Online casinos in the Netherlands

Legal status: illegal, players are not prosecuted

 

Online casino gambling is currently illegal in the Netherlands for private companies (domestic or foreign), but it is undergoing serious changes. Online casino gambling was a state monopoly, although the last time the two state owned gambling companies (Novo Gaming Netherlands BV – better known as NOVOMATIC, and National Foundation for the Exploitation of Casino Games – better known by the brand name Holland Casinos) had a working online casino was 2007 (these two also own and operate all the 14 casinos, and all the 100+ electronic casinos). There are no state-run online casinos anymore, but private companies are also not allowed in. The biggest problem with the current situation and the reason for all the litigation back-and-forth behind the scenes is that this is entirely against EU regulations (against EU laws meant to protect the unified single market and free competition within the Eurozone). The EU clearly states that if an EU member does not provide a way for an online gambling company (registered in another EU country) to get a local licence, then it can not be prosecuted and fined for accepting players from that country, despite not possessing a local gambling licence. And this is the reason why Dutch players who play online in foreign, unlicensed online casinos are not prosecuted, even though it is clearly illegal* (also according to various legal analyzers the penal code and gambling legislation doesn’t provide for player prosecution at all**). Additionally, the state monopoly on land-based casinos and slot halls is against EU regulations as well (violates free competition) as well.  This confusing situation is expected to be regulated by a new gambling law, the 2019 Bill on Remote Gambling that is expected to come into force in 2022 (but realistically, much later).

Casino gambling in the Netherlands is, in general, in the hands of the state-run Holland Casino group. They operate 14 quite big casinos, in fact Europe’s third biggest casino is here in the Netherlands (see below). While this is the company that used to offer online casino games as well, they no longer do so. In fact, most forms of online gambling, save for sports betting and online lottery (both state monopolies) are no longer offered by any public company. And there are no other companies licensed to offer online casino games in the Netherlands, which means there are no legal ways to play in online casinos in the country. However, because of the discrepancy with EU law some online gambling companies disregard this and a few offshore online casinos accept Dutch players, you can see these below.

Despite this, several international online casino operators have been heavily fined for offering their services within the Netherlands. They have turned to the EU Supreme Court and have countersued the Dutch government, litigation, fines back-and-forth are ongoing, for 7+ years in some cases. In layman’s terms: it’s a mess. In fact, the online casino operated by the state went offline for legal reasons, after years of legal action by private EU companies, the state was pressured to take it offline. Some of the Dutch banks also block financial transactions to foreign online casino sites, though this was done on a voluntary (“voluntary”…) basis and the ISPs also “voluntarily” decided to block some of these private companies.

It is apparent that while the Netherlands is widely considered to have liberal regulations in many areas (marijuana, prostitution, migration, lax punishment for crimes, transgender reassignment surgeries, subsidized abortion on demand, an increasingly non-white underclass dependent on welfare and the government, ties to Open Societies Foundations….), and in the political arena of the EU positions itself as a pro-EU, liberal, pro-free trade, pro-globalist definitely not Christian country (Vereniging Martijn….), that regulatory criticizes and initiates legal action against conservative, sane European countries, it’s clear that when it comes to casinos and online casinos that’s where the political posturing ends (just like Germany btw, and all the DACH countries, birds of a feather…).

Fortunately, online casino gambling in the Netherlands is about to change. In 2019 the Draft Bill on Remote Gambling was recently passed by the Dutch Lower House. If this comes into force in a few years it will allow private companies to acquire Dutch gambling licenses.

Land-based casinos in the Netherlands

Unlike online casino gambling, the regulation of land-based casinos in the Netherlands is much more straightforward. Casinos are legal in the country, and their operation is a monopoly of the state-controlled Holland Casino group.

The chain’s first casino opened in Zandvoort in 1976. Currently, Holland Casino operates 14 casino gambling establishments throughout the Netherlands. While online casino gambling is genuinely expected to be opened to private companies in a few years, there are no actual plans to abolish the monopoly on land-based casino gambling (although there have been talks about it since 2011, the Casino Reform Bill, but they are not yet serious about it, it was only drafted to appease the EU, political maneuvering, so that they can keep on criticising others, while they get to keep their gambling monopoly… disgusting institutionalized deceit and lying).

The largest brick and mortar casinos in the Netherlands are those located in Amsterdam and Rotterdam, unsurprisingly. All the casinos in Netherlands have the same naming scheme, the name of the casinos group Holland Casino + the location. Holland Casino has surprisingly big casinos, some of the biggest in Europe are actually located in the Netherlands (see below).

All of the Holland Casinos have a wide selection of casino games available, though of course this varies from venue to venue. The most popular games are various types of poker, roulette, punto banco, bingo and a variation of blackjack.

UPDATE COVID-19: The casinos of Holland Casino are still open despite the pandemic that originated from China. They only let in a certain number of people at once, you have to register online before visiting the casinos (at www.hollandcasino.nl). You have to select the location first (click ‘Venues’ on the main menu at the top) and then scroll down to the bottom and select a time slot. If there is a free slot you can register.

Apart from the big casinos there are over a 100 smaller so called ‘electronic casinos’, which are slot halls (they only have gaming machines, no card games, dice games or table games). Despite the different brand names (Lucky Jack and Flash Casino) these are also state-owned through Novo Gaming Netherlands BV. All of these slot parlours call themselves casinos for some reason,  but it’s misleading, they are not considered genuine casinos in the gambling industry.

All the dutch casinos are 18+ (most electronic casinos are  21+ interestingly, despite the legal gambling age being lower), ID card and/or passport is need to enter. **Diceball: The game is played with a set of two standard six sided with faces numbered 1 to 6 played on a dice table where players may throw the dice by themselves. Generally in Diceball the Shooter (player who is throwing the dice) attempts to throw the dice as long as possible without throwing a result of a total of seven.

Bitcoin casinos  in the Kingdom of  the Netherlands

The government of Netherlands hasn’t issued any specific laws regarding Bitcoin gambling yet. Cryptocurrencies are still not accepted as digital money in the Netherlands. Therefore there are no bitcoin accepting casinos currently in the country. Even if online gambling will be liberalised in the next few years the online casinos will not be able to accept bitcoins, litecoins or any other alternative digital currency.

If you want place bets online using bitcoins, then a foreign bitcoin gambling website is your only option. One of the online casinos below accept bitcoins and ethereum.

 

 

Other forms of online gambling in the Netherlands

Most types of online gambling in the Netherlands are affected by the same regulations – or lack thereof – as online casinos are. They are, in general, covered by the monopoly of Holland Casino. However, there are no actual licensed online gambling operators when it comes to online poker, online bingo and most other forms of online games.

There are two exceptions to this rule. Sports betting and lotteries are controlled by Nederlandse Loterij and not Holland Casino. Nederlandse Loterij has an online platform. Online sports betting and lottery tickets are available on the website.

Apart from this, Dutch gamblers may also play on any international online gambling site available to them. While the operators may be fined, the players themselves face no repercussions for playing on online gambling sites not licensed in the Netherlands.

 

 

History and future of online casinos in the Netherlands

The first online casino in the Netherlands belonged to the state-run operator Holland Casino and opened in 2000. This online casino was not exactly successful, and closed after only a year.

In 2006, the Dutch Supreme Court decided to allow the Holland Casino to reopen their online casino site. However, this would have gone against European Union regulations that prohibit monopolies on the online gambling market. In compliance with the EU warning, the Dutch Senate voted against the opening of the online casino.

Since then, the Dutch prohibition of online gambling has been challenged several times in front of the European Court. Although these motions failed, the Dutch government decided to implement changes to the online casino regulation anyway.

The new iGaming law was at last passed by the Dutch Lower House in July 2016 at first. This legislation was expected to come into effect in early 2018. Obviously that didn’t happen, and it expired. And since then the draft bill on Remote Gambling was passed once again in 2019. This bill mandates the privatization and the establishment of a licensing system. They say it will come into force in a few years, just like last time. I wonder if this is just political maneuvering to appease the EU or are they really serious about privatising their online gambling market? While this may seem like great news to online casino operators and players alike, there are some problems with the new regulation. Namely, the new law sets the online gambling tax also at 29% of gross gaming revenue, which made experts at the German economic and legal research consultancy Academicon fear for the future of the Dutch online casino sector. *

Also, the state monopoly of the land-based casinos is also against EU rules. When will that be addressed? It’s not even on the radar.
