Guatemala Gambling Guide
Gambling is officially illegal in Guatemala* (full name: the Republic of Guatemala, a Central American country of 17 million people, the most populous nation in Central America), but it is de facto legal, and there are multiple gambling establishments in operation, semi-legally, taking advantage of various contradictory laws.
Gambling has been illegal since 1880** (one of the first countries in Central America to regulate games of chance), according to Section 477 of Decree Number 17-73 of the current Guatemala Penal Code***, which specifically criminalizes gambling, and states the following:
“Illicit gambling: Bankers, administrators, businessmen, managers or other persons in charge and the owners of houses for gambling, stakes or chance games will be sanctioned with one to five years of imprisonment and a fine of one thousand to ten thousand quetzals (about $1300).”
Obviously, there is a lot of money in this sector, and various special interest groups, with even more. Therefore, despite the official ban, the Decreto Número 574 El Presidente De La República**** from 1956, which made it possible for gambling establishments to operate, if the Ministry of Interior licenses them. I call this semi-legal, because obviously if the government officially licenses these establishments, it can not be illegal. But it’s also a nice window into the inner workings if this obviously “not corruption free”, bad system.
However, regulation and oversight is very unclear (if there is any at al, no regulatory agency that’s for sure), and the Ministry of Interior only issues licenses, collects licensing fees, and that seems to be all. Scandals involving money laundering, organized crime activity are almost a yearly occurrence, and according to the Caribbean Financial Action Task Force*:
“National regulations for this activity are incipient and do not have the controls required to ensure the adequate taxing and verification on the origin and destination of financial resources, the financial management of large sums of cash being generated, credit accounts and international wire transfers, among others.”
Whether you are a tourist, or a local, I recommend avoiding these semi-legal local gaming venues, because of the issues above, and no accountability. It’s best not to trust such establishments with your personal info, including ID number and credit card information.
This is sadly typical of Central and Southern America (and the entirety of Africa), corruption, influence of organized crime are very real issues, with very real, very bad consequences for the average citizens (e.g.: the situation in neighbouring El Salvador is the same, gambling is officially illegal, yet there are about 20 gambling establishments: 10 casinos + 10 slots, operating semi-legally).
The only exception is the lottery, which appears to be properly regulated and it is officially legal and controlled, since 2005 (details at the lottery section below).
UPDATE COVID-19: The number of visiting tourists declined significantly (more than 50% reduction all over Central America*****, but it is bouncing back quickly). This has resulted in the permanent closures of gambling houses all over Central America. However, due to the lack of regulatory agency, and because the Ministry of Interior does not publish an official list of licensed companies, or gambling establishments. The impact of the coronavirus pandemic on the gambling sector in Guatemala remains unknown.
Online gambling is not yet regulated (UPDATE: except online lottery, which is legal since 2008). Guatemalan citizens can play online freely. You can see a list of online casinos, which accept players from Guatemala below.
UPDATE 2021: There have been talks of regulating and legalizing the gambling sector properly, since at the very least 2011. The 2013 draft law (No. 4685)***** would regulate brick & mortar gambling establishments, would set up a licensing and regulatory agency, and would introduce a gambling tax and many anti-money laundering processes. However, the draft law continues to catch dust, and face opposition, stalling from government officials and anyone opposing a more clear, transparent, regulated, less corrupt gambling industry.

Can tourists play online while visiting Guatemala?
Yes, the laws of the country only apply to citizens and lawful permanent residents, if you are a tourist (or a non-citizen expat, or illegal), you can play online freely while enjoying your vacation.

According to the Caribbean Financial Action Task Force:
”a sector that until this moment does not have an adequate regulatory framework and does not provide the authorities with the tools to control and have oversight on

The licensing is done by the Ministry of Interior (MINGOB) (Spanish only), if you wish to set up any kind of a gambling establishment, you have to contact them. Nothing else is clear, they have no info about the licensing process on their website at all. No info about the licensing fees, and no contact info whatsoever (if you know these, please drop a comment). Your best bet is to get a Spanish translator, and contact the Ministry personally, but without political connections you are unlikely to get any sort of response (and if you have connections you already know who to contact).

According to the 1880 Penal Code of Guatemala, all forms of gambling are illegal (except the lottery). However, despite this, there are at least 3 operating casinos in the country (no official data on the exact amount), licensed by the Ministry of Interior. They are often called “video lotteria”.
/video lotteria definition: comes from the local name for slot machines, video lottery machines, they are slot halls mostly, but often bigger casinos call themselves as such too./
The first casino was Club Monja Blanca, which opened in 1979 (but smaller gambling establishments existed prior to this, but no big casinos). This was a favourite meting place of the infamous political elite of the time, and probably this is where the mixing of organized crime, money laundering, tax evading offshore companies, and the political “elite” really started in earnest, and that is likely the reason why the current situation is the way it is.
There are approximately 4 casinos, and unknown number of smaller slot halls, bingo halls (the government does not have an official list, and the smaller gambling houses don’t have any online presence, therefore, it’s impossible to know for sure just how many of them there are, but during my research I have encountered at least 20+). Most of these casinos and gambling establishments are in Guatemala City, and nearby resort towns, frequented by tourists. The biggest casino is Guatemala Princess Casino.
The government tried many times to legalize and regulate gambling*, but so far, this did not happen. And it is unlikely to happen any time soon. I recommend avoiding these semi-legal, unregulated gambling establishments, especially if you are a tourist.
