Summary: Gambling is legal in Mozambique since 1994 (officially the Republic of Mozambique, a former Portuguese colony, one of the poorest countries in the world, has a population of 30 million, a majority Christian country, a young country, only independent since 1975).

1975: Independence from Portugal. However, Portuguese gambling laws were not adopted and games of chance were not legalized until 1994.

1994: Gambling is officially legalized in Mozambique with the passing of the 1994 Gambling Act. This put many restrictions of land-based gambling venues and did not regulate online gambling (which was technically illegal at that time).

The state-owned Mozambique national lottery (Empresa de Lotarías e Apostas Mutuas de Mozambique) was also established in 1994.

2010: The gambling legislation was overhauled with the passing of Decree 64/2010, this decree officially legalized online gambling as well.

2017: The Mozambican gambling legislation was overhauled with the passing of the 2017 Gaming and Gambling Law. This completely modernized the gambling laws of Mozambique. Many restrictions were lifted.

Gambling is legal in Mozambique since 1994, according to the 1994 Gambling Act (officially: Lei n.° 8/94, de 14 de Setembro, fixou o quadro legal básico e orientador para o exercício das actividades de exploração de jogos de fortuna ou azar, na República de Moçambique)1.

However, the current main piece of the gambling legislation is the 2017 Gaming and Gambling Law – Decreto n.º 4/20177, which superseded Decree 64/2010 of 31 December2,3.

The 2017 is the third complete overhaul of the Mozambican gambling legislation and the most liberal and pro-business one to date.

/Comment: The 2010 gambling legislation already lifted some of the restrictions, the 2017 only continued this trend of business friendly policy making./

The 2010 and 2017 gambling legislation overhauls lifted the following restriction previously affecting the Mozambiquan gambling venues:

  • casinos had to be attached to 250-room hotels, casinos now have to be attached to 4+ star hotels now, and their size doesn’t matter;
  • minimum investment required was $15 million, this was lowered to $8 million (even lower for slot halls and in certain geographical regions outside of the capital, Maputo);
  • only casinos were allowed, slot halls could not be operated, slot machines can now be operated with a licence, casino licence is not required, slot halls are not required to be attached to hotels;
  • casinos were not permitted on the offshore islands of Mozambique, now casinos and slot halls can be found on the islands as well.

The main reason why these restrictions were lifted was to try to attract investment to the hospitality and tourism sector of Mozambique.

UPDATE 2022: However, despite these efforts the tourism and hospitality sector of the country contracted severely due to the global pandemic, which led to casino hotel closures (details can be found in the Mozambique casino gambling section below).

 

Online gambling is also legal since 2010, legalized by the 2010 gambling legislation, Decree 64/20106.

Only licensed gambling companies with a Mozambique gambling licence can accept payers from the country, and it is illegal to place bets on unlicensed websites.

Foreign online gambling operators can also acquire an online gambling licence. However they must set up a Mozambican subsidiary to get a licence (more information about the Mozambique online gambling licensing system can be found below).

Very few international gambling companies were so far willing to invest in such a poor African country, therefore there are not many licensed online gambling websites available to Mozambiquan players (you can see a list of gambling websites, which accept players from Mozambique below).

Gambling licences in Mozambique are issued by the Mozambican General Gaming Inspectorate (Inspecção-Geral de Jogos), which is part of the Ministry of Economy and Finance. You have to contact them if you wish to set up a gambling business in Mozambique.

The Mozambique Gambling Board does not have a website sadly, and the website of the Ministry of Economy and Finance is only available in Portuguese.

Because of these issues we can not provide any information about the process, fees and requirements of the Mozambican gambling licenses.

The gambling tax in Mozambique is called the “special tax on gambling”.

There is no set universal tax rate in Mozambique, the tax rate payable by a gambling business is determined by the gambling licence (a.k.a. the concession agreement), according to PricewaterhouseCoopers5.
