Guide to Gambling in Greece

 

Greece, officially the Hellenic Republic, is a country located in southeastern Europe. The country is a member of the European Union. Most forms of gambling and online gambling are the monopoly of OPAP A.E. (English name: Greek Organisation of Football Prognostics S.A, was state owned, now privatized).

Gambling and online gambling are legal in Greece currently regulated by the Law 4002/2011. Gambling is only allowed within casinos spaces (inside casinos with a valid license) and not in public. The lottery, sports betting are a monopoly of OPAP A.E. until 2020.

Gambling has been legal since antiquity in Greece, but the modern history of it is intertwined  with OPAP and the Greek state, and it start in 1958.

OPAP had a monopoly on almost all forms of gambling since its inception in 1958 (the notable exception are land-based casinos). It was state owned, but over time, due to pressure by the EU and after various scandals it was privatised. In 2013 in the wake of the 2008 financial crisis and the huge debt crisis of Greece the state sold its last 33% share in the company (remember the year 2013, it will come up in the online gambling section below). Now it’s entirely privately owned and traded.
The EU constantly attacks, criticizes and tries to dismantle the monopoly on gambling within the country, because it is not compliant with EU law. That is absolutely true, but in all fairness so are the gambling systems of most EU countries actually…. (including Germany’s, the de-fact leader of the EU currently!). So Greece is by no means the only one with state monopolies and government interference in the gambling sector, sadly this is the more the norm rather then an exception within the EU (and when it comes to lotteries this is true globally too btw.). None of the EU countries lives up to the expectations of the EU, which tells you all you need to know about it….

Despite the EU’s attempts, and despite a wave of privatizations after 2008 OPAP has managed to retain a monopoly on sports betting and lottery until 2020, and a monopoly on casino gambling until 2030.*

Online gambling in Greece is also legal since 2012 according to the Decision No. 23/3/23.10.2012 of the Hellenic Gaming Commission. All forms of online gambling including online sports betting, online lottery, online casino gambling are a monopoly of OPAP until 2030.

For a long time the Greek government was strongly against online gambling, and it was illegal. However, when online casinos, bookmakers started to appear en masse in the early 2000s, the Greek government made online gambling officially legal in 2012. They briefly issued a bunch of licenses to companies in 2012 (some say they only wanted the licensing fee, 24 licenses were issued). However, they also wanted to make online gambling a monopoly of OPAP A.E. (back then the company was still 33% state owned) to prevent foreign online casinos from establishing a market presence (which they were already doing despite the ban). They hoped this would drastically increase the value of the company. Backstabbing the licensed operators, they made online gambling a monopoly of OPAP A.E. in 2013, and shortly after they sold all their shares (if a private person or company would have done the same they would be in jail btw…,). The state made hefty profit (though less than expected, just like today most players in Greece play in foreign, offshore online casinos, instead of OPAP’s online casinos). And even though the licensed companies (the ones who got a license in 2012) sued the government, and the CJEU (Court of Justice of the EU) declared this monopoly to be illegal ,it’s still in effect ever since. OPAP has a monopoly on all forms of online gambling till 2030.

/OPAP is a to put it lightly a controversial actor, not just in Greece, but also in Cyprus, where they have a very strong market presence (you can read about Cyprus gambling here) and there are problems with the company in pretty much every country where they have an operation…/

Online gambling in Greece is still a heated, controversial topic. The country was accused of protectionism, corruption and violating EU law by multiple online gambling operators, multiple times in the last 10 years. However, the situation seemed to be resolved. In 2016 January the Greek government announced, that they will be opening up the online gambling market and will be issuing online gambling licenses sometime in the future.** We are still waiting for that to happen…. In the meantime OPAP still has a monopoly over online gambling and ISPs sporadically block foreign online gambling websites. However, many foreign online gambling sites already accept players from Greece even without a license and the EU ruled (article 50 paragraph 12, free trade and competition within the eurozone) that it is not illegal because it’s not possible to acquire a license right now (because of the monopoly). Therefore players who place bets on foreign gambling websites are not prosecuted at all and you can just ignore the monopoly if you live in Greece. UPDATE 2020: Greece is in the process of rolling out the new licensing system, OPAP’s monopoly on online gambling is null and void, companies can apply for a licence although the details are not yet out, many of them already submitted their applications. This opens up the Greek online gambling market, licence fee is €3m for sports betting, €2 for online casino gambling

 

Interestingly in Greece the number of slot machines (called video lottery machines in the legislation) is permanently restricted to 25 000 and what is worse you can only get them from OPAP A.E:, so even if the casino is not owned by OPAP (and most of them are) they still have to get their slot machines from them and give them a cut… (this is probably the most disgusting system in all of Europe, I’ve been writing about gambling laws for 8 years now, this is evil, it’s rare to see something like this).

Hellenic Gaming Commission is responsible for the licensing system. The following types of gambling licenses can be acquired in Greece currently:

  • Licence A: valid for up to 30 slot machines
  • Licence B: valid for up to 50 slot machines
  • Licence C: valid for “mixed facilities” if you want something else besides slot machines, any number of slto machines
  • Licence D: for gaming machines on sea vessels
  • Licence E: for gaming machines on sea vessels which are engaged in international voyage
  • Licence F: up to 15 slot machines in OPAPA A.E agencies (OPAP has its own licence category…)

In addition the law differentiates between casinos with 3 star hotels, or less (or no hotels), these establishments can get a simple type licence for 15 years. Casinos with 5 stars hotels can get a wider type licence valid for 30 years.

The legal gambling age in Greece is 21.

Gambling tax in Greece

The gambling tax in Greece is 35% for all types of gambling (20% of this tax revenue must be spent on ‘good causes’, 30% in case of horse racing betting)

In addition the winnings of the players are taxed as well (if it’s over €100):

Land-based gambling is legal and regulated in Greece. But there aren’t many brick-and-mortar casinos in Greece. Online casino gambling was for a long time a monopoly of OPAP, just now, recently, the new licensing system is being rolled-out. Bingo in Greece

 

Online bingo in Greece: legal, requires a licence

 

Gambling is legal in Greece, including bingo, which is a game of chance and perhaps a lottery-type game. The problem is that it’s never defined specifically in the gambling legislation of Greece, so no one knows for sure. If it’s a lottery-type game, then that’s the monopoly of OPAP and they don’t do bingo at all, so that’s the end of that. If it’s a casino game, then it’s theoretically possible to get a licence (LICENCE C would be that) and after that you would have to ask for permission from the Hellenic Gambling Commission.

Right now the only thing that is certain is that according Article 25 of Law 4002/2011, the following conditions have to be met in order for a game to be defined as gambling:

  • the result of the game must depend, even partly, on the influence of luck;
  • there must be a wager or bet

And bingo fulfills these criteria, so it’s a game of chance, therefore it needs a licence. The rest is up to the Hellenic Gambling Commission, and because nobody organizes bingo games in all of Greece they are probably not very forthcoming. The way I interpret the legislation is that bingo is legal, requires a licence, licence C and permission from the HGC. And now that online gambling is no longer a monopoly of OPAP it’s possible to get a licence for online bingo as well (so far there are no licensed bingo websites). OPAP doesn’t have a bingo website or any bingo games on their websites, the closest thing is the Bingo Lotto but that’s not real bingo, the name is misleading.

In the meantime, Greek players are free to visit and play bingo on foreign websites.

Land-based poker is legal in Greece and players can enjoy it at the casinos around the country. Online poker was a monopoly of OPAP until just recently, but the company did not utilize this and it does not have any poker websites. However, players from Greece can play poker at numerous offshore, foreign online poker websites (you can find some below) and they are not prosecuted for this. According to the 2016 EU justice court ruling it’s not illegal and players can not be prosecuted for it within the EU. Sports betting is the second most popular form of gambling in Greece (after lottery). There are numerous OPAP land-based bookmakers where players can bet on their favorite sports. However, none of the licenses are issued yet, we will update this section when that happens.

OPAP interestingly does virtual sports betting too, which is like real sports betting but you are only betting on a computer simulation of a real event. OPAP’s online platform apart from this is subpar, there are barely any sports to bet on online (grey hounds, horses and virtual sports only) considering that they make an unbelievable amount of money because of the monopoly this is shit, literal garbage. That’s the best you could come up with in 10+ years making hundreds of millions of €? Seriously… A perfect example of why monopolies are a bad idea, how they stifle innovation and development. I really don’t recommend this lazy, problematic company. Don’t support them with your money, use a foreign sports betting website instead. They are better in every way.

Lottery in Greece

 

Online lottery in Greece: legal, monopoly of OPAP

Lottery is the most common form of gambling in Greece and in most countries. Lottery and lottery-type games (raffles, instant games, scratch card) and their online versions are the monopoly of  OPAP A.E.. Greece is one of the few countries where the lottery is not state owned anymore, because OPAP is now a private company.  Currently, OPAP controls online lottery and the online sale and distribution of other lottery type games (Lotto 6/49, Joker 5/45 + 1/20, Tzoker, scratch cards, keno, Joker, Kino, Proto, and Extra 5 etc…).
Greece is not participating in the EuroMillions or EuroJackpot European lottery draws. OPAP for a long time didn’t sell lottery tickets online, they still don’t sell most types, but now they have Tzoker, which can be bought online. (What’s taking them so long? Counting money they make on being a monopoly eats up all their time? Seriously… This is a shit company, this is OPAP is probably one of the worst European gambling monopolies. At least the others put in a decent effort. Avoid them.)

Greek people can purchase lottery tickets from foreign lottery companies when they are abroad vacationing or they can do it online using various lottery websites. Players are not prosecuted for this, and if you win money on the lottery of a foreign country you will get it. But you will have to travel there to collect it (unless of course it’s an online lottery). So even though OPAP doesn’t participate in Euromillions or Eurojackpot you don’t have to miss out and I recommend those instead of the subpar local lottery. They are better in every way.

No specific legislation on bitcoins exists in Greece. As of now, there aren’t any specific laws in Greece regulating bitcoin gambling either. Online gambling was a monopoly of OPAP up until recently. None of OPAP’s land-based or online platforms accept bitcoin or any cryptocurrency. But right now it’s finally possible to get an online gambling license in Greece for the first time since 2012. Therefore, maybe the new online casinos coming to Greece will accept cryptocurrencies. Will see.

      You are using VPN, or you are currently in Greece and based on your IP address the website thinks you are a Greek citizen. To find type in Google “IP geo location” and you will see where your IP address is currently located.
