Legal status: legal, state monopoly of Veikkaus Oy and PAF, however players can play freely online due to EU laws, explained below
Online casino gambling is legal in Finland, although it is heavily regulated. There is a state-owned company, Veikkaus Oy (established in 2017, from a merger of three companies: RAY, Fintoto, Veikkaus). This company has a monopoly over all online casino gambling on the Finnish mainland.
While this regulation is quite strict, there are some loopholes. The biggest one is the autonomous region of the Åland islands, which belongs to the Republic of Finland, but it has its own gambling monopoly, PAF (Penningautomatförening).
PAF (also a monopoly) is in charge of all gambling in the Åland Islands, including online casino gambling.
The problem is that PAF operates in an autonomous zone of Finland, but they made their online casino site available to all Finnish players, even players from outside of Åland Islands can register and play. Veikkaus Oy felt that PAF was infringing on their rights as the sole operator of online casino games in Finland.
The conflict escalated to the point where Veikkaus Oy (back then RAY, as it was before 2017, before the merge) sent police officers to raid the offices of PAF, in order to have them shut down.
The Finnish government finally managed to put an end to the conflict after years of litigation and mounting legal expenses on both sides (paid for by the tax payers….). Currently both companies have their own online casino site, and both are allowed to offer online casino games to all Finnish players, including the Finnish autonomous territories: Greenland and the Faroe Islands.
The only two domestic Finnish online casinos are the platforms of Veikkaus Oy and PAF.
The other big loophole in the online casino legislation of Finland is that the country has been a member of the EU since 1995.
Because Finland is an EU country, Article 56 TFEU1 (EU gambling directives) apply. This says that other EU online gambling companies should be provided access to the Finnish market, and a way to obtain local online casinos licenses. However, no local gambling licenses are issued, and according to some interpretation of EU laws, foreign online gambling websites can not be blocked or prosecuted in this case (because they can not get a licence).
There have been many issues, and litigation behind scenes on an EU level because of this Finnish gambling monopolies (their monopoly status is also against EU laws btw.), but the EU has refused to take action, because the Finnish gambling monopiles are essentially non-profit companies and all profits are spent on socially beneficial projects.
/Comment: Many European countries are in similar situations. The verdicts of the EU top court are very diverse and context dependent. E.g.: Germany was in a similar situation. It did not issue online casino licenses prior to 2021, and the EU top court ruled that Germany can not block or prosecute these unlicensed operators (or their German players) because they didn’t provide them with away to obtain local online casino licenses2./
Conclusion: Right now the government insist that Finnish citizens can only play in the online casinos of Veikkaus Oy and PAF. Foreign online casinos dispute this, and it is very likely that this violates EU laws. Offshore online gambling companies continue to accept players from Finland (you can see these online casinos below). Players who play in these digital casinos are not prosecuted in any way3, Finnish players can freely use these websites. Offshore online casinos, which accept players from Finland have also not been prosecuted by the EU.
This is a complicated issue that is far from being settled, and many more lawsuits are expected. The EU courts are very slow, therefore the situation won’t likely improve for the foreseeable future.
What is certain is that international gambling sites are forbidden to advertise within the country, and some of the biggest gambling platforms are blocked, despite that this contravenes EU directives, as discussed above.
