Online casinos are legal in Switzerland since 2019, according to the Federal Act on Games of Chance1, which is also the main piece of the gambling legislation.

The Swiss online gambling legislation underwent a huge change in 2018, with the passing of the so called ‘Geldspielgesetz”, which directly translates to Money Gambling Act (but most commonly referred to as Federal Act on Games of Chance, passed in 2018, effective from 2019).

According to this new gambling act, for the first time ever in the history of the Swiss Confederation, online casino licenses are issued to private companies (only companies with an existing brick & mortar casino licence can apply for an online gambling extension, details can be found below, in the Switzerland casino section and in the online casino licensing section below).

Prior to the current situation, online gambling in general was illegal, and only exceptions were granted to the canton lottery companies: Swisslos and Loterie Romande.

In accordance with current law, the Swiss Federal Gaming Board is tasked with licencing, regulating and overseeing licensed online gambling companies in Switzerland (with the exception of the aforementioned lottery companies, which are regulated by the Intercantonal Lotteries and Betting Board, the ‘Comlot’).

A land-based casino licence is the prerequisite of a Swiss online gambling licence (much to the chagrin of the European Union, often criticized by the EU, but because Switzerland is not a member no sanctions were imposed). Only companies, which operate a brick & mortar casino can apply for a licence extension through a public concession. The maximum amount of online casino licenses that can be in use is currently capped at 21 (one per terrestrial casino licence).

At the time of writing at least 10 casinos have successfully applied for an online casino extension. Foreign companies registered and licensed in countries, which are part of the European Economic Area (EEA) can enter into partnerships with licensed Swiss casino companies (e.g.: Oryx Gaming partnered with Grand Casino Luzern2).

Because all brick & mortar casino licenses are taken (details can be found below, in the land-based Switzerland casino section, above the casino list), this is the only way foreign companies can:

  1. enter the Swiss market;
  2. operate licensed online casino platforms;
  3. and accept players from Switzerland legally.

 

Using unlicensed online casinos is illegal. Since 2019 unlicensed internet gambling platforms are not only blocked, but financial institutions are also instructed to stop financial transactions to and from these unlicensed wagering platforms and their offshore bank accounts3 (you can see some of the licensed casino websites below).

Even though Switzerland is not a member of the EU proper, it is a member of the Eurozone and it is integrated into the European Economic Area. Therefore, there is a clear trend towards convergence and harmonization of the regulation of cross country activities, e.g.: online gambling.

As a result, Switzerland now has almost all the characteristics of the typical European online gambling framework, which are the following:

  • open to private investors, so called ‘liberalized’ gambling market, with a licensing system in line with the EU directive on the freedom of competition, free flow of services within the European Economic Area (according to TFEU article 563, and Article 8 of Directive 98/34/EC)
  • high gambling tax rates (compared to non-European countries), 20% – 80%, extremely high progressive digital gambling tax rate, even by European standards
  • unlicensed online gambling website are blocked, but players who visit them (mostly by accident) are not prosecuted
  • all the main forms of online gambling are legal, but only the Swiss online casino gambling and digital poker sectors are open to private investors
  • lottery and lottery-like games are a state monopoly (online versions as well), monopoly of Swisslos and Loterie Romande, sports betting and online sports betting are part of their monopoly as well

 

Interestingly, before the legalization of online casinos there was one online casino like website in Switzerland, which was a cross between a real online casino, and a strictly free to play platform.

Swiss Casinos (the biggest Swiss casino group, they operate 4 casinos) has created an online gambling website, where players could play various games without depositing any money.

Players couldn’t actually play for money, but Swiss Casinos offered various gifts in exchange for in-game coins, which you could win by playing. Gifts available included tickets to their brick and mortar casinos, slots vouchers and various coupons.

UPDATE: As soon as it became possible Swiss Casinos applied for an online casino extension. They were among the first companies to do so. They transformed their social casino platform into a real online casino, transferring all the free to play players they have accumulated over the years (after an extensive opt-in of course, for legal reasons), with the questionable method detailed above.

Casinos are legal in Switzerland. They were actually legal as early as 1881. However, gambling was made illegal in 1921. Casinos, which were in operation prior to 1921 were allowed to remain open, but no new casino licenses were issued until 1998.

The 1998 Federal Act on Games of Chance and Casinos added a casino referendum to the Swiss Constitution. This meant that citizens of the cantons could directly vote on matters related to casinos and casino gambling from then on. This marked the beginning of the relegalization of casinos, and eventually the legalization of online casinos in 2018.

The oldest casino in Switzerland is the Casino Barriere de Montreux1, located at Lake Geneva, built in 1881, and it is still in operation today (owned by the French casino group Groupe Lucien Barrière).

There is usually only one casino per canton. And only 19 of the 26 cantons have legalized casinos so far (at the time of writing).

The biggest casino group in Switzerland is Swiss Casinos (offically Swiss Casinos Services AG), which operates 4 casinos in the country, these are:

  • Casino St. Gallen
  • Casino Zürich
  • Casino Schaffhausen

 

The second biggest casino chain is the French Groupe Lucien Barrière, which operates 3 casinos:

  • Casino Barrière de Montreux
  • Casino Barrière Fribourg
  • Casino Barriere Courrendli

 

Casino Lugano is currently the biggest casino of Switzerland. You can see the details, address, opening hours and a video of each of these casinos in the list below.

Switzerland is officially a confederation made up of 20 cantons and 6 half-cantons. Casino gambling is regulated on a federal level, but cantons have to give their consent for a land-based casino to receive a licence in that canton.

The minimum age of entry varies between 18 and 21 by canton. Id is required to enter, and for tourists passport.

UPDATE 2022: Interestingly, the casino companies present on the Swiss market are not profitable since 2007, in fact, many have losses in the millions (millions of €), per month.

Even with the new legalization of online casinos many of the casinos remain in the red, due to the extremely high gambling tax rates, cost of workforce, licensing fees.

Additionally, many of them are heavily investing into an online casinos extension, which might not be paying of, now that there are more and more licensed Swiss online casino on the market.

It is expected that there will be some restructuring in the Swiss casino sector very soon.

Can locals visit the casinos in Switzerland?

Yes, both locals and tourists can visit the casinos in Switzerland, unlike in some other countries (e.g.: in the entire Muslim world casinos are only available to the tourists, locals can not enter).

 

Casino licensing and regulatory body of Switzerland:

Casino licenses are issued by the Swiss Federal Gaming Board (SFGB). You have to contact them if you wish to set up any sort of gambling business in Switzerland. Their website is not available in English (only available in Italian, German and French).

The number of casino licenses is capped at 21. Currently, all 21 land-based licenses are in use, and at the time of writing 11 online casinos licenses have been issued.

There are two types of gambling licenses in Switzerland:

  • lottery license (regulated by the Federal Act on Lotteries and Commercial Betting, for regional lottery and betting, issued by the Intercantonal Lotteries and Betting Board, no online betting or lottery, that is a state monopoly)
  • casino licence (for brick & mortar casino gambling and with an extension, for online casinos games as well).

 

Only 19 of the 26 cantons have legalized casinos so far (at the time of writing, see the table above for details and a list of cantons, which have legalized casinos).

Licenses are used to be valid for 20 years, but since 2018 they re only valid for 6 years.

The tax rate in Switzerland is the second highest in all of Europe (it’s the highest in France, where the gambling tax rate can literally reach 100% in certain rare cases), it’s a progressive tax system.

This is on top of regular taxes (e.g: corporate tax, which is between 11.9% and 21.6%). Gambling is VAT exempt.

Update 2022: According to the decision of the Federal Council of December 17, 2021, a 2-G certificate (vaccinated, recovered) is required to enter the restaurants, cultural and leisure facilities. This also applies to casinos.

1., Casino Lugano

This is currently the biggest Swiss casino, both in terms of the number of machines and also gaming area. In operation since 1885 (only a casinos since 1912, before that it was a theater, Teatro Kursaal, the second oldest Swiss casino, also known as Casino Kursaal).

In 2020 Casinò Lugano has improved and expanded its gaming offer greatly.

It is a majority state owned casino, 67% owned by the Ticino Swiss canton (and 29% by Casinos Austria).

Accepted currencies: Euros and Swiss Francs.

 

Games: around 420 gaming machines (slots, video poker, good brands, most slots are from the 2010s, but they have many new slots too, good selection), and around 27 tables (7 American Roulette wheels, 3 French Roulette wheels, 3 Caribbean Stud Poker, 2 punto banco tables, 6 blackjack tables, 2 baccarat tables) + around 5 electronic roulette machines with at least 25 terminals

Currently, Casino Zürich is the second largest casino of Switzerland, and this is the flagship casino of the largest casino group of the country, Swiss Casinos Services AG.

The Zürich venue is one of the least good looking of all the Swiss casinos.

/Comment: How it looks on the picture to the left, with the decorative Christmas lights is really not representative, usually it’s just an ugly concrete slab, it has no personality, no beauty, utilitarian. One would expect better from the biggest casino group of the richest country of Europe./

Casino Baden is the flagship casino of Casinos Austria in Switzerland.

They used to have a so called gaming arena, which was a very interesting new approach to the casino experience, the latest trend in casinos.

A gaming arena combines high tech features (huge LED displayes, HD screens, livestreaming your results), disco atmosphere (live DJ, music, strobing lights) to create a group gambling experience that is also a party. Mostly aimed at they younger under 40 crowd.

/Comment: I personally find it loud and stressful, but I’m sure it has its fans. Can be fun in a group after a few beers, that sort of thing./

UPDATE 2022: However, they seem to have discontinued the gaming arena, for unknown reasons, it is no longer featured on the website. Probably it wasn’t popular enough, the clientele consist mostly of older people.

Casino Baden, in partnership with ORYX Gaming, operates an online casino platform as well.

This small Swiss casino is a very unique and interesting looking venue surrounded by beautiful nature, and has its own majestic garden-park (the Kursaal Park).

Casino de Crans-Montana (the ski resort casino) is IMO the ugliest casino in Switzerland. It looks like a low quality mall, the kind you see in the poorer section of cities, very ugly.

However, the situation inside is much better. Even though it is smaller casino, it still has everything you would expect from a casino. They also have a few age-old machines (mechanical slots from the 90s and early 2000s video slots) for nostalgia.

/Comment: I always like if a casino keeps a few mechanical slots and older but well maintained video slots around for nostalgia and tradition. I love it./

This casino is mostly visited by tourists and vacationers visiting the nearby ski resorts.

The casino is owned by Société du Casino de Crans-Montana SA., which is owned by the Partouche Group.

Casino Mendrisio is the flagship casino of the Admiral Group (a subsidiary of Austrian gambling giant Novomatic), located right by the Fox Town Outlet Center.

It’s a large casino (by Swiss standards, medium by international standards) and the best looking gaming venue in Switzerland IMO.

The venue is located 5 minutes from the Italian border so expect a lot of Italian tourists.

The casino has 1,200 free parking spaces for patrons. Interestingly the casino only has an Italian website, very atypical for a Swiss casino.

 

Games: around 380 gaming machines (slots, video poker), and around 22 tables (American Roulette, blackjack, Punto Banco, Ultimate Texas Hold’em, Sic Bo) + 4 electronic roulette machines

Casino Davos is a very small casino of Davos Klosters, an upscale, very expensive alpine ski resort, famous (or infamous, depending on your perspective) of the annual World Economic Forum meetings, where the 1% and other ‘movers & shakers’ of the global economy come to exchange ideas and discuss global agendas.

This is the smallest casino of Switzerland right now (in terms of number of machines), it is located right next to Hotel Europa.

Even though the casino is small, it has really good machines, one of the better selections in Switzerland. Once you enter the casino you can see no expense was spared, watch the video below to see for yourself.

/Comment: Usually the smaller the casino, the more neglected it is. This is an exception./
