Summary: Gambling is legal in Madagascar since 1971 (officially the Republic of Madagascar, previously known as the Malagasy Republic, a Christian island country in Southeast Africa, a former French colony, with a population of 28.4 million, the 5th poorest country in the world).

1971: Gambling was legalized in Madagascar with the passing of Law number 71-011.

1994: Legalization of sports betting, according to Decree no. 763/94 and 25/02/1994 of the Society for exploitation of Lotteries (Société d’Exploitation des Loteries).

2011: An agreement was signed with GTECH to make tickets to the Malagasy Lottery available online. This is the first domestic online gambling operation in Madagascar, which signals the de facto legalization of online gambling in Madagascar (we use this date as the official date of legalization of online gambling, even though online gambling was never specifically legalized or regulated).

2016 – 2017: The government suspended the licensing of new casinos and online casinos within the territory of Madagascar.

2017: The government revoked the temporary suspension of casino gambling venues and websites.

2018: Legalization of online sports betting in Madagascar, according to Decree no. 7974/2018.

2020: The government officially decided to start the process of modernizing  the very outdate gambling legislation.

Gambling is legal in Madagascar since 1971, according to the 1971 Law No. 71-011 Regulating Gambling Houses and Fixing the Tax Regime of These Houses1, which is the main piece of the gambling legislation

The gambling legislation is very outdated, it is virtually unchanged since 1971 and it cause many problems in the regulation of the gambling sector.

UPDATE 2022: However, the government officially decided to start the process of modernizing the very outdated gambling legislation, which did not change much since the 70s2 (and the country also lacks a comprehensive gambling legislation, it’s very fragmented currently).

The gambling sector is actually quite developed, it consist of 6 land-based casinos in the country, multiple gambling websites and the state-owned Malagasy Lottery (details can be found below in the Madagascar casino gambling and the Madagascar lottery sections respectively).

 

Online gambling is legal in Madagascar, at the very least since 2011.

The very outdated gambling legislation was stretched to apply to online gambling as well. Only online sports betting is specifically regulated.(details can be found in the Madagascar sports betting section below).

The two biggest, licensed, legally operating Madagascan online gambling businesses are that of the Madagascan Lottery (an online lottery platform in partnership with GTECH) and Bet261.

Licensed brick & mortar venues and the state-backed lottery can operate online platforms. However, there is no standalone online licensing process, and only companies, which operate physical venues can engage in internet gambling in Madagascar (this is typical of small African countries with lower internet penetration rates).

It’s not surprising that the online gambling sector was neglected in the country, considering that the internet penetration rate of Madagascar is only 22%3 (and it is growing very slowly, by about 1-3% per year). An internet subscription is unaffordable to the vast majority of the people.

/Comment: African countries usually start regulating internet gambling when the internet proliferation is around 50%, based on our experience writing about online gambling laws in Africa for the past 5+ years./

Officially, only licensed gambling websites should accept players from Madagascar. However, because there is no online gambling licensing process and the sector is very underregulated, therefore this is absolutely not enforced in any way.

Betting on blood sports in Madagascar

Not all forms of blood sports are illegal in Madagascar. Cockfighting is legal in Madagascar, it is considered  traditional activity, especially popular among indigenous people in the countryside.

Madagascar, even though it is world-renowned for its’ biodiversity, it didn’t have a developed tourism and hospitality sector until 2019. The number of tourists peaked in 2019, when around 500 K people visited the country (most of them tourists)4.

UPDATE COVID-19: Sadly, decades of work were entirely undone by the global pandemic, which decimated the sector completely. In 2020 the number of visitors was only 87 K, less than 1/5 of the 2019 value.

This resulted in casino closures, and considering the situation it is unlikely that new casinos would open anytime soon.

The Ministry of the Interior and Decentralisation is responsible for the licensing and regulation of the Madagascan gambling and digital gambling sector. Their website is only available in French.

Madagascar gambling taxation

The gambling tax rates in Madagascar are the following:

“Access to the gaming rooms gives rise to the collection of stamp duty , the quota of which is fixed as follows:

  • 500 FMG*, if the entry is valid for one day;
  • 2,000 FMG*, if the entry is valid for one week;
  • 6,000 FMG*, if the entry is valid for one month;
  • 25,000 FMG*, if the entry is valid for one year.”

An according to Article 10. 07. 01 of  the General Tax Code:

  • “slot machines: 400,000 Malagasy Ariary/device per year (€94.35)
  • other devices: 100,000 Malagasy Ariary/device per year (€23.59)”

*Explanation: FMG stands for Malagasy Francs, which was the national currency until 2005. The current national currency is Malagasy Ariary.

However, the gambling legislation is so outdated that it lists the fixed fees in Malagasy Francs. It is unknown how much the gambling companies have to pay exactly, but we have converted them to Malagasy Ariary using the 2022 values:

  • 100 Malagasy Ariary, per day (€ 0.024);
  • 400 Malagasy Ariary, per day (€ 0.09);
  • 1200 Malagasy Ariary, per day (€ 0.28);
  • 5000 Malagasy Ariary, per day (€ 1.18);

 

As a result of the outdated legislation the gambling tax rate is unbelievably low, probably the lowest in the entire world.

Also, due to the wording of this article it only applies to land-based venues, which means that online gambling is tax-free.

Gambling taxes are payable in addition to licensing fees and regular taxes (e.g.: corporate tax, which is 23% in Madagascar), according to the Madagascar General Tax Code5.
