Gambling in the Czech Republic

 

Gambling is legal in the Czech Republic, and there is an abundance of casinos and other gambling establishments to be found in this Central European country since 2012 (between 2009 and 2012 there were only 5 casinos). Online gambling is also legal in the Czech Republic and it is governed by the 2016 law on interactive gambling. However, the legal status of various forms of gambling (especially online gambling) in the Czech Republic can be rather confusing, and the efficacy of gambling laws is often questioned. The gambling regulation in effect is the 1990 law on lotteries and other similar games, and amendments thereof.

Currently there are about a hundred casinos in the Czech Republic (big casinos with tables, card games and also smaller establishments, which are basically pubs with slot machines, both are considered casinos and require the same gambling licence in the country), most of them situated in or near the country’s capital, Prague. There are also several brick and mortar betting shops in the country and a national lottery. To summarize, land-based gambling is a thriving in the Czech Republic, despite the high taxes and the issues surrounding the licenses.

The Czech government has realised that the gambling regulations in effect are insufficient to deal with current issues in gambling, especially online gambling. A law on digital gambling – technically a new version of the 1990 Law on Lotteries and other similar Games – was introduced in 2012 and new one, the law on interactive gambling in 2016. In accordance with this current law, a physical presence and purely Czech ownership is required for online gambling operators.* However, as the Czech Republic is a member of the European Union, and the restriction was found to be contrary to EU policies, the government currently does not block access to gambling websites licensed in other EU countries, even if they don’t have a local gambling licence.

Since then, the government focused on gambling taxes. Right now the gambling tax in the Republic is a 23% tax on gross winnings, except gaming machines (slots and video poker), which are at 35% tax, this is in addition to the 19% corporate income tax within the country.** Taxes on gambling has been set rather high, but it’s only paid on the winnings of the casino, which is in my opinion the right way to go about it.  It’s a tax on the gross winnings of the casino, when the player loses, it’s a nice way to gauge the actual performance, the actual taxable income of a gambling establishment (because it is always possible that someone wins big, really big, or that many people have won in month, more players than who have lost, in an establishment, that in itself is already quite taxing for a casino, a few months like that can put smaller establishments out of business). A tax on total gambling income would be much more disadvantageous for a casino.

UPDATE: The country was full of slot machines and video poker machines, which were serviced by a various companies with gambling licenses to circumvent the law (the establishments didn’t have licenses only the companies who put the slot machines there). But since 2019 the establishments where such machines are placed need to have a gambling license too. So in the last few years all the slot machines from various pubs, grocery stores, cafés disappeared. In addition 457 Czech municipalities implemented a total ban on gambling, including Prague’s 2. district, which includes Vyšehrad and parts of Vinohrady, New Town and Nusle. The number of municipalities which ban gambling entirely is on the rise, a significantly increase.

UPDATE 2: The Czech Republic has introduced new restrictions for online gambling bonuses and free bet offers. Online operators, any gambling website licensed in the country can no longer offer any bonuses, promotions or free bets, free spins anymore. Because of this even foreign online casinos licensed in other EU countries often don’t allow Czech players to take advantage of their promotions. At this point, because of this dumb law, I suggest avoiding locally licensed gambling websites entirely. And this is only the begging, The F-2-F verification is even worse, see below.

In accordance with the 2016 gambling law, there are currently 5 online gambling operators including the state-run Sazka, very few. The biggest reason for the horrendous performance of the online segment is the moronic face-to-face verification required by the state, this is the only country in the whole world, where you can’t verify your identity online. You have to do the following to be able to play online in any of the licensed casinos (this is from Partypoker’s website, I added the quotation marks it was not in the original):

The “””simplest”””  way to obtain face-to-face verification, also known as Customer Identification Performed by a Public Notary, or by Regional or Municipal Authority, is by visiting your nearest Czech POINT or a municipal office.
Please make sure you bring the following to the Czech POINT/municipal office:
A government issued photographic identification document (Passport or ID Card)
A second ID document as a backup (Photographic ID, Driver’s Licence, Utility Bill, Travel Card etc. issued in your name)
CZK 200 for the service – This will be refunded in full to your partypoker account once the full verification process has been completed.

It’s a joke, so not only can the properly licensed, legally operating casinos not offer any bonuses, promotions and have to pay high taxes, players have to do all this just to be able to play…. Unbelievable… No wonder William Hill a (a gambling giant) left the Czech market. This is insane. Meanwhile casinos registered in other EU countries are not blocked, have fantastic promotions, including free spins, free money, and you can upload your ID for verification (like you should be able to do in the 21.st century) and that’s good enough for them. And they pay no taxes to the Czech government… Whoever is responsible for this mess is so detached from reality and has zero insight into the gambling industry, that at this point the Czech government would be better off hiring random strangers from the street, they could come up with a better system, for a tenth of the price… Right now there is absolutely no point in playing at any of the sad licensed gambling websites within the country (even to buy lottery tickets online I recommend you register at a foreign website), in fact if I were you I would actively avoid Czech licensed gambling websites.

And that is why none of the online casinos I recommend to Czech players are licensed in the country, because I don’t want to torture my Czech visitors with this face-to-face registration. Luckily this is the only country in the world where F-2-F is mandatory, and hopefully it won’t remain so for long.

Apart from all this craziness it’s the usual licensing system, operators (land-based and online) require a license from the Ministry of Finance. Foreign online gambling sites can be legally blocked by ISPs at the government’s request, but this has happened in very few instances. Players are not prosecuted for playing on international gambling sites.

Casino gambling is legal in the Czech Republic, and there are hundreds of casinos in the country. Most of the big casinos in the Czech Republic are situated in or near Prague, often attached to hotels, resorts, spas. Games on offer include most traditional casino games: poker, blackjack, roulette and slot machines. Smaller gambling establishments usually only have slot machines and/or video poker machines.

Domestic online casino gambling is also legal in the Czech Republic since 2016. However, domestic, licensed online casinos can not offer any bonuses, promotions and you need to verify yourself face-to-face, which quite the hassle (see details above). Operators require a licence. Since slot machines were relegated to licensed establishments in 2019 (and much sooner in certain municipalities) now these slot machine companies try to circumvent the laws by placing so called “kvizomats”, trivia machines all over the country. These are usually multiple choice question machines. Right now they are not considered gambling, but the government is very hostile towards this practice, as it is clearly aimed to circumventing the law.*

Bingo is not very well-known in the Czech Republic and bingo games are not often organized, but some of the bigger casinos do have bingo events. Bitcoin is legal in the Czech Republic, and the Czech National Bank has issued several statements regarding the categorization of the virtual currency; the Ministry of Finance also offered legal guidance on trading in Bitcoin. The cryptocurrency is quite popular in the Czech Republic, which is home to many Bitcoin-related startups. However, bitcoin or any other cryptocurrency gambling is not specifically regulated, it is legal and companies require a licence, just like any other form of gambling.

      No! How on earth did you come to this conclusion? The Czech Republic does not issue ANY online gambling licenses right now, as of 2014. Therefore, there are no online casinos based in Prague. However, some online gambling websites (you can see a list in above) registered abroad have gambling licenses (from other countries) that make it possible for them to accept players from CZ, among many other countries.
