Legal status: illegal, players are not prosecuted

Online casino gambling is not allowed based on the gambling laws of Tuvalu. Tuvalu – formerly known as the Ellice Islands – is an island country located in the southern Pacific Ocean, between Hawaii and Australia. The first European to discover the islands was the Spanish navigator Álvaro de Mendaña in 1568. From 1892 until 1916, the Ellice Islands had belonged to the British protectorate.

The islands had served as a base during World War II., and the process of decolonisitaion began after the war. The constitution of the iasland nation was drafted in 1974, and Tuvalu was recognized as a British dependency with its own government the next year. In 1978, Tuvalu became an independent nation, which means that while Britain has had a significant effect on the islands, and English is still an official language, Tuvalu has its own legislation independent from Britain, including the matter of online casino gambling.

There do not appear to be any laws in Tuvalu that would regulate online casino gambling specifically. In fact, the gambling laws of Tuvalu are based on the 1964 Tuvalu Gaming and Lotteries Act. At that point, online casino gambling had not been something to regulate, and though the law was updated in 2008, it still does not explicitly mention online casino gambling. It does state, however, that gambling of any kind where the stakes do not equal the winnings is prohibited; which covers all forms of for-profit gambling, including online casinos.

The organisation of such games is strictly prohibited, which means there are no online casino operators baed in Tuvalu, nor is there any way for online casinos to obtain a Tuvaluan gambling licence. When it comes to individual players, participating in unlawful gambling in public is punishable by a fine of $100. On the other hand, there are no laws againt individuals participating in online casino gambling from their own home, as unlike internet cafés, they are not considered public spaces. Most international online casinos welcome players from Tuvalu.

Land-based casinos in Tuvalu

 

Unlike many other island nations in the Pacific region, Tuvalu has opted not to focus on attracting torists through the casino industry. In fact, in accordance with the casino laws that are currently in effect on the islands, for profit gambling is completely prohibted with a few minor exceptions to the rule. As a result, there are no casinos to be found on the islands.

The prohibition of casino gambling in Tuvalu extends to gaming machines as well: both the operator of gaming machines and any players are subject to being fined. The only form og gambling that is allowed on the islands is where all the stakes are redistributed as winnings for the players, and even then, all players must have the same chance of winning, which severely limits the gambling options of Tuvaluan people, though friendly games are still allowed.

As a result, for locals and tourists alike in Tuvalu, online casino gambling – while it is also not legal strictly speaking – is still the most simple and convenient option.

 

Other forms of online gambling in Tuvalu

 

Similarly to casinos both offline and online, most forms of gambling are prohibited, or at least very limited. in general, all forms of gambling where the operator profits or the chances are unequal are forbidden, which covers the usual operation of lotteries, poker halls and sportsbooks as well.

There appears to be only a single form of gambling that is acceptable on the islands: small stakes lottery, and even that only under special circumstances. In accordance with the Tuvalu Gaming and Lotteries Act, lottery games are only tolerated if they are held for charitable purposes, or in the support of athletic or cultural activities. Even then, the entry fee to such lottery draws is limited at $2, while the maximum prize is set at $1000.

Naturally, these conditions are not exactly conducive to a thriving online gambling market. there are currently no online lottery, online sports betting or online poker sites in Tuvalu. On the other hand, individual players are not prosecuted for playing on international online gambling sites.
