Summary: Gambling is legal in Slovenia since 1991 (officially the Republic of Slovenia, a poorer Central European country, independent since 1991, a member of the EU, has a population of 2.1 million).

Slovenia is only independent since 1991 (since the dissolution of Yugoslavia).
In order to fully understand the history of gambling in the country, we have to look at what happened prior to the country’s independence, and it is best to divide that history into two chapters:
1., History prior to independence when Slovenia was still part of Yugoslavia (along with Montenegro, Bosnia and Herzegovina, Croatia, Macedonia, Montenegro, Kosovo and Slovenia):
1913 – Gambling on the territory of modern day Slovenia predates even the formation of Yugoslavia. The first written record of gambling is from 1913, when Slovenia was still a part of the Austria-Hungary. This year marked the opening of Grand Casino Portorož, the oldest (still in operation) casino of Slovenia.
Portorož back then was the most important resort town of the Austro-Hungarian monarchy, much beloved by the nobility and 1% of the era.

1965 – The Yugoslavian Gaming Act was introduced, the official reasoning was that they legalized gambling to help with the rebuilding of the country after World War II..
1972 – The Penthouse Adriatic Club opened this year in Yugoslavia, the project cost $45 million, and it was the biggest casino of Slovenia back then. This casino, hotel, resort complex was owned by Robert Charles Joseph Edward Sabatini Guccione the American founder and publisher of Penthouse magazine.
Officially there were no casinos in Yugoslavia, but “pavilions for games of chance” were allowed as long they focused primarily on tourists and foreigners (most of these venues only allowed foreigners to play).
By 1972 the number of casinos in Yugoslavia reached 28, but only 3 of them were located on the territory of Slovenia1. And even though Yugoslavia was a communist country, only 4 of these casinos were state-owned.
2., Gambling after the disunion of Yugoslavia:
1991 – This year marked Slovenia’s independence. Gambling is legal since the country’s inception. Existing casinos are allowed to continue to operate.
1995 – Casinos are officially legalized in Slovenia with the Slovenian Gaming Act (remember, in Yugoslavia casinos were not officially legalized), and the ban on locals entering gambling venues was abolished too.
Initially, casinos could only be established in the more important tourist towns (had to have one thousand tourist beds and at least two hundred thousand overnight stays by foreign tourists per year2, later the requirements were lowered, to allow cities near the Italian border, e.g.: Nova Gorica, to fully take advantage of the influx of Italian tourists.
2012 – The gambling laws of Slovenia get overhauled by Zakon o igrah na sreč, which is still the main piece of the gambling legislation even today (details below)
2022 – Online gambling is expected to be finally fully legalized and regulated (the last country in the EU to do so).
Gambling is legal in Slovenia since the country’s independence from Yugoslavia in 1991, the main piece of the gambling legislation is the 2012 Law on Gambling (Zakon o igrah na srečo)3 and its amendments.
Fun fact: Interestingly, back in the days of Yugoslavia, casinos were built for the tourists, you could only enter with a foreign passport. Locals were forbidden to enter most venues, because the activity was deemed “irreconcilable with the socialist values”. This is interesting because nowadays the casino sector is still very dependent on tourists.
The Italian tourists are the main driving force of the contemporary Slovenian casino sector, and casinos still primarily cater to tourists and not the locals (of course locals can enter the casinos nowadays).
Casinos are legal and regulated in Slovenia since 1995, and they account for a large portion of the state’s revenues from tourism and gambling.
Some forms of online gambling are legal in Slovenia but it is still considered underregulated and not liberalized, which makes Slovenia the last European country that still hasn’t properly regulated online gambling.
Currently, the only legal forms of online gambling in Slovenia are: the online lottery, which is a monopoly of the Slovenian National Lottery (owned by non-profit organizations and the government), online bingo, and online sports betting, which are a monopoly of Sportna Loterija (a subsidiary of the national lottery).
UPDATE: Online casinos are legal too since 2016, the only licensed Slovenian online casino is operated by Casino Portorož d.d. (details and source can be found in the Slovenia casino gambling section below). Additional private companies can not acquire online gambling licences currently.
The current online gambling legislation of Slovenia is not EU compliant and there is considerable litigation because of this behind the scenes. The EU exerts heavy political pressure on the country to change its online gambling laws.
Because of this pressure the country is in the process of creating and accepting the New Gaming Act since 2014, which would make online gambling expressly legal and allow private operators to obtain a licence in the country.
However, Slovenian players can freely play online on foreign online gambling websites, and they are not prosecuted or fined.
Slovenia and the EU gambling laws: Because Slovenia is an EU country Article 56 TFEU4 and Article 8 of Directive 98/34/EC (EU gambling directives) apply.
UPDATE 2022: The new Slovenian Draft Gambling Act is pending approval in the parliament since 2021. If passed, this will finally liberalize the online gambling sector of Slovenia. This new overhaul of the legal framework will make the country’s gambling legislation finally EU compliant.
The New Gaming Act will also impose fines and ISP (internet service providers) bans on sites that conduct games of chance over the internet without a licence. Actually, Slovenia already blocks many of the biggest unlicensed offshore internet wagering platforms, even though this is against EU laws.
/Comment: Article 56 TFEU prohibits restrictions on the freedom to provide services within the EEA, there was litigation because of this behind the scenes, for years, but they do it anyway5.

Can tourists play online from Slovenia?
Yes, the laws discussed on this webpage only apply to Slovenian citizens, and does not apply to tourists. Tourists (expats, non-citizens, illegal migrants) can play online freely. Slovenia gambling licenses
Gambling licenses are issued by the Financial Administration of the Republic of Slovenia. You have to contact them if you wish to set up any sort of gambling operations in Slovenia. Their website is available in English as well.
The number of casino licenses is capped at 15, and the number of slot halls is capped at 45.
The law makes a difference between casinos and slot halls, casino gambling is called “special gambling”, while slots belong to the category “classic, regular gambling” (this categorization is the same in all of the post-Yugoslavian countries, a legacy of the original Yugoslavian gambling legislation).
UPDATE: The number of available licenses is increased almost yearly, e.g.: in 2013 the maximum number of slot halls was 30, right now is 45, at the time of writing, there are no free casino or slot hall concession slots left. And until the government of the Republic of Slovenia increases the limit once more, it’s not possible to get a licence for a casino or a slot hall.

Slovenia gambling tax
The following are the gambling tax rates in Slovenia6:

Slot halls are legal too, and their number is capped at 50. The maximum number of slot halls has also been reached, although they raise the limit almost yearly.
UPDATE: Online casinos are legal in Slovenia since 2016, although just barely, only Casino Portorož d.d. (the oldest casino operator of Slovenia, in operations since 1913) got a special licence*, other private companies can not even apply at this point. This make online casino gambling a monopoly of Casino Portorož, at least for now.
Slovenia is the last EU country where digital casinos are not yet properly addressed by the gambling legislation, there is no licensing system in place and the digital casino sector is not liberalized.
This sort of cronyism and monopoly situation is 100% against the EU directives and severely violates free flow of services within the European Economic Area (EEA).

The proposed New Gambling Act is meant to rectify this in the near future (although they have been promising this since 2014, they seem to work slow). However, for now, Slovenian players can freely place bets in foreign online casinos, and in the online casino of Casino Portorož in the meantime.
