Online casinos in Canada

Legal status of online casino gambling in Canada: only legal in the following provinces: British Columbia, Quebec, Ontario, Manitoba (with inter-province agreement), Alberta, visiting foreign online casinos is technically illegal, but players are not prosecuted, Kahnawake (First Nations) licensed online casinos are legally accessible in every province

 

Canadian law pertaining to online gambling and online casinos is somewhat complicated. This is due to the country’s political system. Canada is divided into 10 provinces (Alberta, British Columbia, Manitoba, New Brunswick, Newfoundland and Labrador, Nova Scotia, Ontario, Prince Edward Island, Quebec and Saskatchewan) and three territories (Northwest Territories, Nunavut and Yukon), you can see a detailed province by province breakdown below.

Traditionally, gambling and casinos in Canada fall under provincial jurisdiction, which means that each province is able to decide to whether to ban or allow online casinos. According to the Criminal Code of Canada*, online gambling is illegal, except if it is made legal on a provincial level, or by a First Nations’s tribe, according to the Constitution Act, 1982**.

Online gambling is not very well regulated in Canada by the provinces (it was only made legal in 5 provinces, not regulated in the rest, therefore technically illegal in all 8 of them). However, one of the First Nations tribes, the Mohawk Council of Kahnawake, licenses online casinos. All of them can legally accept Canadian players from every province (the online casinos below are either Kahnawake licensed, or are partnered with a Kahnawake online casino).

The provinces that do have online casinos in Canada (British Columbia, Quebec, Ontario, Alberta) do not issue licenses to private companies, they either have their own state-controlled (in partnership with a private company) online casinos, or the local state-owned lottery company is tasked with this. It’s strictly controlled, and online casino gambling is a monopoly of the state in most provinces, for now (there are talks of privatizing the online casino market in Ontario very soon******). These online casino can only accept players from the provinces in which they operate in, except, if they sign a so called inter-provincial treaty with another province (exceedingly rare, but that is the case with Manitoba, details below).

These state owned online casinos are significantly lower quality than the bigger international brands below (just like with everything else, private companies are always better than state owned companies, which are always worse, because of the usual things: politics influencing business, political appointees without relevant experience and talent, lazy management that doesn’t know what they are doing, extreme bureaucracy slowing down everything, corruption, and neglect that characterizes all state owned, controlled companies, this all leads to a subpar online casino gambling experience), and that is why I do not recommend these online casinos.

In order to legally accept players from Canada, an online casino needs to be licenced in one of the provinces (as we discussed above, that is not possible, the few provincial governments that have legalized online casinos do not issue licenses to private companies), or have a licence from a First Nations tribe (only the Kahnawake Gaming Commission issues online gambling licenses, the rest only licenses land-based gambling establishments). Therefore, only Kahnawake licensed online casinos ( you can find these online casino below), or the state-owned online casinos operate legally. Everything else is illegal for Canadian citizens, and we suggest staying away from unlicensed online casinos (although, they are not blocked, and players are not prosecuted at all, for now).

Online casinos which operate illegally are prosecuted ever since 1999, but only if they have a physical branch in the country. The legal precedent for this was the case with Starnet Communcations over a decade ago (in 1999), which was charged with conducting unlawful online gambling operations***. Sadly, offshore operations are left alone, and many Canadian players visit unlicensed online gambling websites illegally. This will most probably result in either blocking (e.g.: USA) or players being fined (e.g.: Poland) eventually.

 

Can tourists play in online casinos while visiting Canada?

Yes.

First Nations Online Casino Gambling Canada

 

First Nations***** gambling is a politically sensitive topic in Canada.  First nations tribes (if the tribe is of the necessary size, and they have provided proof of their ancestry, claims, and have made the necessary legal steps) can also pass their own online gambling laws according to the Constitution Act**, but not many of them have done so. The only tribe doing this, that I’m aware of, is the Mohawk Council of Kahnawake (you can see the details here, Regulations Concerning Interactive Gambling****, if you know of any other tribe that would issue online gambling licenses, please let me know, drop a line in the comments section). The Kahnawake Gaming Commission is actually a thorn in the side of the Canadian gambling system, at the very least, when it comes to online gambling.

At this point, there are at least 250 online casinos licensed by the Kahnawake Gaming Commission (the online casinos below are also licensed there, or are partnered with companies licensed there), and these online casinos are the only privately owned online casinos that can legally accept players from Canada, even from the provinces where online casinos are illegal.

It’s clear that the government of Canada doesn’t want private businesses to be present in the online casino gambling segment, and only allows state-owned (or at the very least state controlled) online casinos to operate. This is the only exception. A similar situation can be observed in the USA, where Native American tribes also have the power to legislate for themselves when it comes to games of chance.

Land-based Canadian casinos

Casinos in Canada are also operated by Indigenous American tribes, generally referred to as First Nations. With some degree of autonomy under so-called First Nation Governments, they are much like the Indian reservations of the USA. These communities – just like their US counterparts – sometimes operate casinos and other gambling venues.

In fact First Nations dominate the casino industry of Canada, out of the 82 casinos, 25 are operated by the tribes, which is 30% of all the casinos, while the Indigenous Peoples only make up about 4.9% of the population.

River Cree Resort & Casino, – currently the biggest Alberta casino, the biggest since 2006, address: 300 Lapotac Boulevard, Edmonton, AB T7X 3Y3 

River Cree Resort & Casino opened in 2006, at that time, it was Alberta’s first Indian casino. The project cost an estimated $178 million. Therefore, it is unsurprising that the casinos is still, to this date, the biggest casino in Alberta, and the second biggest First Nations casino in all of Canada (and fourth biggest casinos). The casino has 1350 slots, 40 tables (blackjack, roulette, ultimate texas hold’em, three card poker, chase the flush*, and craps)

Interestingly, the casino has the most baccarat tables in North America, 26 baccarat tables.

Casino NB (opened in May 2010) is currently owned by the Great Canadian Gaming company (changed hands in 2015), and it is New Brunswick’s biggest casino. The gaming venue has 600 slots. They have 26 tables (3 card poker, baccarat, craps, Let It Ride, poker, 5 tables of roulette – not known what type, but probably American, ultimate texas hold’em), and they have a dedicated poker room.

Dress code: their website claims that “Dress code is in effect.” but there is absolutely no info about the dress code on their website. Really annoying, it’s a big oversight. There is no official information anywhere about the dress code, but based on customer reviews, there is no actual dress code, despite what they claim, or it’s not enforced. People dressed very casually are able to enter the casino without any problem.

Casino Woodbine, adress: 555 Rexdale Blvd, Etobicoke, ON M9W 5L1

Partially state owned (by the Ontario Lottery company) this huge racetrack and casino is the biggest gambling establishment in all of Ontario. They have about 3000 gaming machines (2800 slots, 200 electronic table games – casino war, blackjack, baccarat, three card poker). They have 100 tables (american roulette, blackjack, Mississippi stud, baccarat), and of course, betting on horse racing.

Interestingly, for a very long time, there were no live dealer tables, due to legal issues (the province refused to grant them a table games licence), and there were only electronic tables, which meant that technically they were not casino, just a huge slot parlour. However, the issue has been resolved since. Still, many (actually most) casino listing sites still list them as such, without table games, erroneously.

In operations since 1993, Canada’s biggest casino (owned by the Société des casinos du Québec, a subsidiary of the Quebec lottery company) has 3000 slots (all sorts of brands, ranging from classic, mechanical reels to new, best of class, 4D interactive video slots). The establishments also has 115 tables (baccarat, blackjack switch, Spanish 21, Zappit blackjack, texas hold’em, three card poker, Caribbean stud poker, Let It Ride, Pai Gow, Casino War, Craps, Sic Bo), and Wheel of Fortune. The Klondike Visitors Association operates Yukon’s first and only casino with a special gambling licence from the Government of Canada, called Diamond Tooth Gertie’s Gambling Hall (it’s Canada’s oldest casino actually). Additional casino licenses are not issued.

Canada’s oldest (since 1971) and Yukon’s only casino (has a special license, casino licenses are not issued otherwise).  The venue is state owned, by the Klondike Visitors Association. It’s a small casino with 64 slots, 6 tables (blackjack, roulette, red dog*), money wheel, 3 poker tables. Unlike in most Canadian casinos, there is an entrance fee of $12.
