1961: Gambling was legalized in Botswana in 1961 with the Lotteries and Betting Act. Which means the legalization of gambling actually predates the independence the country.
1966: Independence of Botswana from the Britain.
2012: Gambling legislation was entirely overhauled wit the passing of the Botswana Gambling Act.
2017: A tender was announced for the organization of the Botswana National Lottery, so far the national lottery is not yet in operation.
Gambling is legal in Botswana since 1961, according to the Gambling Act1, which is the current main piece of the gambling legislation.
Prior to 2012 two laws regulated gambling in the country: the Lotteries and Betting Act from 19612 and the Casino Act from 19713.
In 2011 the Ministry of Industry and Finance issued a statement saying that the existing gambling laws (written in the 60s and 70s) are outdated and inadequate. A new, comprehensive gambling legislation was deemed necessary to better regulate the growing number of private businesses conducting games of chance in the country.
Debates have been held, with most members of the parliament advocating stricter regulations, and in 2012 the Gambling Act was created, encompassing all forms of gambling. According to the new regulation, a new
In accordance with the laws, gambling establishments in Botswana require a licence to operate, which can be acquired from the Botswana Gambling Authority (details of the gambling licensing process, fees, requirements can be seen below in the Botswana gambling licence section).
The Gambling Authority was established in 2012, and it is now the legal body responsible for supervising gambling activity as well as issuing licenses.
Online gambling is not yet regulated.
The new, 2012 regulation of gambling still does not mention online gambling anywhere. However, it does state that gambling is only legal within licensed establishments, which would mean that online gambling is technically illegal. However, this is not enforced at all, and players can play freely online from Botswana (although not many international gambling websites accept players from the country, you can see a list of them below).
Botswana’s internet penetration rate was only 35% in 2015. However, it increased to over 60% by 20224, which might lead to online gambling receiving more attention, and perhaps it will be regulated in the coming years.
