Laws pertaining to gambling in the Philippines can seem somewhat hard to comprehend and counterintuitive at first glance. There are two regulatory bodies that control, license and oversee gambling operations in the country:

  • The Philippine Amusement and Gaming Corporation (PAGCOR), and
  • the Cagayan Economic Zone Authority (CEZA).

PAGCOR oversees and licenses all land based gambling venues, such as bingo parlors, betting shops, poker clubs and the Philippines casino industry. They issue licenses to all brick and mortar gambling operations, including what they call eGames*. The name might suggest otherwise, but these are actually land based gambling facilities that offer casino or bingo games on connected terminals. These are not online casinos.

The Cagayan Special Economic Zone and Freeport, also known as Cagayan Freeport, is a special economic zone in Cagayan, northern Luzon. It was established by the Republic Act No. 7922, otherwise known as the Cagayan Economic Zone Act of 1995. CEZA, the economic authority of the Cagayan Economic Zone licenses online gambling in the Philippines. It is actually one of the most reputable and popular gaming jurisdictions in the world, because even though CEZA licensed sites cannot offer their services to Filipinos, a CEZA gaming license allows an operators to tap into the lucrative and growing Asian online gambling market**.

Foreign, offshore online gambling sites are free to offer their services for players from the Philippines. The legality of such sites was debated, but a Court of Appeal decision in 2012 resolved the matter: they stated that an activity, which is not illegal expressly, cannot be penalised. And as there was no law in force specifically banning online gambling in the Philippines then (and there isn’t one now) playing on foreign platforms is technically legal***.

The bottom line is, from strictly a player’s perspective is that Filipinos are free to gamble on any foreign online gambling platforms that accept their registrations.

In the Philippines, casino operators can offer poker games in their venues and separate poker clubs are also eligible for a licence from PAGCOR, the gambling authority that oversees all land based gambling in the country.

The main economic authority of Cagayan Freeport, CEZA issues online poker licenses also. However, the same applies to these, as to other forms of online gambling operators licensed here – they cannot accept players from the Philippines. Nevertheless, players from the Philippines are not prosecuted for gambling online on foreign platforms – due to the Court of Appeal decision mentioned above.

Land based sports betting in the Philippines is legal, although it is a monopoly of a state run operator, MegaSportsWorld. The company has many brick and mortar betting shops and land based betting terminals. However, they do not have an online platform.

As for online sports betting – Philippines licensed operators, who obtained their permits from CEZA, the economic authority of Cagayan Freeport cannot allow locals to place bets online.

However, Filipino players, on the other hand can legally use foreign online bookmakers – there are no prohibitions in place on online betting in the Philippines.

Lottery – Philippines

Land based lottery in the Philippines is legal and also a state monopoly. The Philippine Charity Sweepstakes is the company running all legal, land based lottery games in the country. They do not operate an online platform.

The CEZA reportedly offers online lottery licenses as well. However, as in the case of other forms of online gambling licensed in Cagayan Freeport, licensees cannot offer their services to Filipino players.

There is no ban on foreign online lottery operators. The government did issue and amendment to the country’s gambling act in 2004, that increased penalties for participating in illegal number games. However, its provisions were aimed against Jueteng and Masiao, two popular illegal lottery type games in the country. Filipino players are not prosecuted for participating in foreign online lottery draws.

Philippines is a rather Bitcoin and gambling friendly country. Therefore, it does not come as a surprise that the CEZA already licensed a Bitcoin gambling website, OLE Bitcoin (it is actually not a standalone gambling platforms, rather an agent that lets players make Bitcoin deposits on major sports books in the region – Pinnacle, SBOBET and IBCBET).

Bitcoin gambling websites licensed in the country cannot offer their services to Filipino players. However, as Bitcoin transactions are anonymous, it is not clear, how they actually enforce this law in the case of Bitcoin gambling operators.

Nevertheless, players from the Philippines are free to gamble on foreign Bitcoin gambling platforms.
