Gambling is legal in Puerto Rico (officially the Commonwealth of Puerto Rico, PR , a United States unincorporated territory) since 1948, including casino games, lottery, bingo, horse and even betting on cockfights (UPDATE: since 2019 cockfights are no longer legal). The main piece of gambling legislation is the Laws of Puerto Rico Annotated – Title 15 – Sports and Parks – Chapter 5. Games of Chance* and the Casino and Gambling Act**. There are 20 casinos, 2 horse racing tracks, and several cockfighting arenas (a.k.a. cockpits) on the islands. Puerto Rico is one of the few places in the world, where betting on blood sports is still legal UPDATE: since 2019 , according to US Public Law 115 – 334 – Agriculture Improvement Act of 2018***, all forms of blood sports, including cockfighting are illegal in all US states and territories, which includes Puerto Rico (they tried to fight this ban, but so far it was unsuccessful, see the video below for more info). However, even though cockfighting is illegal on paper, it is still de facto legal in the countryside of Puerto Rico (this is pretty common in the US territories though: Guam, American Samoa, Northern Mariana Islands all have legalized traditional cockfighting and betting on cockfights, despite the objections of the US federal government, and just like Puerto Rico, they are actively fighting the US ban, and have made laws to protect this particular piece of their local culture).
The legal status of unincorporated territories within the US is quite controversial. They can elect regulators and pass their own laws, but the US congress (to which they cannot appoint representatives) can nullify the measures of their territorial legislatures, and in case of conflict, US federal laws supersede local laws (although 54% of Puerto Ricans voted in favor of becoming an independent country, and it is very possible that Puerto Rico will eventually achieve independence). But for now, all the restrictions on online gambling that exist in the US on a federal level apply to Puerto Rico as well, which means it’s illegal. UPDATE 2021: Online casino gambling is no longer illegal, it’s in the process of being legalized in Puerto Rico, it needs to be approved and brought into compliance with US federal laws (Wire Act 1961, Unlawful Internet Gambling Act 2006, Illegal Gambling Business Act, The Wire Act 1961, The Racketeer Act, you can read more about the situation of online gambling in the United States of America here), therefore, the process will likely take years. Gambling licensing and regulation is the responsibility of the newly created Puerto Rico Gaming Commission (no website yet). If you wish to set up a gambling business, you have to contact them (for now you have to contact the Gaming Division of the Puerto Rico Tourism Company, until the Gaming Commission gets a website).

There is no specific gambling tax. Operators pay fixed licensing fees instead.
For the players, taxation of gambling winnings in Puerto Rico: taxable, gambling winnings are exempt from income tax. Instead, prizes are subject to a special tax, according to PRIRC § 3040.02***** “a tax of 10% on certain gambling winnings obtained in banks and 20% on all winnings from pools, betting against the bank, daily doubles, and subscription funds or from
any other betting transactions legally authorized on the racetracks of Puerto Rico.” Federal taxes are not paid on gambling winnings, unlike in the overwhelming majority of the USA.
/Comment: betting against the bank probably means betting against the house, therefore it means betting, wagering, sports betting, it’s just probably incorrectly worded, I have no idea what “gambling winnings obtained in banks” could mean, but according to Puerto Rico Herald****** it means casino gambling, but the article is from 2004 so I ‘m not sure if this is true anymore. They really should rename these, they are really poorly worded. Taxes are not automatically withheld by the gambling establishments./

The 1992 Professional and Amateur Sports Protection Act* (PASP) outlawed sports betting nationwide in an attempt to protect professional and amateur sports against the perceived dangers of sports betting. PASPA barred states that didn’t already have legal sports betting from ever legalizing it. This law effectively gave Nevada a sports gambling monopoly. However, this was declared unconstitutional in 2018, which made it possible for states and territories to legalize sports betting. Puerto Ric took advantage of this and legalized both sports wagering and online sports betting in 2019. However, commercial online sportsbook license are not yet issued, the only form of local online sports betting is online horse racing betting of the Hipódromo Camarero.
Horse and racing betting (and greyhound racing betting) is a different issue when it comes to sports betting. It was already exempt from both PASPA and UIGEA. Horse racing betting and online horse racing betting were legal in the majority of the states and territories, including Puerto Rico ,even before 2018.
Betting on cockfights is also legal in the state. It is a traditional form of entertainment amongst the local populace despite the US federal ban. Cockfighting is so popular in Puerto Rico, that some arenas were actually funded by the government (prior to the US ban) and some of the fights are televised.
