Ancient times – Gambling in Malta goes back to ancient times, and even though the exact dates are not known, the traditional Maltese game Ic-Cippitatu is quite possibly from the era of Ancient Rome. Back then it was a form of gambling, not a game for children, as it is today.

1922 – The first written historical evidence of games of chance in Malta is the 1922 Lotto Act. It was created to formally legalize and regulate the lotto in Malta (the predecessor of Maltco).

20th century – After 1922, during the 20th century, more and more types of games of chance were legalized and regulated, including sports betting, poker, bingo, lottery and of course casinos. At this point all main forms of gambling are legal in Malta.

2004 – Malta joins the EU, and online gambling was officially legalized. Coupled with the low taxes, this proved very attractive to online gambling companies, who relocated to Malta en masse. This is when Malta started to become an online gambling licensing hub.

2017 – Journalist Daphne Caruana Galizia was murdered for anti-corruption work exposing money laundering, organized crime connections in the gambling sector of Malta. This started an avalanche of corruption allegations, lawsuits, and an EU investigation. This has resulted in the European Union declaring Malta a ’cause for concern’ in 2020 (details below), and the Financial Action Task Force (FATF) also put Malta on the list of countries, which need ‘enhanced monitoring’ (context: Central American, Caribbean countries and African countries are on this list mostly).

The effects of this assassination are felt even to this day, and they will have far reaching repercussions to the Maltese gaming sector.

Gambling is legal in Malta since 1922. The main piece of the gambling legislation is the Gaming Act1, and its amendments.

The gambling legislation sorts games of chance into 4 distinct types:

  • Type 1 gaming: games of pure chance, played against the house, the outcome is determined randomly (e.g.: casino games)
  • Type 2 gaming: games of chance and skill and betting, played against the house, not entirely random, determined by the result of an event or competition extraneous to the game, and by which the operator manages its own risk by managing the odds offered to the player (e.g: sports betting)
  • Type 3 gaming: games of chance not played against the house, the operator is not exposed to gaming risk, generates revenue by taking a commission or charging a fee (e.g.: poker tournament)
  • Type 4 gaming: controlled skill games, results determined by aggregated statistical performance (e.g.: fantasy sports betting)

 

The Malta Gaming Authority (MGA) regulates and governs all types of gambling activities and issues licences in accordance with the legislation.

There are currently 4 land-based casinos operating within Malta (which is quite a a lot for such a small country), the casinos rely heavily on the tourists visiting the island (2 million visitors per year2, pre-coronavirus numbers).

Online gambling is also legal in Malta, since 2004. The country was the first European Union member state to regulate online betting.

Malta is actually one of the online gambling hubs of the world, because of the favourable tax rates (it’s a tax haven), the good reputation of the gambling license, and because it is part of the EU. There are almost 300 online gambling companies licensed in Malta.

Malta and EU gambling laws: Because Malta is an EU country Article 56 TFEU3 and Article 8 of Directive 98/34/EC (EU gambling directives) apply.

UPDATE 2023: The European Union designated Malta as a ’cause for concern’ regarding organized crime and money laundering, and the MGA is being accused of being complicit in RaiseBet24.com laundering $74.2 million for the Cosa Nostra (allegedly, not yet proven, Cosa Nostra is the Italian mafia)4.

In addition the Financial Action Task Force (FATF) also put Malta on the list of countries, which need ‘enhanced monitoring’.

This all happened in the wake of the 2017 assassination of Daphne Caruana Galizia, an anti-corruption journalist, involved with the Panama Papers (biggest data leak of the worst offshore tax haven Panama, with many politicians, celebrities and big companies implicated, including the Maltese “elite”).

Some claim she was murdered for getting too close to the truth about money laundering and the organized crime connections of the Malta Gambling Authority, secret offshore accounts in Panama (#panampapers), Italian mafia, and the island’s elite (I don’t claim to be an expert in Maltese politics, her work is expansive, detailed and with far reaching implications, sources down below, you can make up your own mind).

/Comment: She was pretty much proven right by the assassination. Her life and work is worth a read. She has her own Wikipedia page now, probably much to the dismay of the people who ordered her assassination5. She has become a celebrity and a martyr,  and her death resulted in the EU and FATF both starting an investigation. /

Disclaimer: The MGA denies all of these allegations and none of them have been proven yet6.

Nevertheless, this will likely prove very harmful to the online gambling hub, and it will probably lead to the exodus of many of the biggest gambling companies.

There are two major types of licenses available in Malta, these are:

Malta gambling tax

The gambling tax payable depends on the type of the gambling activity (you can see the explanation of the various types above, at the top of the page) and it is determined by the Gaming Tax Regulations Act9.

This is a progressive taxation system, but unlike most other progressive gambling tax regimes, the rates actually decrease, the higher the revenue of a company gets.

The tax base is gross gaming revenue per year.

There is one exception, if the activity in question is generated by players from Malta, in that case the tax rate is a flat 5%. The purpose of this is to motivate companies to grow internationally, instead of targeting local players.

Even though the corporate tax of Malta is 35%, which is one of the highest in the EU, there are ways to reduce this to 5%, which is effective corporate tax rate all the gambling companies pay8.
