Guide to Bulgaria Online Gambling
| Summary: Gambling is legal in Bulgaria since 1957 (officially the Republic of Bulgaria, a poorer Eastern European country, with a population of 7 million, member of the EU), according to the Gambling Act of 20121 (and its amendments), which is the currently main piece of the gambling legislation.
Gambling operators who wish to offer services to Bulgarian players must acquire a licence, and pay the fee and taxes associated with operating legally within the country. Gambling establishments need to obtain a license.Online gambling is also legal in Bulgaria since 2008, but it was only properly regulated in 2012. History of gambling in Bulgaria: Gambling in Bulgaria was not properly regulated until 1993 as in most Eastern European countries formerly under Soviet rule.
However, unlike in most countries, which were part of the Soviet block (e.g.: Serbia, Slovakia, Hungary, Poland, Ukraine etc..), gambling was not illegal in Bulgaria (back then the People’s Republic of Bulgaria) for various sociopolitical reasons.
19th century – The first written record of any sort of gambling regulation is actually a gambling ban from the end of the 19th century, which shows that back than there were serious issues with illegal gambling.
Early 20th – Nevertheless, despite the ban, gambling establishment kept popping up in the bigger cites (back then Bulgaria was very corrupt, more so than today, the gambling ban was largely ignored, the involvement of organized crime in the gambling sector was pervasive, which is still an issue even today). These early gambling establishments were usually pubs that acted as card clubs, and backgammon, barbooth (virtually unheard of today) and illegal sports betting were the main activates.
1957 – The Bulgarian Sports Totalizator, the lottery, sports betting and bingo monopoly of Bulgaria was established. These were the first forms of gambling to be made officially legal since the 09th century gambling ban.
1979 – The first casino of Bulgaria, Vitosha (no longer in operation) opened. However casinos were only open to tourists, and until 1993 locals were forbidden to enter.
1993 – The start of the modern gambling legislation of Bulgaria, and many changes were made to the gambling sector, and much needed anti money laundering laws were introduced too (although they were not fully in force until 1998).
Casinos were made available to locals as well. Licensing system was overhauled.
2008 – The legalization of internet gambling started.
Bulgaria is a member of the EU, therefore EU gambling laws, directives apply too, most importantly Article 56 of TFEU2.
Unlicensed operators are blacklisted, and the list has been growing ever since, currently consisting of over 800 sites.
Blacklisted sites are blocked by internet service providers within the country, only licensed, legally operating online gambling websites are accessible (you can see a list of licensed online gambling sites below).
The main reason for the legalization of online gambling was the expected tax revenue from online gambling operators. However, foreign gambling companies were reluctant to invest in a Bulgarian gambling license because of the taxes and high fees.
Realising their error, the Bulgarian parliament opted to amend the gambling law in 2013. Since then, operators are required to pay a one-time licensing fee of about €50 000, and the tax on turnover has been changed to 20% of gross gaming revenue.
The lower taxes have prompted several online gambling operators (the bigger ones, you can see them below, in the list) to apply for a Bulgarian gambling licence.
/Comment: 20% is still pretty high by international standards, but it’s below average by European standards. Keep in mind, these unlicensed online gambling sites paid zero taxes, and prior to 2012 100% of the internet gambling platforms were unlicensed. They weren’t exactly keen on getting a license even with the lowered taxes but it did help./
UPDATE 2021: The Bulgarian National Revenue Agency (Национална агенция за приходите на Република България) has replaced the State Commission on Gambling, and it is the new regulatory and licensing agency (the details of the licensing process, requirements and fees can be seen below).
The State Commission on Gambling was abolished amid a corruption scandal involving the chairman of the Gambling Commission Alexander Georgiev and Vasil Bozhkov (richest person of Bulgaria), who owns many Bulgarian casinos, slot halls and online gambling sites, and he is suspected to have close ties with the Bulgarian mafia3.

Betting on blood sports in Bulgaria
All forms of blood sports are considered animal cruelty, and are illegal in Bulgaria. Betting on blood sports is also illegal.

Can tourists play online while visiting Bulgaria?
Yes, the online gambling laws of most countries, including Bulgaria, only apply to citizens and lawful permanent residents, if you are a tourist (or a non-citizen expat, or illegal), you can play online freely while enjoying your stay.

Gambling licenses are issued by the Bulgarian National Revenue Agency (Национална агенция за приходите на Република България), which has replaced the State Commission on Gambling, and it is the new regulatory and licensing agency.

- The company must be an must be an EU company (eg, Gibraltar no longer qualifies), doesn’t have to be a Bulgarian company
- the company must have at least BGN (Bulgarian lev) 1.5 m (around $1 million, € 780 K) capital
- the applicant must not have been found in breach of the Gambling Act at any time prior to application (this excludes unlicensed online gambling platforms, which accept players from Bulgaria illegally)
- only casino software that is housed on servers in the EU are accepted
- all official bank accounts of the company must be handled by EU banks, which are also active in Bulgaria
- the central computer systems must be able to register and identify the players and be connected to the servers of the National Revenue Agency to provide real-time information on the games played, the bets made and the prizes paid
- the gaming software and any updates must be approved by the NRA
- post-approval, the applicant must invest BGN 1 m (approx. € 511 K) within 6 months of licensing
- the regulatory agency must be provided with information about the sources of these funds
Key personnel can not be:

convicted of a crime, especially crimes against the financial, tax or social security systems,

declared insolvent in the last three years,

found to have overdue public liabilities.
