Summary: Gambling is illegal in Kuwait (officially the State of Kuwait, a rich Muslim country on the Arabian peninsula, a monarchy with a population of 4.67 million).

Online gambling is also illegal in Kuwait, technically. However, players are not prosecuted for playing online, but some gambling websites are blocked.

1991: Gambling has always been illegal in the State of Kuwait, ever since the country’s liberation from Iraq in 1991.

Gambling (maisir) is illegal in Kuwait, according to title 10 and chapter 3 of the Kuwait Penal Code1.

Article 394 of the Penal Code states that (paraphrased):

“If a person other than the persons mentioned in paragraph (1) of article (393) is found in a common gaming house shall be deemed, unless the contrary is proven, to be
there for the purposes of unlawful gaming. For this reason he/she shall be punished by a fine not exceeding 5 Kuwaiti dinars (€15, $18).”

Kuwait’s legal code is based on Islamic (Shari’ah) law2 and according to Sharia law gambling is strictly forbidden and it is considered Satan’s handiwork.

According to Islamic law:

  • It is unlawful for Muslims to gain wealth by gambling. According to Islamic teachings one ought to earn a living by honest, serious, hard work, and relying on luck to gain money is contrary to this principle.
  • Muslims must not participate in gambling for recreational purposes: The reason for this prohibition lies in the addictive nature of gambling, which causes the gambler to neglect his responsibilities to society and the Creator.

 

Therefore, there aren’t any legally operating land-based gambling establishments in the country. Kuwait doesn’t even have a national lottery.

/Comment: Even most Muslim-majority countries have a lottery, only a few countries in the world don’t have a lottery, e.g. Afghanistan, Iraq, Pakistan, Syria./

If someone is caught engaging in illegal gambling the penalty initially is 5 dinars, but organizers are more severely punishment: imprisonment up to 6 months and a fine up to 50 Kuwaiti dinars (€150, $180).

The authorities are serious about enforcing this gambling ban, when it comes to illegally operating gambling establishments. There were many cases of arrests involving illegal gambling dens. E.g: in 2014, the authorities busted one of the biggest illegal casinos in the country, arresting more than 30 players (including foreigners as well)3. However, the opposite seems to be true when it comes to online gambling, see below.

 

Online gambling is illegal as well. Online gambling is not specifically mentioned in the penal code of Kuwait. However, because all forms of  gambling are considered illegal it applies to digital games of chance as well.

However, this is not enforced and players are not prosecuted.

/Comment: This is not unique to Kuwait, this is the case in most Muslim-majority countries, some (e.g.: Afghanistan) even have such lax enforcement when it comes to internet gambling, that the country even had professional poker players, who openly admitted to playing poker online from the country and competed in international tournaments, namely Sherkhan Farnood, who was the Chairman of Kabul Bank until 20104./ 

However, some online gambling sites are blocked for “violating public morals” (reportedly only a very small number of gambling websites are blocked, only the biggest of them5).

Even some transactions to and from gambling sites are sometimes blocked as well (this only effects transactions via credit cards from local financial institutions, international banks do no comply, virtual wallets e.g.: Skrill, Netteller and cryptocurrencies are completely unaffected).

/Comment: If Kuwaiti citizens keep their online gambling activity to themselves and they only place bets in the privacy of their own homes there is no realistic chance for them to get into trouble with the authorities. And if they do get fined, which is very unlikely, it’s only 5 dinars (€15, $18), which is not much of a deterrent./

While online gambling seems to be the preferred illegal gambling activity of the more educated and richer section of the populace, the leading form of illegal wagering is actually dog fighting, an illegal blood sport, which is sadly very popular in Kuwait, mainly among the poorer sections of society.

How is it legal for online gambling websites to accept players from Kuwait? Isn’t it illegal?

It’s only illegal for Kuwaiti citizens to play online. These foreign online gambling websites, which accept players from Kuwait, are registered and licensed in foreign countries, and the Kuwaiti laws only apply within the borders of Kuwait (within the so called jurisdiction of the country, they do not apply to these foreign gambling websites).

According to the local gambling laws of the countries in which these offshore gambling companies operate it’s perfectly legal to accept players from Kuwait.

But it’s not legal for Kuwaiti citizens to place bets on these platforms.

International law can be complicated, and enforcement is even more tricky, I hope this clears this up.

However, I officially do not recommend playing online form Kuwait, it’s illegal, and you should always act according to the laws of your country, even if it’s not enforced, play at your own risk.

Yes, the laws discussed on this webpage only apply to Kuwaiti citizens, and they do not apply to tourists. Tourists (expats, non-citizens, illegal migrants) can play online freely.

 

Betting on blood sports in Kuwait

All forms of blood sports are officially illegal in Kuwait. Betting on blood sports is also illegal.

However, this does not stop people from engaging in both, regularly. Dog fighting seems to be most popular form of illegal blood sport in Kuwait and in neighbouring Iraq and Saudi Arabia.

These fights are often accompanied by consumption of illegal alcohol, drugs and betting as well. Police rarely interferes, and most locals don’t even consider it animal cruelty6.
