Simon’s Guide to Turkey Gambling & Online Betting Sites

Turkey Gambling Guide

Summary: Gambling is legal in Turkey since 1983 (officially the Republic of Turkey, unlike its neighbours it is a secular state, but its legislative system still bears the traits of Islamic influence in some areas, has a population of 84.3 million, one of the few predominantly Muslim countries with some widespread legal gambling).

Most forms of online gambling are illegal in Turkey since 2007. However, some offshore online gambling websites do accept players from Turkey (they operate outside of the jurisdiction of the country, Turkish gambling laws do not apply to them, contrary to popular belief these are legally operating companies, they just operate under the laws of a different country, detailed explanation below).

Additionally, the sports betting company Sports Toto Organization (a.k.a IDDAA) and its subsidiaries also operate multiple Turkish online betting platforms and the national lottery Millî Piyango İdaresi (operated by ERG-Ahlatçı Oratk Initiative Group) also operate an online lottery platform.

These are currently the only licensed, domestic, Turkish online gambling businesses right now (at the time of writing).

History of Gambling in Turkey - click to expand

Because of the country’s history with Islam (which is still the predominant religion today, and depending on political trends it still has a major influence on the day to day life  of Turkish citizens and governance) the country has a relatively short history with gambling:

1983 – Gambling was first legalized in the Republic of Turkey in 1983 (or 1973, sources differ). The first form of gambling that was legalized was horse racing betting.

/Comment: Not completely clear, according to various sources it’s either 1973 or 1983. And prior to the legalization some casinos already operated, since the 1960s, and they were tolerated.13

I’m going with 1983 as the date of the legalization in this guide./

1990 – Casinos were legalized in Turkey in 1990, the sector exploded almost overnight. It led to the construction of big casino hotels and casino resort complexes. It made Turkey the first Arab country with a thriving casino industry. Initially, casinos were seen as beneficial, casino projects developed the tourism and hospitality sector of the country and generated employment and much needed tax revenue for the government.

1996 – The casino sector underwent a rapid expansion, a veritable casino ‘gold rush’. By 1996 the sector had an estimated yearly turnover of $1bn. And approximately 20,000 people were employed by the newly built casino venues.

/UPDATE 2022: Adjusted to inflation, today that would be almost USD 2 billion, annually, according to 2022 values./

Sadly, it attracted all the seedier elements of contemporary Turkish society as well, namely, organized crime dynasties, corrupt officials, offshore bank accounts.

Because of the involvement of organized crime elements, there were constant issues with money laundering, corruption and tax evasion (through companies registered in offshore tax havens, this is still rampant in the gambling industry today, globally, in fact, it has become ubiquitous to all sectors of the economy). And there were many scandals associated with the fledgling casino sector, which sometimes included leading political figures.

It all culminated in the 1996 assassination of ‘casino king’ Ömer Lütfü Topal1. As a result, casino were banned entirely in 1996.

1998 – It took 2 years to eradicate all of the Turkish casinos.

Despite the ban, some illegally operating gambling establishments remained. They operated as secret private clubs, and because some of the members were wealthy and influential people they remained untouchable all the way up until 2016.

early 2000s – In the early 2000s online gambling was not yet regulated in the country (it was not legal, but it was also not made specifically illegal either, it was a gray area). The gambling legislation, at the time, did not address internet gambling in any capacity. Some companies took advantage of this, and an internet gambling ‘cottage industry’ sprang up.

Many of these online gambling businesses were financed by people who used to be active in the casino sector, and just like in the case of brick & mortar casinos, some of them had ties to organized crime groups as well, allegedly.

/Comment: Not much concrete proof remains of this era, articles about these Turkish online gambling sites are no longer accessible online. There are only a few mentions here and there, in Turkish only of course. There aren’t any good sources anymore, just mentions and rumors./

2007 – To prevent the proliferation of the illegal domestic online gambling sector, the government targeted and banned the unregulated Turkish digital platforms. Online gambling was officially made illegal, except for the state owned gambling companies, which are the only ones, who can engage in internet gambling.

/Comment: No concrete proof that these Turkish online gambling companies moved to Cyprus and are active as Cyprus licensed online gambling companies even to this day.

However, it’s an interesting “coincidence” that the online gambling ban in Turkey coincides with a marked increase in Cyprus licensed online gambling shell companies, which are owned by offshore companies… Makes you think…

Perhaps a journalist, or someone investigating corruption, organized crime in Turkey (and his/her employers allow him/her to investigate this deeply for months), should look into it. As a gambling blogger I have only so much time I can spend on one country, I maintain a database of 196 countries after all./

2016 – In 2016 concentrated attacks, coordinated raids targeted the remaining illegally operating private clubs, finally shutting them down. And since then, only small scale illegal gambling is present in Turkey.

Gambling is legal in Turkey since 1983.

However, only a few forms of strictly state controlled gambling are legal and tolerated since the 1996 casino ban (effective from 1998).

The main pieces of gambling legislation are the Article 228 of the Turkish Criminal Code2 and Law Regarding Roulette, Pinball and Gaming Machines3. According to these acts, games of chance (Şans Oyunları) and betting & wagering (Müşterek Bahis) are illegal by default, only exceptions are granted to the state owned gambling companies.

This strict stance on gambling is a direct result of the 1996 assassination of ‘casino king’ Ömer Lütfü Topal (see above, details are in the history of gambling section), which was a turning point for the gambling industry in Turkey.

Only a few forms of online gambling are legal in Turkey, since 2007, according to the 2006 Regulation on Online Gaming (effective from 2007)12.

This is a direct result of problems with unlicensed domestic online gambling sites in the early 2000s. Since the 2007 online gambling ban only the state owned gambling monopolies can conduct games of chance online.

UPDATE 2022: The state run sports betting company IDDAA takes advantage of this and operates multiple online platform (IDDAA, Nesine, Bilyoner). Additionaly, the national lottery Millî Piyango also sells lottery tickets online.

In 2013 Turkey introduced even stricter laws against the unlicensed offshore online gambling operators, which are becoming increasingly popular in the country, in leu of local alternatives.

Since 2013 many of the bigger offshore online gambling platforms are blocked (but only the biggest seem to be blocked, even to this day, at least in my experience), and financial institutions are instructed to block payments to and from these offshore gambling websites .

/Comment: Players easily circumvent this by using virtual wallets or crypto coins, takes 1 minute to register and create a virtual wallet, this does not really have the deterring effect the government hopes for.

Not to mention, these transactions are rarely blocked, gambling companies have many bank accounts, and they create new ones rapidly and regularly, this blocking is rarely a problem./

The gambling legislation after the 2007 amendment imposes harsher monetary fines and prison sentences on illegal operators.

Additionally, players, who place bets on these unlicensed gambling websites can also be fined. It’s not known how often player are actually fined (if you know, please leave a comment, thank you). I couldn’t find any information about this online, anywhere.

The fines theoretically imposed on illegal operators, those who assist sites in payment processing and media companies advertising or promoting online gambling in Turkey are 100k-500k Turkish lira (US $55k to $278k)4 per person involved in the illegal gambling operation, and 2-3 years of imprisonment for the owners, shareholders and top management.

/Comment: Except, of course, online gambling tied to the state-owned gambling betting and lottery monopoly IDDAA and Millî Piyango, that’s of course perfectly fine. But if private operators do it that’s evil gambling, that weakens the moral fabric of society and it is condemned by the Quran, as many imams and sometimes politicians like to point out…

But if the government does it, that’s okay…. #doublestandards.

It’s obvious the government does not do it to protect the citizens, they do it to protect their gambling monopoly, and their business interests. If I lived in Turkey they probably would have silenced me too, under the charges of “promoting illegal gambling”, btw., they don’t like people telling the truth./

There is no known instance of players, who were prosecuted for playing on unlicensed gambling websites, but that’s also illegal, and the 100k-500k Turkish lira fines theoretically apply as well. This is quite a lot, especially in a country with a median annual income of less than $6k.

/Comment: Which is the median income in the USA and Western Europe per month, for someone with a college degree btw., sad.

Maybe they should focus on this, instead of building and protecting their gambling monopoly? Just a thought… Silly me, thinking about the people, instead of protecting the business interests of my corrupt wealthy friends, I wouldn’t make a good Turkey politician…/

Turkey’s Telecommunications Authority (official name: The Information and Communication Technologies Authority – ICTA, Turkish: Bilgi Teknolojileri ve İletişim Kurumu – BTK)  is responsible for blocking illegal gambling websites, and the Banking Regulation and Supervision Agency is trusted with the prevention of the use of banking services and transactions, including bank and credit cards, for illegal online gaming.

Currently, the only legal forms of gambling in the country are (domestic gambling companies):

/*It’s not real privatisation, the private companies only get the license for 10 years, then it goes back to the state, no permanent ownership exchange whatsoever. So instead of privatization, as it is advertised (for political reasons probably), a better name for it would be ‘public concessions for temporary licenses’./

UPDATE 2022: The ISPs (internet service providers) in Turkey started to block access to unlicensed sports betting websites and bitcoin gambling websites in addition to online casinos as well7.

Despite the fact that all forms of online gambling not owned or controlled by the state are illegal, a few foreign operators accept players from Turkey (you can see them below, they should not be blocked). However, playing on these unlicensed gambling websites is illegal for Turkish citizens, we only include them for the sake of completion and documentation, for legal reasons, we can not recommend using these platforms (except for tourists in Turkey, it’s perfectly fine for them).

To the best of my knowledge no players have been fined so far for using offshore online gambling websites (none that we know of, if you know of anything, heard of someone who received a fine please drop a line in the comments section below).

Some players use VPN for extra safety and anonymity. The government is after the organizers and operators not the players. Nevertheless, when you play online it’s best to use a VPN (virtual private network, a permanent IP mask, plenty of free VPNS available online, 2 minutes registration) and use cryptocurrencies for anonymity, by investing into these extra safety measures there is no way they can track you.

Can tourists play online from Turkey? 

Yes, the laws discussed on this webpage only apply to Turkish citizens, and does not apply to tourists. Tourists (expats, non-citizens, illegal migrants) can play online freely. However, unlicensed foreign gambling websites will be blocked by the internet service providers, and won’t be accessible, while you are using the Turkey internet infrastructure.

 

Betting on blood sports in Turkey

All forms of blood sports are considered animal cruelty8, and are illegal in Turkey. Betting on blood sports is also illegal.

/Comment: Camel wrestling (deve güreşi) is not a blood sport, although injuries are common, it’s also not an officially recognized sport9, but it can be considered a form of animal cruelty (it’s probably not complaint with the recently passed animal rights bill).

Turkish oil wrestling (yağlı güreş) is also not a blood sport, it’s a local version of wrestling, it is an officially recognized sport in Turkey (and a UNESCO recognized cultural heritage). Betting on these wrestling matches is not done officially, none of the domestic bookmakers offer bets on Turkish oil wrestling matches./

 

Despite not having any casino hotels anymore, Turkey still remains one of the most visited countries in the world (the 6th most visited) with 52 million tourists10 visiting per year (pre coronavirus numbers). Turkey gambling license

Turkey for a long time, up until 2017, did not have a single dedicated gambling licensing or regulatory body. The various main forms of gambling all had their own regulatory bodies.

UPDATE: However, since 2017, the Turkey Wealth Fund is now the single dedicated  gambling regulatory and licensing body.

You can find the types of licensee, fees, requirements, info about the process on their website.

/Comment: The following is a list of who was responsible for what type of wagering activity prior to 2017:

  • The Ministry of Finance (lottery, games of chance in general, social gambling)
  • Ministry of Sports ( sports betting, betting in general, except horse racing betting)
  • Ministry of Agriculture (horse racing betting)

It’s not possible for private companies to acquire a license directly, only through public concessions (called “privatization process” usually, it’s a temporary license awarded to a private company to operate a certain gambling monopoly for set period of time). Only the following entities are allowed to organize any sort of gambling activity:

  • National Lottery Administration – lottery, lottery type games, keno, bingo, raffles, social gambling
  • Sports Toto Association – sports betting, and some other types of betting, but not horse racing betting
  • Turkish Jockey Club  – horse racing betting

 

UPDATE 2022: Eventually, the plan is that all types of games of chance will be managed, regulated, licensed by the Turkey Wealth Fund, but it’s a slow process.

Currently the licensing responsibilities of the National Lottery Administration (lottery, lottery type games, keno, bingo, raffles, social gambling) and the Turkish Jockey Club (horse and harness racing betting) were transferred to the Turkey Wealth Fund.

Turkey gambling tax

The gambling tax rates are set by the Law Regarding Taxes, Funds and Public Charges Levied Upon Gaming11, and these are the following:

Sports betting (excluding harness racing betting) 5% gross gambling revenue
Horse racing betting 7% gross gambling revenue
Games of chance (everything else not included in the previous categories) 10% gross gambling revenue

This is on top of all the other, regular taxes (eg.: corporate tax, which is 25%, increased from 22%). Gambling is not VAT exempt, VAT applicable on gambling, betting, wagering activates is 18%.

There is no specific online gambling tax, same tax rates are applicable to online gambling activities as well.

 

For the players, taxation of gambling winnings:

The taxation of gambling winnings is dependent on the of exact kind of activity:

Taxation of gambling winnings in Turkey:
Tax exempt:  winnings from domestic licensed lottery, lottery like gambling (e.g: you bought a scratchcard in Istanbul, you won € 1000, you don’t have to pay any taxes)
winnings from online lottery (e.g.: you bought an online lottery ticket, won € 1000, not taxable)
Taxable: any kind of sports betting, including horse racing betting (e.g: anything that’s sports betting offline or online is taxable, applicable tax rates below)
winnings from any kind of foreign online gambling website (e.g.: you visit an online casino, which accept Turkish players, you win € 1000, that’s taxable, applicable tax rates below)
lottery winnings from foreign lotteries and online lotteries (e.g,: you went on a vacation in Mexico, you bought a lottery ticket, you won € 1000, that’s taxable, applicable tax rates below)

You have to pay the following taxes in case the winnings come from abroad, from foreign gambling websites or from domestic, licensed sports betting websites:

  • Personal income tax: the rate of personal income tax is between 15% to 35%, calculated based on income thresholds announced each year.

 

You have to pay the following taxes in case the winnings are non-cash (items, prizes, membership, property, a vacation, in kind etc…) and come from domestic, licensed gambling companies (IDDAA sports betting , or their subsidiaries):

  • VAT: applicable to non-cash prizes won, the rate of VAT in this case is 18%.
  • Special consumption tax on non-cash prizes won in games, bets, lotteries and raffles: it’s complicated, the rate of special consumption varies by the type of the non-cash prize, all types are taxed differently, an accountant will know how each type is taxed.
  • Inheritance tax:  non-cash prizes won are subject to a 20% inheritance tax.

 

As you can see it’s very complicated, it’s best if you contact a certified personal accountant (CPA) to help with your gambling taxation.

Other:

Social gambling is considered gambling in Turkey (and probably social casinos too, there is a detailed explanation about the legal status of social casinos in the comments section, at the bottom of the page). In fact, it’s one of the few countries, where this is directly mentioned and regulated in the applicable parts of the gambling legislation.

Social casinos need to be approved by the Ministry of Finance.

Loot boxes and other gambling like activities with virtual goods and services (e.g.: skin gambling) are not yet regulated, but considering the propensity of the Turkey government to control all forms of gambling, it’s only a matter of time that they will be.

Fantasy sports betting is not yet regulated11.

/Context: Arab countries (e.g.: Egypt, Libya, Qatar, United Arab Emirates) barely have a few casinos (compared to their population size and wealth), and the few they have are only available to tourists, locals are not allowed to enter. That’s why Turkey’s casino experiment was so important.

And because it failed, it cemented the current stance towards casino gambling in the Arabian Peninsula, and made talks about liberalization in other Middle Eastern countries unfeasible./

Much of the casino gambling went underground after the ban. Even though the state put serious efforts into enforcing the laws in this area, various casino clubs manged to operate semi-secretly for a long time (because some of the members were wealthy and/or well-connected people).

This culminated in concentrated raids in 2016, which put an end to large scale illegal casino gambling in the country. Nowadays, the former Turkish casino operators and everyone who was active in the gambling sector moved their interests, involvements and investments (and corruption and organized crime involvement as well…) to Northern Cyprus (The Turkey controlled half of Cyprus), which is widely known as the casino playground of Turkey, and it is visited by many Turkish and Arab tourists looking to gamble.

The ban was so comprehensive that even the possession of gambling machines and tables are prohibited as well, according to Law on Roulette, Tilt, Pinball and Similar Game Tools and Machines (Law No. 1072)*. Sadly this includes pinball machines as well, that’s why you don’t see any pinball machines in pubs in Turkey, they are also illegal.

In the early 2000s online gambling was not yet regulated in the country. The gambling legislation, at the time, did not address internet gambling in any capacity. Some companies took advantage of this, and an internet gambling ‘cottage industry’ sprang up.

The first form of sports betting that was legalized in 1983 was horse racing betting on the state-run race tracks of the country.

Horse racing is still somewhat popular in Turkey and betting on races is still prevalent, even though the total takeout rate is a stunning 50% (highest in the world).

/Comment: The Jockey Club of Turkey, the organisation conducting all the races is taking a 22% cut from all wagers and the government takes another about 28%, in the form of taxes./

Despite all of this, Turks wagered the Turkish Lira equivalent of $1.49 billion on horse races in 2012*, but it’s a shrinking sector.

The fact that the government privatised Sports Toto for $10 billion, along with the Horse Racing Authority shows just how profitable these operations are (10 year licence to organize sports betting and horse racing betting by private companies, after that ownership reverts back to the state, similarly to the lottery, see below).

Online sports betting is also legal.

Only the licensed Turkish sportsbooks Sports Toto, the Horse Racing Authority, their private operators and their online platforms ate allowed to accept bets on sports over the internet legally.

Betting on unlicensed foreign platforms is illegal, and it is a huge problem for the government and their gambling monopolies (takes away business from them, outcompetes them). Many of the big foreign digital bookmakers are blocked, although most aren’t, and even the few which are blocked are easily accessible by using a VPN.

    Hi very interesting article ever found! While just wondering, I see also many online gaming such as poker and card betting within which coins are used instead of cash, and the coins are only one way convertible, meaning that I can use cash to buy more coins, while the coins bought or earned through winning will always be coins for further playing, that cannnot be convertied into cash again. In this way, am I also gambling? Or, do I violate any law or regulation against the Turkish authority? I wanna make sure that suck kind of online gaming is legal and safe in Turkey, even if til now no plice knock at my door…….

      I agree with you, it’s best to be safe, good choice.

      Back to your question: Yes, those are called “social casinos” in the gambling sector (from the legal term “social gambling”, which has nothing to do with social networks, it is small stakes gambling among friends that is usually legal and not punished, but not in Turkey, social gambling is also illegal in Turkey). I have seen them too online. You can buy coins with money, but coins are not exchangeable back into money, they are all over Facebook. It’s a legal loophole, and because they are a good source of advertisement revenue, they are tolerated on most websites, social networks. It all depends on how bets, coins, tokens are defined in the gambling legislation. However, in most countries where gambling is illegal, that is not specifically, or sufficiently defined. And to the best of my knowledge, it is not specifically defined by the Turkish legislation as well.

      This is a though question. In short: it’s probably technically illegal, operators, companies engaging in the activity in Turkey would get into trouble (all social casinos are foreign websites, not registered in Turkey), but players would not be prosecuted or fined.

      Details: In my opinion, according to the Criminal Code of Turkey:

      “(4) In the implementation of the Criminal Code, gambling shall be defined as a game
      undertaken with the aim of earning money, where the profit and loss depends upon
      chance.”

      And in my opinion, keep in mind, this is in no way the official stance of the Turkish government, only my interpretation of the law, this does not include social casinos, because there is no way to make a profit, tokens are not exchangeable back into money (but they make a profit from your purchases of the coins, see, not easy, which one, probably depends on the judge).

      HOWEVER! It also says:

      “(1) Any person who provides an environment or the means for gambling shall be sentenced
      to a penalty of imprisonment for a term of up to one year and a judicial fine.
      (2) The penalty to be imposed shall be increased by one fold where an environment or
      means is provided for children in order to gamble.”

      And the intent of social casinos are very clear, it’s obviously gambling, these companies attract a lot of investments because it’s obviously a legal loophole, allowing gambling (this is a similar situation to fantasy sports betting in the US btw.). Therefore, I would say operators In Turkey would probably be fined, prosecuted, and it’s technically illegal. Not to mention! They allow children, minors under 18, to register! Which is a big violation according to the Criminal Code.

      Notice how it is actually worded “Any person who provides an environment or the means for gambling” (not mentioned, but obviously includes companies too) so not the players. Therefore, I would say it’s technically illegal, operators are committing a crime, but players would not be fined or prosecuted, but it’s best to avoid it, because it’s most probably illegal.

      Also, Law on Roulette, Tilt, Pinball and Similar Game Tools and Machines (Law No. 1072) says that even machines which are not expressly banned, but include an element of chance are considered illegal gambling machines.

      So, an element of chance is all that is needed in case of machines, and social casinos definitely have an element of chance + combined with the fact that social gambling is illegal in Turkey, unless specifically approved by the Ministry of Finance, it’s clear to me that social casinos would be seen as a a form of gambling. However, this is only my interpretation, it’s not specifically regulated or addressed by the government to the best of my knowledge.
