Even though online gambling was legalized in France in 2009, according to Law 2010-476 2010 (Loi no. 2010-476 du 12 mai 2010 relative à l’ouverture à la concurrence et à la régulation du secteur des jeux d’argent et de hasard en ligne)2, due to pressure from the European Union3, this legalization did not include online casino gambling.

Online casino gambling is thought to be more addictive and therefore dangerous than other forms of wagering because of digital slots. This was the official explanation of the French government.

However, there is ongoing legal conflict between gambling companies licensed in other EU countries, the EU and the French government regarding the legal obligations of EEA (European Economic Area) members.

France, Réunion and the EU gambling laws: Because France is an EU member state and part of the EEA, Article 56 TFEU4 and Article 8 of Directive 98/34/EC5 (EU gambling directives) apply to it (these apply to the French overseas territories as well, including the French Overseas Territory of the Island of Réunion). These articles state that EU online gambling companies should be provided access to the French market, and a way to obtain local licences, including online casino licenses.

However, because France does not issue digital casino licenses online gambling websites licensed in other EU countries can not be blocked or prosecuted, according to some interpretations of the EU laws. This would violate the free flow of services within the European Economic Area (EEA).

Opinions are divided on this issue, and there is considerable litigation behind the scenes. Verdicts vary greatly and they depend on the judges’ interpretation of the EU, EEA and local laws. Therefore, some online casinos (you can see a list of them below), which are licensed in the EU, continue to accept players from France and the French territories.

As a result, Reunionese players can freely visit offshore online gambling websites (as long as they have a subsidiary, which is licensed by an EEA member country), and they are not prosecuted for it.

French gambling tax rates, which are extremely high, apply to the French overseas territories (France d’outre-mer) as well.
