Most forms of gambling are legal in French Guiana (an overseas region and single territorial collectivity of France, capital Cayenne, a population of only 294,071, member of the EU).

Because French Guiana is an overseas territory of France, French gambling laws apply, and games of chance are legal according to the French gambling act: Article L.320-1 of the French Code of Homeland Security (Chapitre préliminaire : Dispositions communes  – Articles L320-1 à L320-18)1, which is the main piece of the gambling legislation.

The head of state of overseas departments is the President of the French Republic. French Guiana is represented in the Senate and the National Assembly, but does not legislate for itself. As a result, the same gambling laws apply as in France, and EU gambling directives also apply (e.g.: harmonization and convergence of laws, and Article 56 TFEU, single economic area).

Providing gambling services in France and in any of the overseas departments requires a French gambling licence (details of the licensing process and fees can be found below), and the overseas territories do not issue local licenses.

The big state-owned French gambling monopolies are also present in French Guyana, and dominate certain gambling niches, these are: Pari Mutuel Urbaine for horse racing betting, Francaise des Jeux for other kinds of sports betting as well as lottery, and lottery like games.

Even though casinos are legal in French Guiana, there aren’t any in operation yet. UPDATE 2021 COVID-19: Le Group Cogit (a huge French casino company) managed to secure a casino licence in Cayenne, and the company is set to build the first casino in the territory. However, the project was postponed indefinitely, due to the coronavirus global pandemic. The current scheduled opening date is not known.3

Online gambling was legalised in France – and thus in French Guiana in 2010, according to French Law 2010-476 (Loi no. 2010-476 du 12 mai 2010 relative à l’ouverture à la concurrence et à la régulation du secteur des jeux d’argent et de hasard en ligne)2.

Online gambling and the licensing of brick & mortar gambling houses are the domain of by the Autorité de régulation des jeux en ligne (ARJEL) UPDATE: L’Autorité nationale des Jeux ANJ replaces ARJEL as the regulatory authority of most forms of gambling and online gambling from 2020. Gambling tax in French Guiana

French gambling taxes apply, which are extremely high:

Casinos, it’s 28% first + the following progressive tax on the remainder, based on annual gross gaming revenue:

 

If this wasn’t enough, a 11.2% tax is paid on the 68% of the gross gambling revenue from slot machines.

In addition, every gambling establishments has to pay a 13.7% withholding tax on any winnings by players equal to or exceeding EUR 1,500 (this is because gambling winnings over €1500 are taxable in France and players never paid taxes on them, so now casinos have to).

As you can see, it’s incredibly high, the highest gambling tax rate in all of the world!

Keep in mind, that this gambling tax is paid on top of regular, corporate tax (can be as high as 31%), and taxes paid on the wages of employees (of course some of it is deductible, but still). In fact, with this crazy system, it’s possible for a casinos to get really close to a 100% effective tax rate.

 

For players, taxation of gambling winnings in French Guiana: Gambling winnings over €1500 are taxable, 12% tax rate. However, licensed domestic companies are required to pay taxes on your winnings, not you. Therefore, as long as you play in a licensed establishment, you don’t have to pay any taxes (it’s automatically deducted from your winnings).

However, if you play abroad, or online, and if you win over €1500, you would have to pay taxes on it.

/In reality, this is rarely enforced, but if you win a really big amount, e.g.: €100 000+, I would certainly suggest paying taxes on it, otherwise you can get into a lot of trouble. Casino gambling is legal in French Guiana. However, there aren1t any casinos in operation currently within French Guiana (UPDATE 2021: the first one is expected to be open very soon).

The city of Kourou has been working on a casino project in 2015, and they were in talks with a Dutch company. But it seems like that deal has fallen through, and the current casino project is expected near the capital, Cayenne, and the operator will be a French company, the Cogit group. Cogit is a huge casino operator, with a presence in France, and more importantly, with a presence in the French overseas territories: Saint Martin, Guadeloupe, Martinique, Réunion. UPDATE COVID-19: the project was postponed indefinitely, due to the global coronavirus pandemic.

Just as in France, online casino gambling is not among the activities permitted by the French internet gambling legislation. Online casino games are believed to have an especially detrimental effect due to their addictive nature, and therefore they were not included in the 2010 legalization.

Despite this, locals playing in international online casinos are not prosecuted. EU gambling laws dictate that according to Freedom to provide services — Article 56 TFEU*: if a country does not provide any means for foreign online casinos to acquire local licenses, then they can not punish or block these gambling websites or players who visit them.

Bingo is legal in France, and all of its overseas departments, including French Guiana. Bingo played in France differs from the US version, and it is the more traditional, older form of the game, with more rows on the bingo cards, though the basics of the game are the same (although there are regional varieties, and in France there are at least 12 different types of regional bingo).

There aren’t any bingo halls in French Guiana, bingo can only take place within licensed casinos, and standalone bingo hall licenses are not issued.

Sports betting is legal and quite popular in France (especially betting on football, the national sport of France), but less widespread in the overseas territories. The name ‘pari mutuel’ betting, in fact, originates from France and it is the most popular form of sports betting worldwide.

When it comes to sports wagering we have two distinct categories: horse racing betting, which is controlled by PMU and wagering on other sports, which is the area of FDJ.

There are no racetracks within French Guiana, though.

Online sports betting is legal too in France and in the French territories, since 2010. It’s one of the three forms of gambling, where private companies are allowed to compete with the state-owned monopolies (PMU and FDJ).

The easiest way for French Guianese punters to place bets on sports is by using online bookmakers, because the FDJ doesn’t have many betting shops in French Guiana, at least compared to the mainland.
