online gambling platforms (and these companies don’t pay any taxes in Ireland).

Betting on blood sports in Ireland
All forms of blood sports are considered animal cruelty, and are illegal in Ireland (except hare coursing, which is considered a traditional sport and hunting, it is an exception). Betting on blood sports is also illegal (which includes betting on hare coursing).

An Garda Síochána (the Irish police) have the power to issue permits for on-premises gaming, where the maximum stake is EUR10 and no player can win more than EUR3,000 in a game (subject to certain requirements and restrictions).
Online gambling licenses are also issued by the Revenue Commissioners. There are only two types of online betting licences that can be obtained in Ireland:
- A remote bookmaker’s licence, which will cover the provision of betting services online.
- A remote betting intermediary’s licence, which will permit an operator to provide facilities that enable persons to make bets with other persons (other than the operator) by remote means.
Significantly less information is available about these licenses.
Due to issues with the Irish online gambling licensing system, even domestic companies (which are engaged in something other than online sports betting) have offshore gambling licenses (usually from tax havens). Even the Irish National Lottery has a Malta gambling licence, which it uses for its online bingo and lottery, in leu of domestic alternatives.

Gambling venues (private clubs, slot halls) have to abide by strict anti-money laundering laws and are subject to frequent controls.
Revenue Commissioners are responsible for the licensing and regulation of these clubs, along with the Garda Síochána.
