Gambling is legal in the Democratic Republic of the Congo, since 1927, according to the 17 August 1927 decree legalizing lottery1.
Initially only lottery was authorized but over time all the main forms of gambling were legalized as well. According to Prof. Dr. Joseph Yav Katshung from Yav & Associates Congolese law firm2 the following forms of games of chance are legal:
[Sic]“opening, managing, operating or consulting casinos, gambling halls or any other business relating to games, machines, lotteries or other games of chance; online gaming; Sports Betting; all other gaming activities which are not prohibited in DRC”[/Sic]A company, which wishes to conduct games of chance in the territory of the DRC must acquire a gambling licence from the Ministry of Finance (details of the Congo licensing process, fees and requirements can be found below in the Congo gambling licensing section).
/Interesting fact: Majority Christian, formerly French colonies in Africa, e.g.: Guinea, Ivory Coast, Niger, Benin and the DRC have all legalized gambling over time, but former French colonies, which are predominantly Muslim usually penalize games of chance, e.g: Morocco, Algeria. Libya (there are exceptions though e.g.: Djibouti, Egypt, but the cultural divide is very obvious and interesting)./
The Democratic Republic of the Congo also welcomes foreign investment with a rather lax regulatory framework. This makes it easy to create Congolese companies and this might attract investment and may prove enticing to international gambling companies, despite the country’s poverty, infamy, political instability, extreme levels of corruptions and political cronyism.
Despite the size of the population (92 million) the Congolese gambling sector is rather underdeveloped and there are currently only 4 larger casinos operating in country, as well as several smaller gambling venues (a.k.a. slot halls), where only slot machines are available.
The country also has its own national lottery, the Société National de Loterie (SONAL).
Online gambling is also legal in the Democratic Republic of the Congo since 2011, according to Ministerial order number 041/MJS/CAB/2100/2011 of 28 December 2011 organising hobbies in Congo3.
This is quite surprising, seeing as the internet penetration in the country is only 23.2%5 (although it is rapidly growing, it was only 5% in 2015).
