Legal status of digital casinos in Spain: legal since 2011, operators require a licence

 

Online casinos are legal in Spain since 2011. The main law affecting online casino gambling is the Spanish Gambling Act (Ley 13/2011, de 27 de mayo, de Regulación del Juego)1, which is the main piece of the gambling legislation.

Online gambling was legalized in 2006. However, initially, internet gambling was the monopoly of the state owned lottery companies Loterías y Apuestas del Estado and La ONCE, which operated online lottery and digital sports betting platforms. Private operators were not allowed onto the market, until 2011.

This violated EU gambling directives and free flow of services within the EEA (European Economic Area).

Only the Law on Measures to Develop the Information Society (Ley 56/2007, de 28 de diciembre, de Medidas de Impulso de la Sociedad de la Información)2 made it possible to develop a licensing system for private operators, but licenses were not issued prior to 2011 (and even then, they were only started to be issued due to the pressure from the EU).

Online casino gambling is regulated on a federal level in Spain, while brick & mortar casinos are regulated regionally, by the gambling authorities of the 17 individual regions and autonomous communities of Spain (you can see a list of these provincial gambling regulatory and licensing  agencies in the offline casinos section below, above the list of casinos).

Online casinos are regulated are by the Regulation of Gambling Activities (Direccion General de Ordenacion del Juego – DGOJ), which is a subdivision of the Ministry of Finance (detailed explanation can be seen below, in the Spain online casino licensing section).

Unlicensed gambling platforms are considered illegal according to the Spanish Gambling Act. Online casino operators that wish to offer their services within Spain need to apply for a gambling licence.

The Spanish government has made quite a bit of effort to prevent unlicensed online casinos from accepting players from Spain. Unlicensed online casinos may not advertise within the country, and such sites are blocked by ISPs (internet service providers)3.

/Comment: Spain actually started blocking these unlicensed offshore digital casino platforms prior to 2011, which was against EU laws. EU directives clearly state that if a country within the EEA does not offer gambling licenses to private operators, they can not block the unlicensed platforms if they are registered and licensed in other EU countries.

Such restriction would violate the free flow of services within the EEA and it would hard free competition within the Eurozone. Spain did block these unlicensed websites anyway, and there was significant amount of litigation behind the scenes because of this, for many years.

This pressure from the European Union is in fact a huge contributor to the 2011 legalization of online casinos and the liberalization of the the Spanish casino sector.

UPDATE 2022: A similar thing happened in Germany as well, which only recently legalized online casinos in 2021 for the same reasons./

Spain and EU gambling laws: Because Spain is an EU country Article 56 TFEU4 and Article 8 of Directive 98/34/EC (EU gambling directives) apply.

Unlicensed online casino operators, which accept Spanish players without a licence may face fines of up to €50m (comment: although the enforcement of such punishments is problematic, or downright impossible, outside of the European Economic Area). Players who place bets on unlicensed gambling websites by mistake are not prosecuted (as is common within Europe, other EU countries also do not prosecute players, only the operators).

Can tourists play online while visiting Spain?

Yes, tourists, expats (or illegal migrants) can play online freely while enjoying their stay in the country.

This is on top of regular taxes (e.g: corporate tax, which is 25%). Gambling is VAT exempt.

As you can see, the gambling tax rates are on the higher end in Spain (above average by European standards).

 

For the players, taxation of online casino gambling winnings in Spain:

Gambling winnings are taxable, you have to pay taxes on your winnings if6:

  • If your income from work or real estate exceeds € 22,000 in a year with a single payer, or € 12,000 with more than one payer, and the net benefits of your gambling bets are higher than € 1,000 in the given year.
  • If the net benefits of bets + other capital and property gains (e.g.: money from investments, dividends on shares) exceeds € 1,600 per year, you must pay taxes on it (regardless of your income from work or real estate income).

 

Net benefits of gambling bets = the amount you won – the amount you used to place bets, deposited online, put into the machine + bonus money, promotional money the gambling operator gave you.

The amount of tax you have to pay on your gambling winnings depends on your income:

/Fun fact: Casinos were actually first legalized in the Kingdom of Spain in the medieval ages, in 1276, with the Ordanimento de las tafurerias2 of Alfonso X de Castilla. Back then, they were called gambling houses, and they were mostly operated by the royal family.

However, casinos were subsequently banned and relegalized multiple times. They are only continuously legal since 1977./

Slot halls are also legal in Spain.

In fact, the casino sector is dominated by slot halls and electronic casinos.

/Clarification: The difference between real, bona fide casinos and slot halls is that slot parlours only have gaming machines and are usually smaller. Casino are usually bigger, and they have card games and live dealer tables as well. 

Electronic casinos are slot halls, which also have automated electronic table games (without dealers or croupiers). Electronic casino are usually bigger than slot halls, but smaller than the casinos./

There aren’t any actually big casinos in Spain (by international standards), despite the fact that Spain is the second most visited country in the world (126 million tourists per year, pre-coronavirus numbers3).

Yes, both locals and tourists can visit the casinos in Spain, unlike in some other countries (e.g.: in the entire muslim world casinos are only available to the tourists, locals can not enter).

 

Casino licensing and regulatory body of Spain:

Gambling in general is regulated and licensed by the General Directorate for the Regulation of Gambling Activities (“Direccion General de Ordenacion del Juego”, or DGOJ for short). You have to contact them if you wish to set up any sort of gambling business in Spain. Their website is available in English as well, although not everything is translated into English.

All online and terrestrial gambling operators need to obtain a general licence from them in order to operate any sort of gambling business in Spain.

However, as mentioned above, the 17 individual regions and autonomous communities all have their own licensing authorities, which are responsible for issuing licenses and overseeing licensed gambling establishments. Therefore, casinos and slot halls need to obtain a license from the region in which they operate as well.

Harm redution and problem gambling prevention in Madrid:

The number of gaming venues in the region have increased by 125% since 2014, there are 678 gambling establishments in Madrid currently.

Because of the high number of gaming venues Madrid temporarily suspended the licensing process between 2019 and 2020.

The minimum distance between gambling establishments must be 300 meters, and they can not be located within 100 meters from schools (existing premises are exempt, only applies to new venues, from 2020).

Taxation of brick & mortar gambling establishments in Spain:

The following are the casino gambling tax rates in Spain. Keep in mind that gambling taxation is dependent on the region in which the gambling business is located in, therefore the values below do not apply to all of the regions of Spain (but they apply to most of them, unless they have set their own gambling tax rates):

This is on top of regular taxes (e.g: corporate tax, which is 25%). Gambling is VAT exempt.

As you can see, the gambling tax rates are on the higher end in Spain (above average by European standards).

 

For the players, taxation of casino winnings in Spain:

Gambling winnings are taxable, you have to pay taxes on your winnings if:

  • If your income from work or real estate exceeds € 22,000 in a year with a single payer, or € 12,000 with more than one payer, and the net benefits of your gambling bets are higher than € 1,000 in the given year.
  • If the net benefits of bets + other capital and property gains (e.g.: money from investments, dividends on shares) exceeds € 1,600 per year, you must pay taxes on it (regardless of your income from work or real estate income).

 

Net benefits of gambling bets = the amount you won – the amount you used to place bets, deposited online, put into the machine + bonus money, promotional money the gambling operator gave you.

The amount of tax you have to pay on your gambling winnings depends on your income:

  •  € 12,450 or less: 19%
  • € 12,450 to € 20,200: 24%
  • € 20,200 to € 35,200: 30%
  • € 35,200 to € 60,000: 37%
  • € 60,000 or more: 45%

 

It’s not that easy to calculate it, it’s best to contact a certified personal accountant (CPA) to help you with your gambling taxation.

Casino Aranjuez is the biggest casino of the Comar group (Grupo Comar), one of the biggest casino group in Spain (they operate 9 casinos). What makes this casino special are the multiple showrooms/theater/concert halls within the complex, capable of seating hundreds, and they regularly host big names (in Spain) such as Sabel Pantoja, Raphael, David Bisbal and Miguel Bosé.

Marbella’s casino (in operations since 1978) is located within the hotel Andalucía Plaza, considered to be one of the best hotels in Spain.

Casino Marbella is a CIRSA casino (CIRSA is the oldest Spanish casino company, which operates 6 casinos in Spain, and over 150 mostly in South and Central America).

As the name would suggest this the main casino of the Marbella region of Spain

/Comment: In case you don’t know, Marbella is a very posh, upscale region of Spain, known as the playground of the rich, with upscale luxury establishments. It is infamous for being very expensive./

The casino has very little information about it online, despite its significance, and it is a small casino (by international standards, by Spanish standards this is a medium casino).

However, they do have a virtual tour on their website, which is a fantastic idea, gives you a good feel for the casino.

UPDATE: They also operate a croupier school, where they train new dealers and croupiers.

The Admiral Group has several casinos in Spain (they are the fourth largest casino company active in the country, with 3 casinos + 2 in Gibraltar). Admiral group is a subsidiary of Austrian gambling Novomatic (which was founded by billionaire Johann Graf).

The Sevilla venue is their flagship casino in Spain. This is also the only gambling venue in the region of Sevilla. The gaming venue is a recent addition to the Spanish gambling scene, in operation only since 2019.

The is not just a casino, it also acts as a convention centre, focusing on meetings, conferences, exhibitions.

Interestingly, their website is not available in English, which is very unexpected considering how much of a role tourists play in the casino sector.

They also have an interesting “pool club”. It a unique concept: bar+restaurant+pool+old arcade games + HD monitors with sport + online sports betting terminals. Goes by the name Admiral Arena, it’s kind of like an upgraded, rethought sports bar.

/Comment: Great idea, it’s finally something new and unique, something really interesting, not just the same old tables games + slots and restaurant, that every other casino has. I wish more casinos would innovate like this. Really great idea, more of this please./

Casino Costa Brava is CIRSA casino and as such everything mentioned at Casino Marbella (3rd casino on the list) about the company applies here as well.

Gran Casino Costa Brava is smaller casino (in terms of number of games). Interestingly it is the most reviewed casino in Spain, and it has over 2000 reviews (on multiple sites) online.

Bitcoin gambling is legal in Spain. It is one of the few countries, where the use of cryptocurrencies by gambling businesses was specifically addressed by the government.

First of all, a statement from the Spanish Treasury clarified the legal status of cryptocurrencies in general, they remarked that: “the bitcoin is an exchangeable virtual currency between users, and can be converted to Euros, US dollars and other currencies”, which acknowledges bitcoin as a currency in certain situations (the problem with this is that it only applies to bitcoin, not litecoin, ethereum, bitcoincash and the many other alternative digital currencies.

/Comment: Bitcoin income and revenue are also taxable in Spain. Therefore, if you win money gambling, and you get your winnings in bitcoins, you still have to pay taxes on them, as soon as you exchange the bitcoin to Euros and it arrives on your bank account./

In 2014 the Spanish Finance and Public Administration stated that all bitcoin gambling sites offering their services to the residents of the country are subject to the same rules as other online gambling operations, and therefore, they have to obtain the same licenses*.

This means that gambling businesses with a valid license can accept digital currencies and that the same requirements (i.e.: licensing requirement) apply to them. Despite this, cryptocurrencies are not mentioned by name in the gambling legislation.

Even though cryptocurrency usage is legal, none of the land-based casinos or slot halls in Spain seem to accept any virtual currencies (to the best of my knowledge, if you know of any casino in Spain, which accept bitcoin, litecoin, ethereum or any other crypt coin please let me know in the comments section).
