Legal status of digital casinos in Spain: legal since 2011, operators require a licence

Online casinos are legal in Spain since 2011. The main law affecting online casino gambling is the Spanish Gambling Act (Ley 13/2011, de 27 de mayo, de Regulación del Juego)1, which is the main piece of the gambling legislation.

Online gambling was legalized in 2006. However, initially, internet gambling was the monopoly of the state owned lottery companies Loterías y Apuestas del Estado and La ONCE, which operated online lottery and digital sports betting platforms. Private operators were not allowed onto the market, until 2011.

This violated EU gambling directives and free flow of services within the EEA (European Economic Area).

Only the Law on Measures to Develop the Information Society (Ley 56/2007, de 28 de diciembre, de Medidas de Impulso de la Sociedad de la Información)2 made it possible to develop a licensing system for private operators, but licenses were not issued prior to 2011 (and even then, they were only started to be issued due to the pressure from the EU).

Online casino gambling is regulated on a federal level in Spain, while brick & mortar casinos are regulated regionally, by the gambling authorities of the 17 individual regions and autonomous communities of Spain (you can see a list of these provincial gambling regulatory and licensing  agencies in the offline casinos section below, above the list of casinos).

Online casinos are regulated are by the Regulation of Gambling Activities (Direccion General de Ordenacion del Juego – DGOJ), which is a subdivision of the Ministry of Finance (detailed explanation can be seen below, in the Spain online casino licensing section).

Unlicensed gambling platforms are considered illegal according to the Spanish Gambling Act. Online casino operators that wish to offer their services within Spain need to apply for a gambling licence.

The Spanish government has made quite a bit of effort to prevent unlicensed online casinos from accepting players from Spain. Unlicensed online casinos may not advertise within the country, and such sites are blocked by ISPs (internet service providers)3.

/Comment: Spain actually started blocking these unlicensed offshore digital casino platforms prior to 2011, which was against EU laws. EU directives clearly state that if a country within the EEA does not offer gambling licenses to private operators, they can not block the unlicensed platforms if they are registered and licensed in other EU countries.

Such restriction would violate the free flow of services within the EEA and it would hard free competition within the Eurozone. Spain did block these unlicensed websites anyway, and there was significant amount of litigation behind the scenes because of this, for many years.

This pressure from the European Union is in fact a huge contributor to the 2011 legalization of online casinos and the liberalization of the the Spanish casino sector.

UPDATE 2022: A similar thing happened in Germany as well, which only recently legalized online casinos in 2021 for the same reasons./

Spain and EU gambling laws: Because Spain is an EU country Article 56 TFEU4 and Article 8 of Directive 98/34/EC (EU gambling directives) apply.

Unlicensed online casino operators, which accept Spanish players without a licence may face fines of up to €50m (comment: although the enforcement of such punishments is problematic, or downright impossible, outside of the European Economic Area). Players who place bets on unlicensed gambling websites by mistake are not prosecuted (as is common within Europe, other EU countries also do not prosecute players, only the operators).

By scrolling below you can find a list of online casinos, which accept Spanish players.

Can tourists play online while visiting Spain?

Yes, tourists, expats (or illegal migrants) can play online freely while enjoying their stay in the country.

Online casino licensing and regulatory body of Spain:

Gambling licenses are issued by the General Directorate for the Regulation of Gambling Activities (“Direccion General de Ordenacion del Juego”, or DGOJ for short). You have to contact them if you wish to set up an online casino business in Spain. Their website is available in English as well (although not everything is translated into English yet).

All online operators need to obtain a licence in order to offer their services on the Spanish market.

In order to conduct online gambling in Spain, companies first need to acquire a General Licence (valid for 10 years), than another Specific Licence (valid for 5 years) for the types of games they want to offer on their website. Currently, the following types of licenses are available:

  • bingo
  • blackjack
  • baccarat
  • poker
  • roulette
  • slots
  • fixed odds betting
  • fixed odds sports betting
  • sports pool betting
  • fixed-odds horse betting
  • horse pool betting
  • exchange betting

The licensing requirements are set by Royal Decree No. 1613/2011 November 14, which establishes the technical requirements for gaming activities5.

Licensing fees and requirements can be found on the website of DGOJ (although at the time of writing they were only available in Spanish).

Taxation of online casino sites in Spain:

The following are the online gambling tax rates in Spain:

Spain online gambling tax rates
Activity: Tax rate: Tax base:
general gambling tax (applies to all kinds of games of chance and online gambling, except for the types of gambling below) 20% gross gambling revenue
electronic bingo tax 30% gross gambling revenue
betting games 13% gross gambling revenue
sports betting, horse racing betting and other types of betting 10% gross gambling revenue
casino games
  • 22% if the gross gambling revenue less than EUR2 million.
  • 30% if the gross gambling revenue is from EUR2 million to EUR3 million.
  • 40% if the gross gambling revenue is from EUR3 million to EUR5 million.
  • 45% if the gross gambling revenue is more than EUR5 million.
gross gambling revenue
online gambling tax in the Madrid region 10% gross gambling revenue

This is on top of regular taxes (e.g: corporate tax, which is 25%). Gambling is VAT exempt.

As you can see, the gambling tax rates are on the higher end in Spain (above average by European standards).

For the players, taxation of online casino gambling winnings in Spain:

Gambling winnings are taxable, you have to pay taxes on your winnings if6:

  • If your income from work or real estate exceeds € 22,000 in a year with a single payer, or € 12,000 with more than one payer, and the net benefits of your gambling bets are higher than € 1,000 in the given year.
  • If the net benefits of bets + other capital and property gains (e.g.: money from investments, dividends on shares) exceeds € 1,600 per year, you must pay taxes on it (regardless of your income from work or real estate income).

Net benefits of gambling bets = the amount you won – the amount you used to place bets, deposited online, put into the machine + bonus money, promotional money the gambling operator gave you.

The amount of tax you have to pay on your gambling winnings depends on your income:

  •  € 12,450 or less: 19%
  • € 12,450 to € 20,200: 24%
  • € 20,200 to € 35,200: 30%
  • € 35,200 to € 60,000: 37%
  • € 60,000 or more: 45%

It’s not that easy to calculate it, it’s best to contact a certified personal accountant (CPA) to help you with your gambling taxation.

Land-based casinos in Spain

Legal status of casinos in Spain: legal since 1977, operators require a licence, slot halls are also legal

Casinos are legal in Spain since 1977, according to the Spanish Gambling Act (Ley 13/2011, de 27 de mayo, de Regulación del Juego)1, which replaced Royal Decree Law 16/1977 as the main piece of the casino gambling legislation.

/Fun fact: Casinos were actually first legalized in the Kingdom of Spain in the medieval ages, in 1276, with the Ordanimento de las tafurerias2 of Alfonso X de Castilla. Back then, they were called gambling houses, and they were mostly operated by the royal family.

However, casinos were subsequently banned and relegalized multiple times. They are only continuously legal since 1977./

Slot halls are also legal in Spain.

In fact, the casino sector is dominated by slot halls and electronic casinos.

/Clarification: The difference between real, bona fide casinos and slot halls is that slot parlours only have gaming machines and are usually smaller. Casino are usually bigger, and they have card games and live dealer tables as well.

Electronic casinos are slot halls, which also have automated electronic table games (without dealers or croupiers). Electronic casino are usually bigger than slot halls, but smaller than the casinos./

There aren’t any actually big casinos in Spain (by international standards), despite the fact that Spain is the second most visited country in the world (126 million tourists per year, pre-coronavirus numbers3).

This is mostly due to the fact that slot halls take away business from the casinos.

/Comment: In countries where slot halls are illegal, casinos are always significantly bigger, on average.

Slot halls are illegal in most European countries already, because it is a widely known fact in the gambling industry that they contribute significantly more to problem gambling and addiction than casinos./

Casinos in Spain are usually part of a large resort complex (or at the very least are attached to a hotel) and they also act as entrainment complexes (e.g.: some of them even have their own theaters), similarly to neighbouring Portugal.

The largest casino in Spain is the Casino Gran Madrid Torrelodones (detail, address, opening hours, number and types of games, video can be seen below in the Spain casino list).

The biggest casino group in Spain, in terms of number of casinos operated in Spain, is Grupo Comar, which owns 9 casinos, these are: Gran Vía Casino, Atlantic Casino, Casino Bahía De Cádiz, Casino Conde Luna, Gran Casino Melilla, Gran Casino Sardinero, Casino del Tormes, Casino Zaragoza, Gran Casino Aranjuez.

The biggest Spanish casino group, in terms of total number of casinos operated worldwide is CIRSA, which operates, at this point, 200+ casinos, mostly in South and Central America (they only operate 5 casinos in Spain).

Casinos are legal federally, on an national level, in all of Spain. However, they are regulated and licensed regionally, and all 17 autonomous regions and cities have their own casino laws and licensing processes (details can be seen in the casinos licensing section below).

The city with the most casinos in Spain is, unsurprisingly, the capital, Madrid. But all the popular tourist destinations (e.g.: Alicante, Palma de Mallorca, Ibiza, Marbella feature multiple casinos and slot halls).

You can find all the currently operating brick and mortar casinos in the list below.

Can locals visit the casinos in Spain?

Yes, both locals and tourists can visit the casinos in Spain, unlike in some other countries (e.g.: in the entire muslim world casinos are only available to the tourists, locals can not enter).

Casino licensing and regulatory body of Spain:

Gambling in general is regulated and licensed by the General Directorate for the Regulation of Gambling Activities (“Direccion General de Ordenacion del Juego”, or DGOJ for short). You have to contact them if you wish to set up any sort of gambling business in Spain. Their website is available in English as well, although not everything is translated into English.

All online and terrestrial gambling operators need to obtain a general licence from them in order to operate any sort of gambling business in Spain.

However, as mentioned above, the 17 individual regions and autonomous communities all have their own licensing authorities, which are responsible for issuing licenses and overseeing licensed gambling establishments. Therefore, casinos and slot halls need to obtain a license from the region in which they operate as well.

The regulatory bodies of the 17 individual regions and autonomous communities are the following:

Free advertisement for licensed local lawyers, law firms from this country

Get featured on this website, here, just right under the taxation section. Advertise your services, get a link to your own website, or the law firm's website you work for, on a page that is visited by businessmen, company representatives looking for help with: setting up a gambling business, licensing, setting up a company, help with an existing gambling business, consulting etc....
And all this for free. Click on the drop down section if you are interested and want to get listed.

How to get featured

In order to get the free placement you must have a website (social media profile is not enough). Here is what you have to do:
  • send me a link to your website, or your employer's website
  • send me 1-2 sentences about you and/or your business etc.., something that describes the business, what you do, something that makes potential clients interested
  • send me one single picture of your company's logo, or a picture of your office, or one of your certificates, credentials which you are proud of etc... (but don't send a picture of yourself, for legal reasons I want to avoid uploading pictures of people)

The picture must be 150x150 pixels.
Contact me through the live chat, it's in the bottom right corner of the website, or in the comments section at the bottom of this page, with a link to the website you wish to advertise. If you qualify, I will give you my email address where we can discuss everything (I won't be putting my email address on the page, due to the extreme amount of spam I receive as it is).
In exchange: In order to appear for free on this website, you have to link back to this guide, from your website. It must be your website, your employer's website, a law blog or something similar. The link doesn't have to be in a prominent position, or on the homepage. It can be placed at the bottom of an unimportant page, where people don't see it, that's fine with me. And 1 sentence is enough, something like this: "We are featured on Simon's Gambling and Casino Blog, at <link here>."
That's all, if you are interested, get in touch. Looking forward to hearing from you.

Taxation of brick & mortar gambling establishments in Spain:

The following are the casino gambling tax rates in Spain. Keep in mind that gambling taxation is dependent on the region in which the gambling business is located in, therefore the values below do not apply to all of the regions of Spain (but they apply to most of them, unless they have set their own gambling tax rates):

Spain gambling tax rates
Activity: Tax rate: Tax base:
general gambling tax (if it is not considered a casino game this is the tax rate applicable most likely) 20% gross gambling revenue
sports betting, horse racing betting and other types of betting (payable by sports betting terminals in casinos) 10% gross gambling revenue
casino games (includes gaming machines as well)
  • 22% if the gross gambling revenue less than EUR2 million.
  • 30% if the gross gambling revenue is from EUR2 million to EUR3 million.
  • 40% if the gross gambling revenue is from EUR3 million to EUR5 million.
  • 45% if the gross gambling revenue is more than EUR5 million.
gross gambling revenue

This is on top of regular taxes (e.g: corporate tax, which is 25%). Gambling is VAT exempt.

As you can see, the gambling tax rates are on the higher end in Spain (above average by European standards).

For the players, taxation of casino winnings in Spain:

Gambling winnings are taxable, you have to pay taxes on your winnings if:

Gran Casino Aranjuez

Gran Casino Aranjuez, address: Plaza de la Unesco, 1 Aranjuez (Madrid) A4 salida 37

Casino Aranjuez is the biggest casino of the Comar group (Grupo Comar), one of the biggest casino group in Spain (they operate 9 casinos). What makes this casino special are the multiple showrooms/theater/concert halls within the complex, capable of seating hundreds, and they regularly host big names (in Spain) such as Sabel Pantoja, Raphael, David Bisbal and Miguel Bosé.

  • Gran Vía Casino
  • Atlantic Casino
  • Bay of Cadiz Casino
  • Casino Conde Luna
  • Gran Casino Melilla
  • Gran Casino Sardinero
  • Casino del Tormes
  • Casino Zaragoza

Tourists are very important to any casino in Spain, that’s why it’s hard to understand why this casino only has a Spanish website. I honestly have no idea how tourists get information about the casino, if they don’t speak Spanish (and most casino directory, listing websites are very outdated).

Games: around 150 gaming machines (slots, video poker, older machines, their slots selection is not very good), and around 20 tables ( various forms of poker, blackjack, baccarat, American Roulette) + electronic roulette machines

They also have a big poker room with around 30+ poker tables. You can find info about cash games and the online tournament schedule here (Spanish only). It is probably the biggest poker room in all of Span.

/Comment: Although sadly, the official website of the casino does not publish and concrete numbers or data about the poker room so I can’t be certain./

They have a sports betting section as well.

Casino Marbella

Casino Marbella, address: Hotel H10 Andalucia Plaza, s/n 29660, Marbella, Puerto Banús

Marbella’s casino (in operations since 1978) is located within the hotel Andalucía Plaza, considered to be one of the best hotels in Spain.

Casino Marbella is a CIRSA casino (CIRSA is the oldest Spanish casino company, which operates 6 casinos in Spain, and over 150 mostly in South and Central America).

As the name would suggest this the main casino of the Marbella region of Spain

/Comment: In case you don!t know, Marbella is a very posh, upscale region of Spain, known for its rich tourists, upscale, luxury establishments, and infamous for being very expensive./

The casino has very little information about it online, despite its significance, and it is a small casino (by international standards, by Spanish standards this is a medium casino).

However, they do have a virtual tour on their website, which is a fantastic idea, gives you a good feel for the casino.

UPDATE: They also operate a croupier school, where they train new dealers and croupiers.

The other 4 CIRSA casino in Spain are:

  • Casino Lloret
  • Casino Valencia

They have a sports betting section as well (although there is no info about it on their website, if you know if it’s still in operation please leave a comment).

*Caribbean poker explanation, how to play, video tutorial:  Caribbean stud poker is a variant of 5 Card Poker with same rules (usually, depends on the casino). However, unlike the non-banking 5 Card Poker, Caribbean stud is played against the house rather than against other players (a.k.a. it’s a banking poker game).

If you wat to learn how to play Caribbean Stud Poker watch the following video tutorial:

4., Casino Admiral Sevilla
This is a picture of the decorated front gate of Casino Admiral Sevilla, located, as the name suggest, in Sevilla, Spain. This is the fourth casino on this list of the best rated Spanish gambling venues. You can read more about this establishment to the right of the picture, and you can watch a video depicting the casino below.

Casino Admiral Sevilla

Casino Admiral Sevilla, address: Av. de la Arboleda, s/n, 41940 Tomares, Sevilla

The Admiral Group has several casinos in Spain (they are the fourth largest casino company active in the country, with 3 casinos + 2 in Gibraltar). Admiral group is a subsidiary of Austrian gambling Novomatic (which was founded by billionaire Johann Graf).

The Sevilla venue is their flagship casino in Spain. This is also the only gambling venue in the region of Sevilla. The gaming venue is a recent addition to the Spanish gambling scene, in operation only since 2019.

The is not just a casino, it also acts as a convention centre, focusing on meetings, conferences, exhibitions.

Interestingly, their website is not available in English, which is very unexpected considering how much of a role tourists play in the casino sector.

They also have an interesting “pool club”. It a unique concept: bar+restaurant+pool+old arcade games + HD monitors with sport + online sports betting terminals. Goes by the name Admiral Arena, it’s kind of like an upgraded, rethought sports bar.

/Comment: Great idea, it’s finally something new and unique, something really interesting, not just the same old tables games + slots and restaurant, that every other casino has. I wish more casinos would innovate like this. Really great idea, more of this please./

And you can watch a video of the Admiral Arena sports bar 2.0 here:

Games: around 110 gaming machines (slots, video poker, mostly 5-10 years old slots, fairly recent, average selection), and around 25 tables (Caribbean Poker, blackjack, baccarat, American Roulette) + electronic roulette machines and electronic keno

Bitcoin casinos Spain

Legal status: legal, operators require a licence

Bitcoin gambling is legal in Spain. It is one of the few countries, where the use of cryptocurrencies by gambling businesses was specifically addressed by the government.

First of all, a statement from the Spanish Treasury clarified the legal status of cryptocurrencies in general, they remarked that: “the bitcoin is an exchangeable virtual currency between users, and can be converted to Euros, US dollars and other currencies”, which acknowledges bitcoin as a currency in certain situations (the problem with this is that it only applies to bitcoin, not litecoin, ethereum, bitcoincash and the many other alternative digital currencies.

/Comment: Bitcoin income and revenue are also taxable in Spain. Therefore, if you win money gambling, and you get your winnings in bitcoins, you still have to pay taxes on them, as soon as you exchange the bitcoin to Euros and it arrives on your bank account./

In 2014 the Spanish Finance and Public Administration stated that all bitcoin gambling sites offering their services to the residents of the country are subject to the same rules as other online gambling operations, and therefore, they have to obtain the same licenses*.

This means that gambling businesses with a valid license can accept digital currencies and that the same requirements (i.e.: licensing requirement) apply to them. Despite this, cryptocurrencies are not mentioned by name in the gambling legislation.

Even though cryptocurrency usage is legal, none of the land-based casinos or slot halls in Spain seem to accept any virtual currencies (to the best of my knowledge, if you know of any casino in Spain, which accept bitcoin, litecoin, ethereum or any other crypt coin please let me know in the comments section).

Additionally, none of the online platforms of the state-owned lottery monopoly accept any virtual currency.

However, some of the digitalcasinos, which have a Spanish online gambling licence accept bitcoin, litecoin, ethereum and one of them even accepts ripple. You can see these casino websites below.

Other forms of online gambling in Spain

Most forms of online gambling are actually legal in Spain. Online gambling is regulated, on a national level, by the same 2011 Spanish Gambling Act, which regulates online casinos. Since the legalisation of online gambling, more than a 100 operators have received a licence, and most of the bigger unlicensed offshore gambling websites have been banned.

The most popular form of online gambling in Spain is sports betting, especially betting on football (for US visitors: betting on European football, soccer), which has accounted for about half of all online gambling tax revenues since 2013 (but nowadays only accounts for about 30%, on the decline since 2011). Spain is one of the few countries, where online sports betting revenue exceeds the revenue from the online lottery segment.

The gaming act recognises several types of sports betting, including fixed-odds and pari-mutuel betting, bot of which can also be conducted online by licensed sportsbooks. Wagering on horse races is also possible over the internet, and unlike in most countries, it not the monopoly of the state.

Online poker is also legal in Spain, and requires its own specific licence.  Poekr is codiereda casino game.

There were about 10 licensed online poker operators in Spain. However, most of the larger operators, such as Poker Stars left the market due to the high taxes (UPDATE: Poker Stars has re-entered the Spanish gambling market, they accept players from the country once again, there are rumors that they have been granted a lower special tax rate, although, details are not public, if you know the details please leave a comment).

Online lottery is also legal, it is a duopoly of state owned La Sociedad Estatal Loterías y Apuestas del Estado and La ONCE. The Spanish state owned lottery companies also offers all of their games online, and they have online sports betting sections as well on their digital paltforms.

If you have questions or any feedback don’t hesitate to drop a comment below. Please let me know in the comments section if you think we might have gotten something wrong or if you have additional information, clarification about the casinos in the country. Thank you for visiting:
This is a selfie of the author and owner of Simon's Casino Gambling Blog, me, Simon András Péter, a.k.a. by the internet pseudonym SimonTheSorcerer, owner of Simon's Online Marketing Kft. This is the homepage of my online casino gambling blog, you can see what's on the website, the links to all the different sections of the website.

That's me, Simon, thank you for visiting.

Don't worry, this is not an ad! ;) Just wanted to make sure to tell you that I'm glad you visited this gambling blog. I'm Simon, the only author and the man behind this blog (if you are interested, my unusual life story can be found on the homepage, under the "About me" dropdown section).
I'm an independent gambling blogger since 2012. In this sector dominated by huge media companies, casino operators and online marketing networks, who can easily spend $ millions on their online gambling blogs, it's not easy for an independent nobody like me to survive. It took me about 6 years, working my ass off, to even have a chance to be noticed by visitors like you. I'm lucky enough that for a few years now, I make enough money to be able to do this full time (before that, I had part-time jobs, ghost writing gigs, online marketing this and that).
Now I can finally do this full time, thanks to visitors like you! And it means a lot! If you are interested, please bookmark this site (no social media profiles, I no longer have any, but please feel free to share anything on any social media networks, if you still use them). I don't have any money to advertise, and if you have a personal blog, any social media profile, please mention my gambling blog and link back to it. This the only way for a small website like this to grow. Thank you!

Logo of Kiva.org. You can read about my non-profit activity right next to the picture.
Charity: As a way to help others, to give back, I sometimes donate to Kiva. If you click on the ads on the website, I make some money. And in a good month, if I make more than my expenses, I donate to people and projects on Kiva.
Kiva helps young entrepreneurs in developing countries, which is an issue close to my heart for obvious reasons. If you have the means, please sign up with the revolutionary non-profit company Kiva.org and help people lift themselves out of poverty, through hard-work, and an initial investment (non-profit loan). These non-profit loans encourage entrepreneurship and hard work instead of creating a dependent class that is afraid to get a job, or start a business (because if they did, they would no longer get support and free money, disincentivezing hard work and entrepreneurship). This is the right way to fight poverty in developing countries (or anywhere else really), and if this is something you are interested in, and if you would like to know more, or to help out, please check out Kiva.org here. Thank you!
By being on this site, you agree to terms and conditions, and privacy policy. You must be at least 18, and if you are a gambling addict, or a citizen of Hungary, please leave the site.
