Not much information is available of the gambling sector of the island prior to 2005. However, due to the sizeable transient population of the islands, the low level of education of the residents, poverty, general disregard of the law and lack of work opportunities, it is very likely that illegal gambling dens were commonplace.

However, nowadays gambling has a much better image, and it is associated with the casinos of the bigger hotels, which operate perfectly legally and pay considerable taxes.

The gambling act of Sao Tome established a legal framework for licensing, taxing, controlling and overseeing the casino industry on the islands (the primary purpose of the legalization was to make it possible for hotels to open casinos) .

According to the legislation, casino licenses can only be obtained through public tenders.

The tax rate can vary in accordance with the conditions laid down in the tender, but it is set to a minimum of 20% on gross gaming profits*.

Online gambling is technically illegal in Sao Tome. Although it is barely regulated and this ban is not enforced.

Internet gambling is barely mentioned in the São Toméan legislation, the regulation only states that a casino with a land-based casino licence shall not operate an online gambling platform with the same licence.
