Gambling is legal and strictly regulated in the Principality of Liechtenstein since 2010 (except the lottery and non-profit gambling, which were legal prior to 2010).
The main piece of legislation governing gambling is the Gambling Act 2010 (Geldspielgesetz – GSG)1,and its amendments.
Up until 2010 gambling was outlawed, because of a law from 1949 prohibiting gambling. The only gambling entertainment allowed in the country was the International Lottery (Internationale Lotterie in Liechtenstein Stiftung), which became available online in 1995, one of the first lotteries to do so. ILLF was not considered gambling because it was paying a large percentage of the profits to charities.
Since 2010 the government is issuing casino licences but it resulted in a lengthy legal battle with Austrian gambling giant Novomatic, the first company to acquire a Lichtenstein casino license, and this halted things for years2.
Online gambling is also legal since 2010, and online gambling operators also require a licence. However, right now it is not possible to get an online gambling license (according to online blog posts, forum posts) and none have been issued (can’t verify this). The Gambling Act from 2010 clearly says:
“1) Anyone who organises online gambling games on a commercial or public basis shall require a concession issued by the Government.”
No such concessions have ever been issued but many online gambling websites seem to ignore this entirely, and as you can see below, they accept players from Lichtenstein despite not having a license. Players who play online on such gambling platforms are not prosecuted and the websites are not blocked. This is because of various EU laws, which I explain below.
Liechtenstein and EU gambling laws: Because Liechtenstein is an EU country Article 56 TFEU3 and Article 8 of Directive 98/34/EC (EU gambling directives) apply. These state that other EU online gambling companies should be provided access to the Liechtensteiner market, and they should be provided a way to obtain local gambling licenses (free trade of services and free competition within the Eurozone).
This is not the case, the licensing system is currently on hold, which means online gambling companies can not acquire local licenses. This is against the EU directives (there is a lot of litigation because of this behind the scenes), and this means that the government of Liechtenstein can not block foreign internet gambling platforms, and can not prosecute, or fine players who place bets on such platforms.
