Although most European countries have realized the need for a regulated online casino market and have moved toward controlled legalisation, that is not quite the case with Germany. In fact, the German online casino and gambling regulation is probably the most needlessly complicated and inefficient in the region (and also conflicts with EU laws and regulations). This is really weird considering that Germany likes to call out and criticise the systems of other countries ( mostly Eastern and Central European), gambling laws and how they are not EU complaint, even though their own system is worse, and not EU complaint as well…

In order to understand  even the basics of the confusing German system, we have to take a closer look at the German political system first.

The Federal Republic of Germany is made up of 16 federal states or Bundesländer. Each of them are autonomous to a large extent, but are subject to decisions on various topics to the federal “parliament”, or Bundesrat. In theory, the states could legislate for themselves when it comes to online casino gambling (and Schleswig-Holstein did just that up till 2012). However, online casinos are currently banned by an interstate treaty, which the 16 states ratified in 2008 except  Schleswig-Holstein (Interstate Treaty on Gambling 2012, last modified in 2019*).

The Glücksspielstaatsvertrag, or interstate gambling treaty signed by 15 out of 16 states came into effect in 2008. The treaty banned all forms of online gambling, including online casinos in most of Germany. The only state that decided not to join the treaty was Schleswig-Holstein.

Although the law was changed in 2011 (effective in 2012) allowing certain forms of online gambling, online casinos have remained banned ever since. Schleswig-Holstein ratified the modified version with the rest of the states in 2012, which means this amended form of the Glücksspielstaatsvertrag now applies to all of Germany. However, by that time they have already issued 23 online casino licences and 25 sports betting licences. These licenses were originally meant to expire but in 2019 they decided to extend them all. The 23 online casinos licensed in Schleswig-Holstein are the only legal, licensed, local options German players have right now (you can find a list of online casinos accepting German players below).

Despite the strict regulations and the ban on online casinos, the casinos licensed in Schleswig-Holstein can accept players from all over Germany, and also, a 2016 EU top court ruling stated that Germany can not penalize or restrict unlicensed foreign operators, because they made it impossible for them to acquire licenses**. So right now unlicensed, unregistered online casinos form other countries, which do not pay any taxes can accept players from Germany without any problems, fully legally…. You can see why the German system is trash and why thy shouldn’t criticise other countries. This is a joke.

UPDATE 2021: The German government realized what a mess their system is. In theory, from 2021 July 1 online poker and online casino gambling will be legal on a state level. A new regulatory authority will be created as well, which will handle the licensing of online casinos. From 2021 July 1, only licensed online casinos can accept players from Germany.

Land-based casinos in Germany

 

Unlike online casinos, land-based casinos are legal in Germany and have been for quite a while. The first German casino is said to have opened in 1720 in Bad Ems. Even today, many of the spa towns (Bad means bath or spa) in Germany host casinos, and of course all of the larger cities.

While the online casino gambling market is restricted by an interstate treaty, land-based casinos in Germany are regulated on state-level, not federally. Although there is a way for private companies to obtain casino licences, most brick and mortar casinos in Germany are owned by the state, about 50% and they are run by subcontractors (another thing they often criticise other countries for, the lack of privately owned casinos, when in reality they are one of the worst offenders…, this also violates the EU directive of free competition too). Currently there are a 100 licensed casinos in Germany.

UPDATE: The exact number of casinos in Germany is not known currently, because of the COVID-19 many of the casinos are temporarily closed and a few of them will definitely not survive this crisis.

All 16 states allow and have casinos, and though there are some differences, the minimum age of entry is at least 18 throughout Germany, and all casinos are non-smoking (except for the designated area), and most of them are only open between noon and 3 am.

Most of the 100 casinos in Germany are “Vegas-style” complexes with hotels, restaurants, bars, entertainment venues, shows and some even have sports bars which are sports books too where you can watch sports and bet on live games. Many of the establishments have dress codes and entrance fees (you can read about it below at the casino list).

In terms of actual casino games: roulette, blackjack, poker, baccarat and various slot machines are all present in these establishments, all of them are legal and allowed in casinos unlike is some other countries (fun fact: sports betting is more strictly regulated, various forms of sport betting are outlawed entirely). Apart from the large, elegant casinos there are also many arcades in Germany where only slot machines, video poker machines and electronic roulette machines are available.

Casinos are called Spielbank in German, and most of them have spielbank written over the gate or the building, instead of casino, don’t get confused. Also spielbank is almost always in the name as well.

 

Gambling tax in Germany

Casinos, online casinos and online poker sites have to pay 19% of the gross gaming revenue (the amount wagered by players less the winnings paid out to players). This is on top of regular taxes, VAT is applicable too. The German tax rate is considered an average gambling tax rate in Europe, but it’s high if compared globally.

The casino has 350 slots (the slot machines are arranged by theme, which is a very good idea, wish more casinos would do the same), there are 26 live dealer tables (5 Blackjack 5, 10 and 20 €, Roulette, 9 Ultimate Texas Hold Em), 5 poker tables (Pot Limit Omaha, and Texas Hold Em).

There 5 electronic roulette stations (some multi roulette) there is a slots jackpot system, the “Mystery Jackpot” is the brand new luxury Mercedes standing on a platform and waiting for its new owner.

The casino floor opens at 11 AM every day for slots only. Table games do not start until 3 PM. The floor closes at 3 AM on weekdays, and 4 AM on Fridays and Saturdays.

Spielbank Berlin was originally located at ZOO of Berlin (from 1975-1998). But it now has it’s own imposing 3 story building. The entrance fee is €2.50. The casino has 300 slot machines and 12 tables (4 blackjack and 8 roulette, some of them are high roller, high limit tables) + electronic roulette an video poker machines (no info on the website on how many).

There is sometimes live music, and a restaurant and interestingly a theater. There is really nice, separate poker floor with 8 poker tables that opens at 6pm daily and has constant cash games, regular tournaments. Even really big poker tournaments stop here, the WSOP has events here multiple times and The German Poker Tour stops here regularly.

Poker is available from Sunday to Thursday from 6pm, until further notice, reservations can only be made for the same day via the reception (from 3pm).
You have to register by phone, because their shitty website can’t do even that.

There is an entrance fee of €2.50 to play poker and table games. Casual wear is okay for the slots parlour but at least a polo shirt and jacket for men and a dress for the ladies is a requirement to play at the tables. A jacket is provided if you do not have one (a dress is not provided). Joyce restaurant is also part of the complex along with Club Grace a night club with live music.

*There is no European roulette, many websites claim that casino Stuttgart has European roulette as well, but right now, at the time of writing, no they don’t have European roulette, just inferior American which is very weird for a European casino. Because it has worse odds (worse RTP), worse for the player, you lose more and faster compared to European roulette (you can learn more about American roulette here). Also, this is not the only German casino that only has American roulette, weird, bad optics for these European casinos.

Casino Saarbrücken is situated next to the French border and it is in the capital of Saarland (expect French tourists and casino staff speaks French). This casino in Hannover (Hannover has three casinos, the others Spielbank Niedersachsen and Spiel mit, but Spiel mit seems to have closed permanently due to COVID-19)  has 141 slots, 30 electronic roulette stations and 5 live dealer tables (4 american roulette, 1 blackjack).

The Hannover casino is one of the few places that organizes bingo games. There is also a separate poker room, open all day, cash games every day.

Casino Hannover has a restaurant/bar Lucky Dinner. The casino doesn’t have a hotel, but it is partnered with hotels nearby with free shuttle services to and from the casino.

 

 

UPDATE COVID-19: Not all of these casinos are closed due to COVID-19, most of them operate at a limited capacity and they are open for a limited time only, but they are still open. The interstate treaty of 2008 banned all forms of online gambling in 15 out of 16 German states apart from wagering on horse races.

In 2012 the near-complete ban on online gambling in Germany was rescinded. Online lotteries may now be legally operated. The most popular lottery is the Lotto 6aus49 which, as the name suggests, is a 6 out of 49 number game of the national lottery Lottery and Tote Association (Deutscher Lotto und Totoblock).

Online sports betting has also been liberalised to some extent by the 2012 changes. The law now states that a maximum of 20 online sports betting licences may be issued federally. The law has most likely been changed due to the fact that Germany had no way of stopping local players from using international online sportsbooks, which are very popular among the residents.

 

 

 

History of online casino regulation in Germany

 

In the past decade or so, Germany has seemed desperate to control all aspects of online casino gambling within their country. However, seeing as Germany is a member of the European Union, their options are severely limited. Along with the treaty banning online gambling, the proposition also included having ISPs block foreign online casino sites and making gambling-related payments impossible.
