Gambling and online gambling are legal in Romania. The National Gambling Office is the regulatory body trusted with controlling and overseeing the gambling industry. A Committee inside the Gambling Office is responsible for issuing gambling licenses to both online and offline operators.
Government Emergency Ordinance no. 77/2009* on the organisation and operation of gambling activities is the central piece of legislation pertaining to gambling. The law was amended in 2013 (Government Emergency Ordinance no. 20/2013)**. The amendment laid down the functions of The National Gambling Office.
Gambling activities which are eligible for a licence under Romanian law are the following:
- lottery games – monopoly of the national lottery company “Loteria Romana”)
- betting
- casino gambling
- poker
- slot machines-gaming machines – (includes slot machines, video lotteries, AWP machines)
- bingo
- bingo on TV
- online casino-type games (includes slots as well)
- online bingo and online keno games
- tombola – defined as the activity of drawing numbers, letters or other symbols, regardless of the characteristics of the equipment used to make the draw
- any other type of gambling games – including new games or combinations of games mentioned above
- temporary gambling games – for a period of three months, temporary casinos in tourist resorts or cruise ships
Foreign online gambling operators that do not hold a Romanian gambling licence cannot offer their services to residents. The government has also taken measures to make these sites unavailable to Romanians – currently, 1300+ unlicensed international gambling sites are known to be blocked by the internet service providers upon request of the authorities in Romania (in comparison, there are only 25 approved online gambling websites, as you can see the foreign operators are not very eager to get a Romanian gambling license, you have to force them, this is typical for every country, not just Romania, you can see some of these approved operators below).
The law also mentions a minor fine to be imposed on players who gamble in unlicensed gambling venues or on sites of unlicensed operators on the internet.*** However, laws like this are very difficult to enforce internationally and on the level of individual players. Although it is technically illegal for them to do so, the chances of a Romanian player being prosecuted for placing bets with unlicensed online platforms are virtually non existent. Still ,we definitely do not recommend playing on unlicensed online gambling websites. The online gambling websites below all accept Romanian players and are all licensed.
Romania gambling licenses
The gambling licensing system in place in Romania is very simple and easy to understand (other countries could learn from this, this is really not the norm…). There are only two types of licenses. Class 1 and Class 2.
- Class 1 gambling licence: allows the company to organize any of the legally allowed forms of gambling in terrestrial, land-based form (no online gambling).
- Class 2 gambling licence: this is the online gambling license, with it your company is allowed to organize all the legal and allowed types and forms of games of chance online, on the phone, SMS, or using other means of telecommunication.
Only operators based within Romania, the EU, EEA or the Swiss Confederation can apply for a Class 1 or 2 licences and authorisations. Online gambling websites which have been blacklisted prior to application can not apply for a Class 2 online gambling licence (this is a fantastic idea btw., other countries could learn from this too, works better than forcing ISPs to block unlicensed websites, but can be used in tandem as well).
Romania gambling tax
Land-based:
In Romania the gambling tax is hidden, and it is called “administrative fee”, “authorisation fee”, “licensing fee”. I hate his kind of taxation paradigm. I like it when they are straightforward and tell you that you have to give us x% of your revenue instead of forcing companies, accountants to do extra work, to go through burdensome, often hastily and weirdly put together gambling legislation, regulations to decipher what they have to pay the state. Dumb, unnecessary extra bureaucratic burden, and increases opportunities for error, increasing overhead on both sides. Keep in mind the taxes below are paid on top of the high corporate tax (16%, actually considered average in the EU, only moderately high by international standards):
- Land-based operators of casino or poker clubs must charge an entrance fee for each player (EUR10 for a casino and EUR6 for any other type of gambling establishment).
- fixed-odds betting: 16% of total revenue (but not less than EUR90,000)
- casino games: EUR60,000 per table in Bucharest and EUR30,000 per table in any other Romanian city. For unlimited winnings slot machines the authorisation fee is EUR2,600 per machine, while for AWP machines (pachinko and coin games fall under this category too) it is EUR1,500 per year.
- EUR400 per year per slot machine or video lottery terminal.
Online gambling:
- 16% of the total revenue.
- Online gambling companies must pay taxes on the winnings of their players (because it’s based on the individual tax situation of player, their income, their country of origin, etc., it’s not a set %). This is fantastic idea, because online gambling companies never pay taxes after the winnings of their players and simply say “it’s their job, we wash our hands”, but players never do (99.9% of them don’t even know they have to).
Gambling winnings are not subject to taxation if they are from Romanian online gambling companies or from foreign companies who have a Romanian gambling license. In every other case you must pay taxes on your winnings (rarely enforced, but if you win a really big amount contact an accountant, otherwise they might fine you and you have to pay back-taxes + huge fine, not fun, speaking from experience).
Other:
Social gambling is not considered gambling in Romania. ‘Loot boxes’ or similar video game features are not regulated yet (however, in many other EU countries they are already classified as gambling, probably they will be classified as such, eventually, in Romania as well).

Online bingo in Romania: legal, licence required
In Romania, bingo operators , both online and offline are eligible for a gambling licence (and even TV bingo is possible). There are brick and mortar bingo halls in the country but thee are no online bingo websites. The national lottery Loteria Română doesn’t have any real bingo games (some are like bingo, but not real bingo) but there is a substandard, low quality TV bingo on Kanal D called Bingo Romania. Their website bingo-romania.ro doesn’t even work anymore…., and therefore I can’t tell whether this is online bingo or just TV bingo (if you know please drop a comment). Land based poker is legal and licensed in Romania. Lottery in Romania
Online lottery in Romania: legal, state monopoly
Lottery games constitute a state monopoly in Romania. Online and offline lottery games can only be offered legally by the national lottery company Loteria Romana. However, they do not appear to have an online platform that would sell lottery tickets online at the time of writing (, which makes Romania one of the last European countries that doesn’t have an online lottery). Which is quite a missed opportunity. Most – as much as 80% – of the European lotteries already operate an online platform. The website of Loteria Română is also the ugliest lottery website in all of Europe, it actually looks abandoned and neglected. Despite them being a monopoly, and them making a significant amount of money, it’s surprising that they don’t have a a decent web presence or an online platform in 2020. Bad optics.

Romania finally started accepting bitcoin and other cryptocurrencies as legally accepted currencies within the country in 2019.* It’s not yet entirely recognized, and doubtless that it will ever be recognize fully as a legal tender, but right now it is classified as “virtual currency” in some situations, which is good enough (sadly it also means it is taxable).
