Legal status of casinos in Yemen: illegal, players are prosecuted
Casinos are illegal in the Yemeni Republic, according to Law 12. of Concerning Crimes and Penalties (the Penal code of the Yemeni Republic)1.
They have always have been illegal. There aren’t any casinos in the country currently, and there were never any in country’s history.
Similarly to their online counterparts, brick and mortar casinos are also prohibited in Yemen because of the integration of Sharia law into the legislation2.
Sharia courts preside over matters related to illegal casinos. And unlike in the case of online casinos (details can be found above) the land-based casino ban is quite strictly enforced. Punishments, according to Article 287 of Law 12., include:
- Players participating in illegal gambling: “Anyone who is found to be gambling in a public area shall be punished by imprisonment for up to a maximum of six months or a fine up to a maximum 2000 YR (Yemeni rial, the national currency, approximately € 7).”
- Organizers, organizing illegal gambling operations or operating unlicensed internet wagering platforms: “Anyone who operates a place for gambling, allows for gambling games to take place in a public place or area, or takes part, in any manner in arranging or supervising such gambling games shall be punished by imprisonment for up to a maximum of two months or a fine up to a maximum 6000 YR (Yemeni rial, approximately € 22).”
Compared to other Arab countries in the vicinity these punishments are very lenient, especially the fines, which are surprisingly low.
Interestingly not all Muslim-majority countries banned casinos, the following Islamic countries all have casinos: Turkmenistan, Armenia, Egypt, Kazakhstan, Lebanon.
Due to the Muslim majority in Yemen, the casino ban is actually supported by the majority of the population, and is very unlikely that casinos will be legalized in the near future.
Even though Yemen, due to instability and its geopolitical climate, could use the investment.
Additionally, the country receives very little tourists. In fact the country receives one of the lowest number of visitors in the entire Arabian Peninsula: around 300 K visitors per year (most of them are most likely not tourists, e.g.: reporters, NGOs, expats, businessmen etc…)3.
UPDATE COVID-19: These are pre-coronavirus numbers, the number of visitors has fallen even more as a result of the global pandemic. However, the government hasn’t published any official figures since 2015. Therefore the impact of the global pandemic is not yet known.
/Comment: When a government is not publishing the official figures it’s almost always because they are hiding it, because it’s that bad or due to the geopolitical climate. In Yemen it’s probably both and I would assume the number of visitors is well below 100,000 visitors per year at this point./
The legalization of casino could help the country in the following ways:
- Casinos (specifically huge casino hotel complexes), after the civil war is over, could help rebuild the tourism and hospitality sector of the war-torn country. Such investments have a notable positive impact on the sector (which are proven by well documented cases worldwide) and they are known to drastically improve the number of visitors in poorer countries (e.g.: Egypt, when casino were legalized it was a poor country, and not the wealthier tourist hot spot it is today)
- Post-upheaval countries are always cash-strapped. Long-term sizeable investment projects (which casino hotel projects always are) can help the ailing economy and create lucrative jobs for the suffering population.
