Online casino gambling was illegal in Puerto Rico. However since 2020 it’s in the process of being legalized in Puerto Rico. In order to fully understand the legal status of online casinos in Puerto Rico, one needs to take a closer look at the legislative system of Puerto Rico.
The Commonwealth of Puerto Rico is an unincorporated territory of the United States located in the Caribbean Sea. Puerto Rico has its own government, and has the right to create its own laws. However, the US Congress can overrule legislation passed within the territory, and in case of conflict US federal laws supersede local laws. This means that Puerto Rico has to adhere to the federal legislation of the United States, which includes US federal online casino gambling laws such as the Unlawful Internet Gambling Enforcement Act 2006 banning financial transactions related to gambling, the Wire Act 1961 which forbids interstate electronic communications pertaining to online gambling and The Racketeer Act. Therefore, the process of legalizing online casinos fully, and bring the law into compliance with US federal laws will likely take years. In the meantime players can freely play online, they are not prosecuted or fined, and online casinos which accept US players accept players from Puerto Rico as well (you can see the these online casino sites below).
UPDATE 2021: Another US territory, the Northern Mariana Islands also started to legalize online casinos gambling, probably inspired by the legalization attempts of Puerto Rico. It’s probably only a matter of time, til other territories legalize online casinos gambling.

Puerto Rico online casino tax: there is no specific online casino tax yet, it will be announced when the legalization process is finished, it will be either 10% or 20% based on the current brick & mortar casino tax
Age requirement to play in online casinos in Puerto Rico: 18+
For players, taxation of winnings from an online casinos in Puerto Rico: taxable, gambling winnings are exempt from income tax. Instead, prizes are subject to a special tax, according to PRIRC § 3040.02***** “a tax of 10% on certain gambling winnings obtained in banks and 20% on all winnings from pools, betting against the bank, daily doubles, and subscription funds or from any other betting transactions legally authorized on the racetracks of Puerto Rico.” Federal taxes are not paid on gambling winnings, unlike in the overwhelming majority of the USA.
/Comment: betting against the bank probably means betting against the house, therefore it means betting, wagering, sports betting, it’s just probably incorrectly worded, I have no idea what “gambling winnings obtained in banks” could mean, but according to Puerto Rico Herald****** it means casino gambling, but the article is from 2004 so I ‘m not sure if this is true anymore. They really should rename these, they are really poorly worded. Taxes are not automatically withheld by the gambling establishments. No idea which if any applies to online casino gambling winnings, if you win a bigger amount ask a CPA – certified personal accountant./
Online casino licensing Puerto Rico: Gambling licensing and regulation is the responsibility of the newly created Puerto Rico Gaming Commission (no website yet). If you wish to set up a gambling business, you have to contact them (for now you have to contact the Gaming Division of the Puerto Rico Tourism Company, until the Gaming Commission gets a website). Land-based casinos in Puerto Rico
Legal status: legal since 1948, operators require a licence
Unlike online casino gambling, land-based casinos are legal in Puerto Rico for a very long time. Brick and mortar casinos are not regulated by US federal law, but rather by Puerto Rico’s own Games of Chance Act from 1948*. This act is quite old and contains clauses from as early as 1948, but has been amended several times since. This act specifically regulates casinos and casinos gambling, and supplements the main piece of gambling legislation of Puerto Rico, which is the Laws of Puerto Rico Annotated – Title 15 – Sports and Parks – Chapter 5. Games of Chance.**
Casinos can only be opened in so called “zonas históricas, antiguas o de interés turístico” – historically important zones of tourism, these were established in 1947 and they must be part of a hotel or resort.***
The Puerto Rican gambling law allows casinos to operate, but only as part of resorts or hotels. As a result, casinos in Puerto Rico are mainly aimed at tourists (though locals are still allowed to enter these establishments). Puerto Rico casinos are, in fact, popular tourist destinations, and are considered to be among the best casinos in the Caribbean area.
Currently there are 20 brick and mortar casinos in operation within Puerto Rico. 5 of these casinos are located in the largest city and capital of Puerto Rico, San Juan and its metropolitan area. The land-based casinos are regulated and supervised by the recently formed Puerto Rico Gaming Commission.
While the gambling act regulates land-based casinos quite well, there is somewhat of a loophole regarding slot machines. As a result, several semi-illegal slot machine parlors have sprung up, which have cut into the profits of legitimate casinos. However, the police has been cracking down on them.
The largest casino in Puerto Rico is the Caguas Real Hotel & Casino UPDATE: renamed to Four Points by Sheraton Caguas Real Hotel & Casino, located in Caguas (you can see it on the picture at the top). The casino offers 570 slot machines, as well as several table games such as blackjack, roulette, mini baccarat and craps, you can see the details below. Like all Puerto Rican casinos, Casino Real is also incorporated into a resort, offering several other services such as pools, restaurants besides the casino.
Most of the casinos in Puerto Rico are on the smaller side (by international standards). The dress code required by casinos in Puerto Rico is usually not mentioned on the website of the casinos (not mentioned in 90% of the cases), and it is s not strictly enforced, but it should be smart casual. Opening hours are usually 24/7. There is a growing Chinese influence in Puerto Rico (abut 10% of Puerto Rico casinos are fully owned by Chinese individuals or companies, and many more are partially owned, which is common in US territories, probably a conscious effort on part of the Chinese Communist party, a great example of this is the situation on Saipan, the main island of the Northern Mariana Islands). The casinos make an effort to draw in these Chinese players and many have small “Asian sections” usually with EZ Baccarat, and a few Asian themed slots. Very few of the casinos have poker, even the bigger casinos only have a few tables, and a few (about 3 casinos) have tables for live poker cash games, none of them have standalone card rooms, just semi-separated poker sections (they always call these poker rooms, on purpose, to make them seem bigger and better than they actually are).
Can locals play in the casinos of Puerto Rico?
Yes they can. Unlike in many smaller countries (e.g.: Samoa, and many arab, muslim countries) the casinos are not just for tourists, locals are not forbidden to enter, and can play in the gambling establishments.

The hotel complex has the biggest casino in Puerto Rico. sadly, the casinos is barely even mentioned on the hotel’s official website, therefore I had to collect all the info from secondary non-official sources.
/Comment: It ‘s quite an oversight IMO that they didn’t include basic info (opening hours, dress code, entrance fee, number of games, COVID-19 info etc… ) about the casino on the hotel’s website./

Stellaris Casino at San Juan Marriott
Stellaris Casino at San Juan Marriott Resort, address: 1309 Ashford Ave, San Juan, 00907
Perhaps the best know hotel and casino in all of Puerto Rico, in operation since 1963. Originally called Puerto Rico-Sheraton Hotel, later renamed to Dupont Plaza Hotel, then it was called Palm Hotel and Casino, and it got its final name sometime in 1995. For a long time it was PRs biggest hotel and also the biggest casino. It is currently owned by a Chinese businessman. The casino has its own Wikipedia page too (although that has very outdated info, probably hasn’t been updated for years). Sadly, the casinos is barely even mentioned on the hotel’s official website.
/Comment: This is also a Marriott casino, therefore it’s barely mentioned on the official website, all info comes from secondary, non-official sources sadly. They really should include more than just the name and a few pretty pictures, it really only takes like 5 minutes to add a few lines…. I have expected better from multi-billion $ company…./

Casino del Mar at La Concha Resort

Casino del Mar is easily the most recognizable casino of the Commonwealth of Puerto Rico. The casino describes itself as having an “über-chic yet relaxed atmosphere”, which is just a bunch of marketing buzzwords, but I included it because that’s how they want to be seen apparently (über is a German word means above, beyond, on top of, and chic is smart elegance and sophistication according to Merriam-Webster, so it’s very elegant and stylish yet relaxed, like every other casino in Puerto Rico….). The hotel itself looks plain, only that building to the left is unique.
Games: 360 slots with bets ranging from 1¢ to $25 (sadly, according to the pictures, and reviews of players online, they are mostly older slots from 2010s and earlier, no really new slots).
Tables (around 18 tables):
- Blackjack (12 blackjack tables, 4 standard, and 8 tables with side bets – 7 tables of “lucky lucky” and 1 table of 21+3)
- Three Card Poker- Progressive Roulette with Luminar System & Display, unknown number
- 1 table of EZ Baccarat – Dragon & Panda 8 (popular in Macau casinos in China, introduced sometime in the 2010s to please the increasing number of Chinese tourists and wealthy Chinese people residing in Puerto Rico, the casino above is actually owned by a Chinese individual, the casino’s official website advertises this as “Casino Del Mar has an exclusive Asian-themed area”, it consist of this one table and a few Asian themed slots….)

Sheraton Puerto Rico Hotel & Metro Casino
Sheraton Puerto Rico Hotel & Metro Casino address: 200 Convention Boulevard, San Juan, 00907
A huge hotel complex with a casino (largest casino of San Juan, capital of Puerto Rico) that has recently undergone full renovation, the casino itself is called Metro Casino. Guests get complimentary snacks and beverages while playing in the casino, there are penny slots, as low as $0.01 per spin (with one line, but nobody is playing with one line, it’s more like $0.25, or $0.5 per spin with all the lines, by default slots have all the lines active). Also, this casino has the biggest poker section in all of Puerto Rico. They also started to add Chinese casino games, namely EZ Baccarat to please the growing number of Chinese tourists and locals.
Games: 18 tables (blackjack, roulette, baccarat, craps, EZ baccarat, electronic roulette table, free bet blackjack and 21+3 extreme blackjack), 430 slots.
The casino has a poker section, Casino Metro Poker Saloon (not an actual saloon, it’s just a marketing buzzword, it’s a semi separated section), with 4 tables for cash games, the rest is for games against the dealer, but it is Puerto Rico’s biggest poker section. The other casinos only have a few poker tables, most don’t have any tables for live cash games at all, just a few Texas hold’em tables, where you can only play against the dealer.

The largest hotel resort in western Puerto Rico, most well know for its waterpark. Previously it was a Hilton hotel, with the name Mayagüez Hilton, but it was bought by a group of local rich people. At the time of writing, the website of the hotel has no information about the casino, therefore I had to gather the information here from secondary non-official sources.

Bitcoin, cryptocurrency casinos in Puerto Rico
Bitcoin gambling is not specifically regulated in Puerto Rico or on the federal level. None of the land-based casinos accept bitcoin, litecoin, ethereum, or any of the other cryptocurrencies. However, when the legalization process of online gambling ends bitcoin online casinos will be able to be licensed and operate on the island.
Other forms of online gambling in Puerto Rico
Apart from online casino gambling, which is being legalized right now, online sports betting, fantasy sports betting and e-sports betting are all legal since 2019, according to the Puerto Rico Sports betting and Fantasy Contest Regulations.*
And when it comes to land-based gambling: bingo (only fundraising, non-profit bingo), the lottery (Loterias de Puerto Rica), horse racing betting, and interestingly cockfighting betting are the main forms of games of chance. Betting on blood sports, including cockfights is actually illegal in the USA, on a federal level, according to the 2018 Agriculture Improvement Act** but Puerto Rico and all the other US territories disregard this, keeping their traditional sport and this part of their local culture alive (and in some territories it’s also part of local religious customs), despite the repeated attacks from Washington. This is far from a settled issue, and we will be hearing from this in the future, for now, cockfighting remains de facto legal.
