Simon’s Guide to Gambling, Land Based and Online Casinos – Peru

Many forms of gambling, such as poker, lotteries, betting and casinos in Peru are legal and licensed by authorities. Peruvian law distinguishes between 3 basic legal categories, when it comes to gambling:

  • games that are legal and regulated,
  • games that are expressly banned.
  • and games, which are not authorised, but not specifically outlawed either.

Most forms of land based gambling, (including brick and mortar casinos in Peru) fall into the first category (legal). Brick and mortar gambling facilities are legal and strictly regulated in the country. Authorities were very active in this field the past couple of years. As a result of concentrated effort, tax income generated by the industry has increased more than threefold since 2007, and there are now 70,000 slot machines in 700 slot parlors and 22 casinos. All of these establishments operate legally now, which is quite a change, considering just a few years ago illegal gambling was abundant in the country.

All online gambling, on the other hand arguably falls into the third category (not regulated). This means that no specific regulatory framework exists for such operations in the country. However, neither playing online, nor running an online gambling website (such as a poker site or an online casino) is restricted by authorities in Peru currently*. Recently, a draft regulation was proposed by Peruvian legislators that would regulate and clear up the legal situation of online gambling providers in the country. The new law would require operators to have a physical branch in Peru and pay taxes – reportedly between 15-20% additional gambling tax**.

For the time being, Peruvian citizens can legally set up online gambling businesses in the country and local players can also gamble on the websites of all major international operators without having to worry about the authorities.

Land based bingo appears to be legal and regulated. Nevertheless, it does not seem to be an especially popular form of gambling in Peru. Traditional (offline) sports betting is legal and regulated in Peru. Legal betting shops can be found all through the country. Horserace betting is also legal and available. The only racetrack in the country is the Hipódromo de Monterrico. Punters can bet on the races held here both on the spot and in land based, offtrack betting shops. The Jockey Club del Perú, the organisation conducting the races at Hipódromo de Monterrico signed a deal with Sportech Racing and Digital earlier this year, to set up an online betting site*. It will most likely launch in the next couple of months.

Online gambling is not specifically regulated, therefore, operating an online sportsbook from Peru as well placing bets with foreign online bookmakers is not illegal in the country.

Lottery is not a state monopoly in Peru. Currently, there are two lottery providers legally operating in the country. Intralot is the more popular of the two. It entered the market by buying out Peru’s first lottery, “La Tinka” (established in 1994) in 2003. In 2005, Scientific Games also began operating its own lottery after buying out La Tinka’s competitor, “La Grande.” Intralot offers lottery tickets online as well, and some interactive scratch card games*.

Peruvian players are not restricted from participating in foreign online lottery draws either.

There are no restrictions in place on Bitcoin or other digital currencies in Peru. However, there is no info on the stance of Peruvian authorities on Bitcoin gambling. We’re yet to see, whether local authorities will approve any local Bitcoin gambling operations.

Online gambling is unregulated in the country and players are free to access foreign internet gambling sites. There is no information available on government websites specifically about bitcoin gambling.
