Legal status of digital casinos in Poland: illegal, players playing in unlicensed online casinos can be prosecuted
Online casino gambling is currently illegal in Poland, but since 2016 there are talks of legalizing it (UPDATE 2021: nothing so far)1.
Unlicensed online casinos are blocked by the ISPs (Internet Service Providers) since 2017 and financial transactions to and from unlicensed gambling websites are blocked.
Some online gambling websites circumvent the ban on online casinos by getting a Polish sports betting license (details below in the Polish gambling licensing section), which is legal and available. But these websites also have online casino games on their websites as well, which Polish players can still use (you can see these websites below).
/Comment: It’s not actually 1000% clear how this actually works from a legal point of view (probably special agreement with the government, if you know more please drop a comment, obviously these things are all hush-hush, under the carpet kind of deals, but would love to know more). They also utilize intermediary companies, which report the earned revenue as bets on sports instead of the reality, and there are also “tricky” payment processors involved.
And as long as these websites pay taxes on this, and they do, the government seem to turn a blind eye to this small bending of the rules, which I’m personally very much okay with (you can see these websites below)./
However, using unlicensed online gambling websites is illegal, and players do sometimes get punished since 20142 if they win bigger amounts and don’t pay taxes on them (yes gambling winnings are taxable in Poland, see the online casino winnings taxation section below).
Additionally, Polish banks officially should block financial transactions to and from unlicensed offshore online casinos. However, in reality this doesn’t really happen (similarly to Norway btw.)3 and offshore gambling companies able to circumvent this using offshore bank accounts and payment processors.
There is no separate, specific standalone online casino gambling act in Poland, it is regulated by the same gambling act, which regulates brick & mortar casino (you can see this in the next section above the list of the Polish casinos).
Poland and the EU gambling laws: Because Poland is an EU country Article 56 TFEU4 and Article 8 of Directive 98/34/EC (EU gambling directives) apply.
According to these the current Polish online gambling legislation is not compliant with EU laws.
EU authorities expressed concerns about the current legislation that does not guarantee the free flow of products and services between member states in the European Economic Area.
To address some of these concerns, another amendment to the Act on Gambling Games was signed into law in 2016. The amendment allows gambling companies from other EU member states to set up gaming operations in Poland, provided they have a physical branch and a Polish speaking representative in the country. Although, this only applies to online betting companies, EU online casino companies still can not not get a licence.
According to these EU laws Poland could not restrict or fine players for playing in unlicensed online casinos, which are licensed in other EU countries, and the country should not restrict access to these websites, because that would restrict the free flow of services and competition within the EEA. It happens regardless and there is a lot of litigation because of this behind the scenes.
Polish authorities did not block unlicensed websites prior to 2017, since then, many of the unlicensed online gambling websites are blocked, even though this contravenes EU laws. And additionally, financial institutions have started blocking transactions to and from unlicensed gambling websites as well (although reportedly this does not really work, offshore operators easily bypass these measures by using payment processors and proxy offshore bank accounts).

Legal status of casinos in Poland: legal since 1918, operators require a licence, slot halls are also legal
Land-based casinos are legal in Poland since 1918.
The first casino in the country opened in 1918, predating the Soviet regime. But casinos were made illegal once more in 1945, when Poland was forced to be a part of the Soviet Union, and were only made legal once again in 1989.
The first casino in the country was the one located within the Grand Hotel Sopot (you can see it below, in the list, it’s the second one).
The 2009 Act on Gambling Games1 is the main piece of the gambling legislation currently, and it regulates casinos, among other things.
There are very strict regulations in place regarding casinos. Among other things, there is a strict cap on the number and types of games they can have available, e.g.: a cap of 70, on the number of gaming machines. This is the reason why you don’t see big casinos in Poland.
Slot machines outside of casinos in pubs, slot halls and electronic casinos were made illegal.
UPDATE: However, Totalizator Sportowy Sp. z o.o. (the state-owned lottery company) received a monopoly in 2018 on slot halls.
/Comment: After the government banned all private operators, they realized they actually miss the tax revenue, so they swooped in and created a state owned monopoly…
Obviously, this garnered the ire of competing private operators and many took the Polish government to court; EU courts. Some of these legal proceedings are still ongoing, but it’s doubtful they will change much.
Nevertheless, it’s a good thing, this a clear violation of the free market within the EEA, regardless of what the politically motivated verdicts of the courts will be./
There are 50+ slot halls in Poland currently, and their number is growing fast. And there are around 15 bona fide casinos in the country (all of them small by international standards).
At the moment, the biggest casino operator present in the country is Century Casinos through a subsidiary (which goes by the name Casinos Poland Sp z o. o., formerly Orbis, and Casinos Poland CP, and various subsidiaries or joint ventures with other companies). They operate 8 out of the 15 casinos currently in operation, and admittedly all the better and bigger casinos are operated by them.
/Comment: No wonder, Century Casino was created by former employees of Casinos Austria with connections to the 1%, you can’t compete with that sort of money.
No wonder the Polish government created a monopoly when it comes to slot halls, if there was real free market the 1% would buy up and own everting (which is what they want). Just to put the decision of the Polish government into context, this the other side of the coin./
Olympic Casino Group used to be present in the Polish casino sector as well, but they left the market in 2016.
This was most likely the result of the restricting slot machines to casinos, because the main profile of Olympic casinos is actually the operation of so called “electronic casinos” (slots + electronic tables, no live dealers, no card games, not real casinos), which are a subtype of slot halls, which is a monopoly of the state owned gambling monopoly.

The biggest casino in all of Poland currently is the Mariott Hotel & Casino in the capital of Poland. Located in the Marriot Hotel tower (40 floors, typical modern, nowadays very fashionable skyscraper, looks very out of place in Poland, doe not fit the city IMO).
This is the flagship casino of Casinos Poland Sp z o. o. (a subsidiary of Century Casinos), which operates 8 casinos in Poland, making it the biggest casino operator. This is one of the three casinos in Warsaw, the capital in Poland.
Even though they operate the best and biggest casino of Poland, I have mixed feelings about this company and certain practices of theirs, you can read more about this at Casino Lodz, the third casino on this list.
Despite the importance, and despite this being the biggest and best rated casinos in all of Poland it has no official online presence whatsoever (and the website of Marriot doesn’t even mention the casino). Which I assume is very incontinent for the many tourists visiting.

Grand Hotel Sopot and Cristal Casino (a.k.a. Sofitel Grand Sopot), address: Powstancow Warszawy St 12/14, 81-718 Sopot
This magnificent 5 star hotel has a very small casino, which is called Cristal Casino Sopot (used to be called Orbis Casino).
Even though the casino itself is small, the building, and the location is magnificent and gorgeous. It’s also the oldest casino in Poland, originally opened in 1920 (and was closed during the Soviet occupation, only reopened in 1989 with a special permission as part of an effort to bring some life into the failing Soviet economy).
That is why Sofitel Grand Sopot’s casino gets second place, despite the size.
The website of Sofitel doesn’t mention the casino at all, and the casino doesn’t have any website (which is sadly very common among Polish casinos). Therefore, I had to scrape together the info you can find here from secondary sources (many of which are outdated sadly). If they are not accurate please let me know in the comments section, thank you.
The small Cristal Casino only has 25 gaming machines, 10 live dealer tables – 4 tables of american roulette (, which is always a bad sign in a European casino, has worse odds than the European roulette and does not fit the location, tells you that the casino wants you to lose as much as possible, and as fast as possible, dead giveaway, bad optics), 2 tables of blackjack, 2 stud poker tables. No poker room. Dress code is not mentioned anywhere online, but considering the clientele and that it is located in a 5 stars hotel I would say semi-formal, no mention of any entrance fee, 18+, bring ID and if you are a tourist, a passport too. There are actually 3 casinos in the city of Łódź. This is the biggest, the so called Manufaktura casino (open since 2012), located within the Manufaktura Shopping Center (which used to be a huge textile factory, but since the entire textile industry has been outsourced to China and India).

The casino is reportedly on the smaller side, around 400 m2.

Casino Warsaw in the Hilton Hotel, address: Grzybowska 63, 00-844 Warszawa (used to be called Olympic Casino Sunrise, but Olympic Casinos left the Polish market, it was acquired by Casinos Poland, a subsidiary of Century Casinos Inc.)
One of the 3 casinos of Warsaw, located in Warsaw’s biggest Hilton hotel (the capital has 6 Hilton hotels). Sadly, despite the really great location, the casino is only the second biggest (around 1800 m2) and it has no online presence whatsoever. Even though, because of the location, it is frequented by many tourists, many of whom don’t speak Polish.
