Online casino gambling is illegal in Kuwait, similarly to all other forms of online gambling.
Casinos in general are prohibited in the country, in accordance with title 10 and chapter 3 of the Kuwait Penal Code1.
Article 394 of the Penal Code states that (paraphrased):
“If a person other than the persons mentioned in paragraph (1) of article (393) is found in a common gaming house shall be deemed, unless the contrary is proven, to be
there for the purposes of unlawful gaming. For this reason he/she shall be punished by a fine not exceeding 5 Kuwaiti dinars (€15, $18).”
However, this is not enforced when it comes to gambling websites. Players who place bets online are not targeted, unlike those, who engage in physical, offline gambling (details below, in the Kuwait brick & mortar casinos section).
/Comment: This is not unique to Kuwait, this is the case in most Muslim-majority countries, some (e.g.: Afghanistan) even have such lax enforcement when it comes to internet gambling, that the country even had professional poker players, who openly admitted to playing poker online from the country and competed in international tournaments, namely Sherkhan Farnood, who was the Chairman of Kabul Bank until 20102./
The Kuwait government does not issue gambling licences to online casino operators, and there are no domestic online casinos licensed in Kuwait.
/Comment: If a website claims to be licensed in Kuwait, or if it’s available in Arabic, it’s a scam. Avoid such websites, there are no Kuwaiti digital casinos./
Some online gambling sites are blocked for “violating public morals” (reportedly only a very small number of gambling websites are blocked, only the biggest of them3).
Even some transactions to and from gambling sites are sometimes blocked as well (this only effects transactions via credit cards from local financial institutions, international banks do no comply, virtual wallets e.g.: Skrill, Netteller and cryptocurrencies are completely unaffected).
