Gambling guide Slovenia

 

Legal gambling was first introduced in Slovenia (then a part of Yugoslavia) in the ’60, but initially merely as a means to collect funds for charitable purposes. Only in the second half of the decade was the first legal casino in Slovenia established. The Slovenian Gaming Act was introduced in 1965. The first casino, Casino Portorož was opened a year before the enactment of the Act, as a pilot project. In subsequent years, several others followed, although players were only allowed in these venues in possession of a foreign passport and wagers could only be made in foreign currencies. Locals were restricted from gambling in casinos, as the activity was deemed irreconcilable with the socialist values.

The government was more tolerant towards lottery by this time, as the profits of the game went to public funds and were redistributed in society. Initially, casinos in Slovenia could only be established at major tourist destinations that had one thousand tourist beds and at least two hundred thousand overnight stays by foreign tourists per year*. Later the criteria was made less stringent to allow cities near the Italian border, like Nova Gorica to lure in the masses of Italian tourist-gamblers. The ban on locals entering gambling venues was also abolished, eventually.

The casino sector continued to develop in the subsequent decades. By 1991, Slovenia gained independence with the disunion of Yugoslavia. However, until the Slovenian Gaming Act was enacted in 1995, there was no clear legal framework for controlling and licensing the gambling scene and casinos in Slovenia.

Casinos are legal and regulated in Slovenia nowadays, and they account for a large portion of the state’s revenues from tourismHowever, online gambling is still a grey area in the country. There is a currently a draft legislation being discussed by regulators called the New Gaming Act, which would make online gambling expressly legal and allow operators to obtain a licence in the country**. It would also impose fines and possible ISP bans on sites that offer their services on the Slovenian market devoid of a licence.

Currently, the only legal provider of online gambling in Slovenia is the National Lottery and there are also regulations in place, that prohibit foreign operators from advertising their products on the Slovenian market.

Despite this, foreign online platforms are not being blocked and Slovenian players gambling on such sites are not prosecuted.

Bingo in Slovenia

 

Online bingo in Slovenia: not regulated

 

Land based bingo in Slovenia is legal since the ’60s, although initially, it was only allowed to be conducted occasionally, in support of charitable causes. Later it was deemed a form of “classic gambling” (as opposed to casino gambling, the other category of games defined in the legislation) by the Gaming Act of 1964, and as such could only be offered by the two state-backed companies, Loterija Slovenije and Športna loterija. According to the current regulations, bingo games can be legally conducted in any licensed land based casino in Slovenia.

Online bingo, as all forms of online gambling not conducted by the state lottery, is technically illegal. However, players of foreign online platforms are not prosecuted and the government does not block online gambling sites, for now.

Sports betting in Slovenia

 

Online sports betting in Slovenia: not regulated

 

The only licensed and legal bookmaker in Slovenia is the state backed Sportna Loterija, which has plenty of land based betting shops around the country, as well as an online platform. It also launched a virtual sports betting product last year, on software provided by the company Inspired Gaming*.

Foreign online sportsbooks occupy a legal grey area in the country. In 2006, the government attempted to block the two most popular foreign sports betting sites: bwin.com, and bet-at-home.com. However, without the requisite legal statutes in place, most ISPs in the country refused to comply with the government’s request**. For now, no such sites are being blocked and players are not prosecuted for placing bets with foreign online bookmaker.

Foreign online lotteries (as all forms of unlicensed online gambling in Slovenia) are not yet regulated, but the state does not enforce an ISP ban on such sites, nor are players prosecuted for taking part in lottery draws of foreign online platforms.

On December 23, 2013, the Ministry of Finance of the Republic of Slovenia issued a formal opinion about the status of Bitcoin and other virtual currencies in response to a request from the Tax Administration of the Republic of Slovenia. The opinion states that Bitcoin is not a monetary means under Slovenian law and not a financial instrument.

Online gambling in itself, is a grey area in Slovenia, and virtual currencies as well. We’re yet to see, whether the New Gaming Act will address gambling in virtual currencies in specific, but for now, Bitcoin gambling is clearly in a legal vacuum in Slovenia, playing on foreign Bitcoin gambling sites is not in any way criminalised under Slovenian law.
